STATE OF MINNESOTA <br />COUNTY OF WASHINGTON <br />CITY OF LAKE ELMO <br />ORDINANCE NO.08-034 <br />AN ORDINANCE APPROVING THE BUFFER SETBACKS IN THE MEYERS <br />PINERIDGE DEVELOPMENT - AN OPEN SPACE PRESERVATION (OP) <br />DEVELOPMENTS <br />WHEREAS, Section 150.180, Subd. (B,2,d) of the City Code prescribes specific buffer <br />setbacks requirements within OP — Open Space Preservation developments; and <br />WHEREAS, prior to 2009, the buffer setbacks required by the City Code have not been <br />observed in many of the City's OP — Open Space developments due to either the lot arrangement <br />approved by the City at the time of subdivision approval or the setbacks approved as part of the <br />building permits review in OP Zoning Districts; and <br />WHEREAS, the City Council finds that it is in the best interests of the City and its <br />residents within OP — Open Space Preservation Zoning Districts to clarify the required buffer <br />setback within each OP — Open Space development, including the Meyers Pineridge <br />development; and <br />WHEREAS, the Planning Commission reviewed the proposed buffer setbacks, held a <br />public hearing at their regular meeting held November 8, 2010, and recommended approval of <br />the OP — Open Space Preservation Buffer Setbacks as identified in the chart below; and <br />NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Lake <br />Elmo, Washington County, Minnesota, that buffer setbacks be applied from the edge of OP — <br />Open Space Preservation Zoning Districts as follows: <br />Recommended Buffer Setbacks in OP Develo ments in feet <br />North <br />Ede <br />South <br />Ede <br />West <br />Ede <br />East <br />Ede <br />Exception <br />Parcel(s) <br />Meyers Pineridge <br />50 <br />50 <br />100 <br />200 <br />5010 Keats Ave (Meyers Pineridge) <br />0 <br />0 <br />0 <br />0 <br />
