RESOLUTION NO. 1 -4
SC L TIC NAPPROT17NG THE DEVELOPER'S AGREEMENT FOR TFI F"IhST PHASE
OF THE VILLAGE PRESERVE SIL ENTIAL SUBDIVISION
WHEREAS, the City of Labe Elmo is a municipal corporation organized and existing
under the laws of the State of Min esota and
WHEREAS, t3W SA Land Development, LLC, 10850 Old County Road 15, Suite 200,
Plymouth; MN 55441 "Applicant" has previously submitted an application to the City of Lake
Elmo ("City") for a Final Plat for Village Preserve; and
WHEREAS, the Lake Elmo City Council considered and approved the Preliminary Plat
request for Village Preserve at a meeting held on July 15, 2014; and
WHEREAS, The Lake Elmo City Council adapted Resolution No. 201 - 4 on May 5th;
215 approving the Final Plat for Village Preserve; and
WHEREAS, Condition 3 of said Resolution No. 115-34 establishes that, prior to the
execution of the Final Plat by City officials, the Applicant is to enter into a Developer's
Agreement with the City; and
WHEREAS, the Applicant and City have agreed to enter into such a contract, and a copy
of the Developer's Agreement was submitted to the City Council for consideration at its June 2,
2015 meeting
NOW, THEREFORE, based on the information received, the City Council of the City
of Lake Elmo sloes hereby approve the Developer's Agreement for Village Preserve and
authorizes the Mayor and City Clerk to execute the document.
