HomeMy WebLinkAboutFINAL ORDINANCE NO. 2012-063Ordinance 2012-63 Council; 1012112 CITY OF LAKE ELMO COUNTY OF WASHINGTON STATE OF MINNESOTA ORDINANCE 2012-63 AN ORDINANCE AMENDING THE SHORELAND STANDARDS SECTION OF THE GENERAL PROVISIONS TO REVISE THE REQUIRED SETBACK FROM THE OHW LEVEL FOR WATER - ORIENTED ACCESSORY STRUCTURES BASED ON MINNESOTA STATE STATUTES SECTION 1. The City Council of the City of Lake Elmo hereby amends Title XV: Land Usage; Chapter 150: General Provisions, as follows: § 150.255 SHORELAND STANDARDS D) Placement, Design, and Height of Structures (2) Design Criteria for Structures b. Water -Oriented Accessory Structures 1. The structure or facility must not exceed 13 feet in height, exclusive of safety rails, and cannot occupy an area greater than 250 square feet. Detached decks must not exceed 8 feet above grade at any point. 2. The setback of the structure or facility landward from the ordinary high water level must be at least -20 10 feet on a recreational development lake and 50 feet on a natural environment lake. 3. The structure or facility must be treated to reduce visibility as viewed from public waters and adjacent shorelands by vegetation, topography, increased setbacks, or color, assuming summer, leaf -on conditions. 4. The roof may be used as a deck with safety rails, but must not be enclosed or used as a storage area. The structure or facility must not be designed or used for human habitation and must not contain water supply or sewage treatment facilities. 6. As an alternative for general development and recreational development waterbodies, water -oriented accessory structures used solely for watercraft storage, and including storage of related boating and water -oriented sporting equipment, may occupy an area up to 400 square feet provided the maximum width of the structure is 20 feet as measured parallel to the configuration of the shoreline. Ordinance 2012-63 Council; 1012112 SECTION 2. Effective Date This ordinance shall become effective immediately upon adoption and publication in the official newspaper of the City of Lake Elmo. SECTION 3. Adoption Date This Ordinance No. 2012-63 was adopted on this 2nd day of October 2012, by a vote of Ayes and Nays. Dean A.
