AN ORDINANCE AMENDING SECTION 400.03 SUBD 4 `BUILDING PERMITS"
AND ADDING SECTION 400.03 SUBD 4 A. 1 and 2, and B.
TO THE LAKE ELMO MUNICIPAL CODE
Section 1. Amendment: Section 400.03 Subd. 4 `Building Permits" of the Lake Elmo
Municipal Code is hereby amended as follows; to wit:
Subd 4. Buildine Permits
No building permits shall be issued for the construction of any building, structure or
improvement to any land or lot in a subdivision, as defined in this section, until all
requirements of this section have been satisfied, with the following exception:
A. Building Permits may be issued for Model Homes after approval of the final
plat by the Council provided the following conditions are satisfied:
1. A signed Developers Agreement which shall include securitv for
improvements as set forth in Section 400.16 Subd 9 A and B.
2. Developer shall agree in writing to indemnify and hold harmless the City for
damages that may occur as a result of the model home construction prior to
the required improvements being completed.
B. No Certificate of Occupancy shall be issued by the City until the first wear
course on a public street is completed and approved by the City Engineer.
Section 2. Effective Date: This ordinance shall become effective upon its passage and
public ion accordin o law.
