On the 6th day of April, 1998, the Lake Elmo City Council
adopted Ordinance No. TIH a , and, by four affirmative votes
pursuant to Minn. Stat. §412.191, Subd. 4, directed that a summary
of the Ordinance be published.
Lake Elmo Ordinance No. q -7 ya is entitled "An Ordinance
Extending the Development Moratorium on Property Located Within the
Public Facility (PF.) Zoning District of the City". The Ordinance
prohibits development within the Public Facility (PF) Zoning
District of the City of Lake Elmo until July 20, 1999.
A copy of the Ordinance is available for inspection by any
person during regular business hours at the office of the City
Administrator at 3800 Laverne Avenue North, Lake Elmo, MN 55042.

AN ORDINANCE EXTENDING THE
PROPERTY LOCATED WITHIN THE
DISTRICT OF THE CITY.
DEVELOPMENT MORATORIUM ON
PUBLIC FACILITY (PF) ZONING
THE LAKE ELMO CITY COUNCIL ORDAINS:
1.0 Recitals.
A. On the 7th day of April, 1998, the Lake Elmo City Council
adopted Ordinance No. 9728 which established a
development moratorium for property located within the
City's PF Zoning District.
B. The development moratorium established by Ordinance No.
9728 will expire on the 17th day of April, 1999.
C. The City has drafted proposed regulations for property
located in the PF Zoning District. The regulations have
been discussed at several meetings of the Planning
Commission and have been the subject of at least one
public hearing before the Planning Commission.
D. As a result of public comments on the proposed PF
regulations, the City has concluded that it needs to
review in more detail the impact of the proposed PF
regulations on existing PF uses before it takes final
action.
E. In order to facilitate the City's review process, it will
be necessary to extend the development moratorium on
property located within the PF Zoning District for a
reasonable time.
2.0 Development Moratorium. The Lake Elmo City Council
hereby adopts a development moratorium applicable to all property
located within the City's Public Facility (PF) Zoning District.
3.0 Duration of Moratorium. The development moratorium will
commence on the effective date of this ordinance and will continue
until July 20., 1999 unless otherwise terminated or extended by
action of the .City Council.
4.0 Enforcement. The City of Lake Elmo may enforce any
provision of this ordinance by mandamus, injunction, or any other
appropriate civil remedy in any court of competent jurisdiction.
lty. Every section, provision, or part of this
ordinance is declared_ separable from every other section, provision
or part of this ordinance. If any section, provision, or part of
this ordinance is adjudged to be invalid by a court of competent
jurisdiction, such judgment shall not invalidate any other section,
provision or part of this ordinance.
Effective Date.. This Ordinance shall be effective the day
following its publication or on the day following the publication
of an Ordinance Summary approved by the Lake Elmo City Council.
