CITY OF LAKE ELMO <br />WASHINGTON COUNTY <br />STATE OF MINNESOTA <br />ORDINANCE NO. 97-129 <br />AN ORDINANCE ADOPTING A DEVELOPMENT MORATORIUM <br />RELATING TO THE CONSTRUCTION OF FENCES <br />The Lake Elmo City Council hereby ordains that Section 1360.07 and its <br />subdivisions shall be added to the Lake Elmo Municipal Code to read as follows: <br />"Section 1360.07 <br />A. Recently the City has become aware that its current fence <br />regulations have required an unusual amount of interpretation. The City <br />has undertaken a study to determine whether new fence regulations <br />should be adopted. <br />B. The Lake Elmo City Council has requested its Planner and <br />Planning Commission to review current fence regulations and propose <br />revisions. New regulations have been drafted and are being reviewed. <br />C. Pending the completion of the review process, the Lake Elmo City <br />Council has determined that it would be in the public's interest to impose a <br />development moratorium on the issuance of new fence permits. <br />D. In order to achieve the above objective, a development moratorium <br />is hereby imposed prohibiting the construction of all fences on property <br />within the City of Lake Elmo, except for those fences required by the State <br />Building Code for safety purposes. <br />E. This moratorium shall be in effect for six (6) months from the date <br />of publication of this Ordinance, unless terminated by prior action of the <br />Lake Elmo City Council. <br />F. The Lake Elmo City Council may, by amendment to this Ordinance, <br />remove specific parcels from the moratorium if proposed fences will <br />comply with anticipated new regulations, or repeal the moratorium in its <br />entirety. <br />ADOPTION DATE: Passed by the Lake Elmo City Council on the 18th day of May, <br />2004. <br />
