HomeMy WebLinkAboutFINAL ORDINANCE NO. 97-164CITY OF LAKE ELMO ORDINANCE NO. 97-164 AN ORDINANCE INCORPORATING MINNESOTA STATUTES CHAPTER 84; AND SPECIFICALLY RELATING TO THE SNOWMOBILES AND ALL -TERRAIN VEHICLES WITHIN THE CITY OF LAKE ELMO THE LAKE ELMO CITY COUNCIL ORDAINS THAT CHAPTER 1011 IS HEREBY ADDED TO THE MUNICIPAL CODE TO READ AS FOLLOWS: 1011 Recreational Vehicles 1011.01 Incorporation by Reference. Provisions of Minnesota Statutes Chapter 84, as amended from time to time, shall be applicable to the City of Lake Elmo. In those cases where there is a conflict between the provisions of Minnesota Statutes Chapter 84 and this Chapter 1011, the more restrictive regulation shall apply. 1011.02 Definitions. A. All -Terrain Vehicle. All -Terrain Vehicle means a motorized floatation -tired vehicle of not less than three (3) low pressure tires, but not more than six (6) tires, that is limited in engine displacement of less than 800 cubic centimeters and total dry weight less than 800 pounds. B. Snowmobile. Snowmobile means a self-propelled vehicle designed for travel on snow or ice, steered by skis or runners. 1011.03 Regulations. A. No person shall operate a snowmobile or all -terrain vehicle on a public sidewalk or within the unimproved portion of a city street. B. No person shall operate a snowmobile or all -terrain vehicle on city owned property. C. No person shall operate a snowmobile or all -terrain vehicle between the hours of 11:00 p.m. and 7:00 a.m. provided that all - terrain vehicles may be used for snow plowing purposes during prohibited hours. D. No person shall operate a snowmobile or all -terrain vehicle within fifty feet (50') of a residential dwelling unless such operation occurs on property owned or occupied by the operator of the snowmobile or all terrain vehicle. E. No person shall operate a snowmobile or all -terrain vehicle within one hundred feet (100') of any fisherman, pedestrian, skating rink or sliding area. THE LAKE ELMO CITY COUNCIL HEREBY REPEALS CHAPTER 1010 AND ITS SUBDIVISIONS. The Lake Elmo City Council hereby repeals the following definitions which are included in Chapter 150 of the Municipal Code: All -Terrain Vehicle (ATV) Owner (Snowmobile and Recreational Vehicles) Snowmobile ADOPTION DATE: Passed by the Lake Elmo City Council on the 20th day of December, 2005.
