AN ORDINANCE EXTENDING THE DEVELOPMENT MORATORIUM ON
PROPERTY LOCATED WITHIN THE PUBLIC FACILITY (PF) ZONING
DISTRICT OF THE CITY.
THE LAKE ELMO CITY COUNCIL ORDAINS:
1.0 Recitals.
A. On the 7th day of April, 1998, the Lake Elmo City Council
adopted Ordinance No. 97-28 which established a
development moratorium for property located within the
City's PF Zoning District. The Development Moratorium
was to expire on the 17th day of April, 1999.
B. On the 6th day of April, 1999, the Lake Elmo City Council
adopted Ordinance No. 97-42 which extended the original
Moratorium from April 17, 1999 to July 20, 1999.
C. The Lake Elmo City Council, City Staff and some of the
affected property owners have continued to discuss the
text and impact of the proposed PF Regulations.
D. The Lake Elmo City Council has determined that it will
need to again extend the Development Moratorium in order
to draft revisions to proposed regulations resulting from
discussions with affected property owners and to permit
the City's Planning Commission to review the proposed
revisions prior to final action by the City Council.
2.0 Development Moratorium. The Lake Elmo City Council
hereby adopts a development moratorium applicable to all property
located within the City's Public Facility (PF) Zoning District.
3.0 Duration of Moratorium. The development moratorium will
commence on the effective date of this ordinance and will continue
until the 21st day of December, 1999 unless otherwise terminated or
extended by action of the City Council.
4.0 Enforcement. The City of Lake Elmo may enforce any
provision of this ordinance by mandamus, injunction, or any other
appropriate civil remedy in any court of competent jurisdiction.
5.0 Separability. Every section, provision, or part of this
ordinance is declared separable from every other section, provision
or part of this ordinance. If any section, provision, or part of
this ordinance is adjudged to be invalid by a court of competent
jurisdiction, such judgment shall not invalidate any other section,
provision or part of this ordinance.
Effective Date. This Ordinance shall be effective the day
following its publication or on the day following the publication
of an Ordinance Summary approved by the Lake Elmo City Council.
Adoption Date. Passed by the Lake Elmo City Council on the
6th day of July, 1999.
