CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA ORDINANCE 97- 96 AN ORDINANCE AMENDING SECTION 210.03 COMPOSITION OF THE 1997 LAKE ELMO MUNICIPAL CODETHE PLANNING COMMISSION Section 1. Amendment: Section 210.03 of the Lake Elmo Municipal Code is hereby amended to read as follows: 210.03 Composition The Planning Commission shall consist of eleven (11) members and two alternate members. Members shall be appointed by the Council for three-year terns so that only one -thud (1 /3) of the appointments will expire on December 31st of each year. Alternate members shall be appointed to serve until there is a vacancy on the Commission, or until, they have served three years. The Council shall designate a first alternate and a second alternate who will become full members in order of appointment and shall complete the unexpired tern of the member they succeed. If the office of any alternate becomes vacant, the vacancy shall be filled in the same manner in which the last regular appointment for that office was made. Section 2. Effective Date: This ordinance shall become effective upon its passage and publication according to law. Commission Expenditures The expenditures of the Environmental Management Commission shall be within amounts appropriated for the purpose by the Council, provided, however, that all expenditures are duly authorized though normal administrative purchasing policies. Subd.10. Removal of Commission Members for Nonattendance Given that the Council expects diligence in attendance by the members of the Environmental Management Commission at Commission meetings, excessive absences will be considered as grounds for removal from the Commission. Excessive absences may be considered as absence from more than one-third (1/3) of the meetings, or absence from three (3) or more consecutive meetings. Section 2. Effective Date: This ordinance shall become effective upon its passage and publication according to law. Amendment: Section 801.01 and its subdivisions are hereby added to the Lake Elmo Municipal Code; to wit: Section 801.01 Environmental Management Commission Subd. 1. Commission Established An Environmental Management Commission for the City is hereby established. Subd. 2. Purpose of the Commission The general purpose of the Commission is to assist the City Council in establishing plans, policies, and procedures in matters affecting the environment. This will include, but not be limited to: the orderly disposal of solid waste, recycling, composting, storm water run off, water quality improvements, wetland conservation and management, air quality, ground water (drinking), tree preservation, and quality of the environment and natural resources. Additionally, the Commission may assist in educational tasks and other environmental interests and concerns that Council deems appropriate. All conclusions reached by the Commission shall serve as recommendations and powers of execution shall be vested in the Council. Subd. 3. Composition of Commission, Appointment and Terms of Members The Environmental Management Commission shall consist of nine five (5) regular members, appointed by the Council for three year (3) terms. The initial term for appointments to the Commission shall be staggered so that only one ( 1) new appointment or re -appointment need to be made in any one year. Commission members must be voting age residents of the City. Vacancies during a term due to resignation or removal from the Commission shall be filled by a Council appointment for the remainder of the unexpired term. Resignation of Environmental Management Commission members shall be submitted in writing to the Council. A majority of the serving members shall constitute a quorum. At their discretion, the Council may appoint up to two (2) ex officio members and up to two (2) student representatives to serve on the Commission. Such individuals shall serve in an advisory role without voting privileges and do not need to meet the age or residency requirements for a commissioner. Subd. 4. Residency Requirement No person appointed to represent the residents shall continue to serve on the Commission once that member has taken residence outside of the corporate limits of the City. A resignation shall be submitted to the Council in this instance. u Subd. 5. Organization of the Commission Officers of the Environmental Management Commission shall be the Chair and Vice -Chair. These Officers shall be elected annually by the members of the commission at the first meeting in January. The Environmental Management Commission may elect such other officers as may be necessary and may give the Chair the authority to appoint and change committees if such appointments might become necessary. The Environmental Management Commission shall provide for the date, time and location for meeting. Subd. 6. Commission Meetings and Records The Environmental Management Commission shall hold regular meetings as established by the Commission and approved by the Council. These meetings shall be open to the public. The Environmental Management Commission shall submit to the Council written minutes of its meetings and actions. Subd. 7. Commissioner to Attend Council Meetings The Environmental Management Commission shall have one or more of its members present at all pertinent Council meetings. Subd. 8. Duties of Commission It shall be the duty of the Environmental Management Commission: 1. To assist the Council in developing and reviewing policies, plans, reports, regulations, and other matters affecting solid waste disposal, recycling, composting, storm water run off, water quality improvements, or other areas affecting the environment that may be assigned by the Council. 2. To advise the Council and residents on solid waste disposal, recycling, composting, stone water run off, water quality improvements, or other issues affecting the environment. 3. To assist in the collection of background data to determine goals, policies, and programs that will maintain or improve the environment in the City. 4. To assist in preparing public education materials and methods on solid waste disposal, recycling, composting, storm water run off, water quality improvements, and other issues affecting the environment. 5. To recommend additional methods, policies, or procedures that will reduce the solid waste stream; expand recycling; and/or improve the orderly disposal of solid waste. 6. To hold public meetings. 7. To cooperate with other agencies, Commissions, and volunteer organizations to achieve common goals related to solid waste and the environment. 