HomeMy WebLinkAboutFINAL ORDINANCE NO. 97-037CITY OF LAKE ELMO ORDINANCE NO. 9-Ti AN ORDINANCE DECREASING AREA SUBJECT TO DEVELOPMENT MORATORIUM THE LAKE ELMO CITY COUNCIL ORDAINS: 1.0 Recitals. A. On November 4, 1997, the Lake Elmo City Council adopted Ordinance No. 97- 21 which established a development moratorium for that portion of the City of Lake Elmo which is illustrated on Exhibit A attached ("Village Area"). B. On August 4, 1998, the Lake Elmo City Council adopted Ordinance No. 97-35, which extended the Development Moratorium which applied to the Village Area. C. The City is continuing to review the manner in which its comprehensive plan and official controls should be amended in order to better accommodate and control development in the Village Area. D. The City Council has concluded that it is in the best interest of the City to allow a portion of the property included in the Village Area to be excluded from the Development Moratorium so that the owners of such excluded property can present a more detailed concept plan for the joint development of such excluded property. E. By redefining the property included within the "Village Area" the City is not waiving any of its other development regulations or pre -approving any concepts which may be presented. All property must be developed consistent with applicable subdivision and zoning regulations. 2.0 Redefinition of Village Area. The Lake Elmo City Council hereby amends the area which is included in the "Village Area" as referenced in Ordinance 97-21 and Ordinance 97- 35, so that such area complies with the illustration attached hereto as Exhibit A-1. A copy of Exhibit A-1 shall be kept on file in the office of the City Administrator and shall be available for review during regular business hours. 3.0 Enforcement. The City of Lake Elmo may enforce any provision of this ordinance by mandamus, injunction or any other appropriate civil remedy in any court of competent jurisdiction. 4.0 Separability. Every section, provision, or part of this ordinance is declared separable from every other section, provision or part of this ordinance. If any section, provision of part of this ordinance is adjudged to be invalid by a court of competent jurisdiction, such judgment shall not invalidate any other section, provision or part of this ordinance. Effective Date. This Ordinance shall be effective the day following its publication or on the day following the publication of an Ordinance Summary approved by the Lake Elmo City Council.
