ORDINANCE NO. 97-153
AN ORDINANCE REMOVING PROPERTY FROM THE
RESTRICTIONS OF THE VILLAGE AREA DEVELOPMENT MORATORIUM
1.0 RECITALS.
A. On October 5, 2004, the Lake Elmo City Council adopted Ordinance No.
97-142 ("Village Area Development Moratorium").
B. Pursuant to the terms of the Village Area Development Moratorium and
upon adoption of specific findings, the Village Area Development
Moratorium allows the Lake Elmo City County to remove property from
the application of the development moratorium.
C. The City of Lake Elmo has received a development application from the
Lake Elmo Business Park Company, a Minnesota partnership, for the
subdivision and development of property located in the "Village Area"
as that term is defined in the Village Area Development Moratorium.
2.0 FINDINGS. The Lake Elmo City Council makes the following findings in regard
to the removal of the development proposed by the Lake Elmo Business Park
Company from the restrictions of the Village Area Development Moratorium:
A. The use and site plan from the site complies with the Old Village Plan.
3.0 REMOVAL OF PROPERTY. The Lake Elmo City Council hereby authorizes
removal of the Lake Elmo Business Park Company parcel, as defined in the
Development Application, dated February 18, 2005 from the restrictions
contained in the Village Area Development Moratorium but does not authorize
removal of any other property; and the removal of this parcel from the
restrictions of the Village Area Development Moratorium shall not be
considered an approval of the proposed plat and building development which
must otherwise comply with the City of Lake Elmo's Development Regulations.
Effective Date: This Ordinance shall be effective the day following publication.
Adoption Date: Passed by the City Council of Lake Elmo the 15th day of March, 2005.
