CITY OF LAKE ELMO <br />WASHINGTON COUNTY, MINNESOTA <br />ORDINANCE 97- 80 <br />An Ordinance Amending Sections 810, 810.01, 810.02, 810.03. <br />And Repealing Section 810.04 and 810.05 of the Lake Elmo Municipal Code <br />Section 1. Amendment: Sections 810, 810.01, 810.02, 810.03 and 810.04 are her <br />amended, to wit: <br />Section 810 — Open Burning Prohibited <br />810.01 Adoption by Reference <br />The ambient air quality standards, air pollution control regulations of the Minnesota <br />Pollution Control Agency, (MPCA) and the Open Burning Restrictions and <br />Permitting Regulations of the Department of Natural Resources (DNR) are adopted <br />by reference, and have the same force and effect as if they were reproduced in their <br />entirety. <br />810.02 Permits <br />Open Fixes or Open Burning, except for recreational or campfires as hereinafter <br />defined shall be prohibited without a permit approved by the Lake Elmo Fire Chief, <br />or the Fire Chiefs designee. As used hereinafter, the following shall mean: <br />Subd. 1. Open Fire; Open Burning. <br />"Open Fire or Open Burning" means a fire burning in a manner, whether <br />concentrated or disbursed, which is not contained within a fully enclosed firebox, <br />structure or vehicle and from which the products of combustion are emitted <br />directly to the open atmosphere without passing through stack, duct, or chimney. <br />Subd. 2. Recreational Fire - Campfire. <br />"Recreational Fire" means a fire set for cooking, warming, recreational, or <br />ceremonial purposes, which is not more than 3 feet in diameter by 3 feet high, <br />and has had the ground 5 feet from the base of the fire cleared of all combustible <br />material. <br />810.03 Violations <br />Any person violating any of the provisions of the provisions of these rules shall be <br />guilty of a misdemeanor. <br />