3 C! Amendment: Section 400.10 of the Lake Elmo Municipal Code is hereby amended to read as follows: 400.10 Exceptions to Platting Subd.1. Minor Subdivision. A minor subdivision is a division of land which results in no more than 4 parcels wherein each resultant parcel complies with the City's minimum lot dimension and public road frontage requirements for the zoning district in which the land is located. Subd. 2 Lot Line Adjustment. A lot line adjustment is a division of land which results in no more than 4 parcels wherein each resultant parcel does not comply with the City's minimum lot dimension and/or public road frontage requirements for the zoning district in which the land is located. The City Council hereby waives compliance with the City's platting regulations for lot line adjustments which satisfy one of the following conditions: A. Each resultant parcel, when combined with an abutting parcel through a Tax Parcel Consolidation Procedure approved by Washington County, equals of exceeds the minimum lot dimension requirements and public road frontage requirements for the zoning district in which the property is located; or B. In those cases where the City Administrator determines that it is not reasonably possible for each resultant parcel to comply with the provisions of Section 400.10, Subd. 2A, each resultant parcel, when combined with an abutting parcel through a Tax Parcel Consolidation Procedure approved by Washington County, is less non -conforming after the lot consolidation than it was before the lot consolidation; or C. In those cases where, in regard to property which is zoned agricultural or Waal residential, the City Administrator determines that each resultant parcel will equal or exceed minimum lot dimensions for the zoning district in which the property is located, but that one of the resultant parcels cannot satisfy the minimum public road frontage requirements for the zoning district in which the property is located, access to the non- complying parcel is protected by a restrictive covenant approved by the City Attorney which includes the City as a beneficiary. Subd. 3 Application for Minor Subdivision/Lot Line Adjustment. An application for a Minor Subdivision or a Lot Line Adjustment shall be submitted on forms provided by the City Administrator. The applicant will be responsible for all expenses incurred in obtaining the required information, which includes the following: A. Name, address, and telephone number of the property owner/applicant and evidence of title. Ci W c B. A legal description of the parcel which is being subdivided and legal descriptions for each of the resulting parcels; and, in regard to lot line adjustments, legal descriptions for the consolidated parcels. C. A written description stating the reason for the request. D. A land survey prepared by and signed by a registered land surveyor describing the minor subdivision and/or lot line adjustment and showing all buildings, driveways, easements, setbacks and other pertinent information including the legal descriptions herein required. Subd. 4 Review of Minor Subdivision. A completed application shall be submitted to the Planning Commission for its review and recommendation to the City Council. The City Council may attach reasonable conditions to its approval and shall require the conveyance of necessary street, utility, and drainage easements on forms approved by the City Attorney; and shall require the payment of a public use dedication fee. Subd. 5. Review of Lot Line Adjustment. A completed application shall be reviewed administratively by the City Administrator who shall make a written finding in regard to the provisions of Section 400.10, Subd. 2(A), (B), or (C). The City Administrator's approval shall be conditioned upon tax parcel consolidation. Prior to the issuance of any development permits, and no later than 60 days after administrative review and approval, the applicant shall provide the City Administrator with the verifications listed below. Failure to provide the required verifications shall invalidate the City Administrator's approval. A. Recorded documents or recorded document numbers for the deeds of conveyance which effectuate the lot line adjustment. B. Proof that the Washington County Assessor has approved a Tax Parcel Consolidation and has assigned a new tax parcel number for the consolidated parcel or parcels. Section 2. Effective Date: This ordinance shall become effective upon its passage and publication according to law. Performance Standards — Primary Exterior Surfacing The Primary Exterior Surfacing of structures shall be limited to natural brick, stone, or glass. Artificial or veneer brick or stone shall not qualify as complying with this performance standard. Primary Exterior Surface shall be defined as not less than 70% of the sum of the area of all exterior walls of a structure nominally perpendicular to the ground. All parapet or mansard surfaces extending above the ceiling height of the structure shall be considered exterior surface for the purposes of this subdivision. Windows and glass doors shall be considered a primary surface, but the sum area of such glass shall be deducted from the wall area for purposes of the 70% Primary/30% Accent formulas of this section. I f m CITY OF LAKE ELMO ORDINANCE NO. 9-1 - I I E AN INTERIM ORDINANCE IMPLEMENTING A DEVELOPMENT MORATORIUM ON CERTAIN PROPERTY WITHIN THE CITY OF LAKE ELMO THE LAKE ELMO CITY COUNCIL ORDAINS: 1.0 Recitals. A. The City Of Lake Elmo ("City") has a Comprehensive Land Use Plan ("Comprehensive Plan"), which identifies: The following parcels as being within the "LB — Limited Business" classification: Parcel 1: PIN 3302921440003 Parcel 2: PIN 3402921330005 Parcel 3: PIN 3402921330004 Parcel4: PIN3402921340004 2. And, the following parcel as being within the "RAD — Rural Agricultural" classification: Parcel5: PIN3602921340006 B. All of the above referenced parcels are herein referred to as the "Moratorium Area Parcels." Buildings have been constructed on Parcel Nos. 1 through 4. Parcel 5 is vacant land. C. The City's Zoning Map designates all of the Moratorium Area Parcels as "GB — General Business." D. There is a conflict between the designation of the Moratorium Area Parcels on the City's Comprehensive Plan and the designation of such parcels on the City's Zoning Map. The conflict occurs as a result of a change in the City's Comprehensive Plan. E. The City is in the process of reviewing the manner in which to resolve the conflict which may include a change to its Comprehensive Plan, a change in the zoning districts and/or a change to the text of the City's zoning regulations. In order to protect the integrity of its Comprehensive Plan, the planning process and the health, safety and welfare of the citizens of the City Of Lake Elmo, the City Council has determined that a development moratorium in appropriate.
