CITY OF LAKE ELMO <br />COUNTY OF WASHINGTON <br />STATE OF MINNESOTA <br />ORDINANCE NO. 08-016 <br />AN ORDINANCE ADOPTING REGULATIONS TO GOVERN STORM WATER AND <br />EROSION AND SEDIMENT CONTROL IN THE CITY OF LAKE ELMO <br />Section 1. The City Council of the City of Lake Elmo hereby ordains that Sections 150.280 <br />thru 150.296 of the Lake Elmo City Code are to read as follows: <br />Sections: <br />150.280 Statutory Authorization <br />150.281 Findings <br />150.282 Purpose <br />150.283 Applicability <br />150.284 Definitions <br />150.285 Incorporations by Reference <br />150.286 Plan Review Procedure <br />150.287 Performance and Design Standards <br />150.288 Storm Water Facility Maintenance <br />150.289 Monitoring and Inspections <br />150.290 Enforcement <br />150.291 Financial Securities <br />150.292 Storm Water Utility <br />150.293 Lawn Fertilizer Regulations <br />150.294 Other Controls <br />150.295 Severability <br />150.296 Authority <br />STORM WATER AND EROSION AND SEDIMENT CONTROL <br />150.280 STATUTORY AUTHORIZATION. <br />(A) This ordinance is adopted pursuant to the authorization and policies contained in <br />Minnesota Statutes Chapters 103B, 103F.401, 103F.441, and 462 and Minnesota Rules <br />Chapters 7050, 7090, and 8410. This ordinance is intended to meet the current <br />construction site erosion and sediment control and post -construction storm water <br />management regulatory requirements for construction activity and small construction <br />activity (NPDES Permit) as defined in 40 CFR pt. 122.26(b)(14)(x) and (b)(15), <br />respectively. <br />150.281 FINDINGS. <br />(A) The City of Lake Elmo finds that uncontrolled storm water runoff and construction site <br />erosion from land development and land disturbing activity can have significant adverse <br />
