HomeMy WebLinkAboutFINAL ORDINANCE NO. 97-010-.3t 4-- Clq b cta;-��Z- Houle/Engstrom Annexation City of Lake Elmo Washington County, Minnesota Ordinance 971 AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF LAKE ELMO TO INCLUDE CERTAIN UNINCORPORATED TERRITORY ABUTTING THE CITY LIMITS NOT EXCEEDING SIXTY (60) ACRES UPON PETITION FOR ANNEXATION FROM ALL OF THE PROPERTY OWNERS THEREOF (GLEN R. HOULE AND COLLEEN E.F. HOULE AND ROBERT E. ENGSTROM) PURSUANT TO MINNESOTA STATUTE 414.033 SUBD. 2. (3) WHEREAS, certain territory described below is not presently included within the corporate limits of any incorporated City; and WHEREAS, the territory described below is less than sixty (60) acres in area; and WHEREAS, the territory described below abuts upon the Lake Elmo City limits at the North, West and South boundary thereof and is deemed to become suburban in character; and WHEREAS, a certain Petition dated May 6, 1997, requesting annexation of the territory described below was presented to the Lake Elmo City Council on May 6, 1997; and WHEREAS, the Petition was signed by all owners of the territory described below; WHEREAS, the Baytown Township Board of Supervisors resolved at a meeting on May 5, 1997, to support his annexation request; and WHEREAS, the Lake Elmo City Council considered this request at a public hearing on June 17, 1997 in accordance with State Statute. NOW, THEREFORE, the Lake Elmo City Council ordains: Section 1. Determination of Facts: The City Council hereby determines: (1)That the territory described below abuts upon the Lake Elmo City limits and is deemed to become suburban in character. Houle/Engstrom Annexation (2)The City of Lake Elmo has received a petition for annexation from all of the property owners, to wit: Glen R. Houle and Colleen E. F. Houle and Robert E. Engstrom of the territory described below. All that part of the Northwest quarter (NW 1/4) of Section Seven (7) in Township Twenty-nine (29) North of Range Twenty (20) West of the Fourth Meridian described as follows; to wit: Commence at the Southwest corner of the Northwest Quarter (NW 1/4) of Section Seven (7); thence north along the west line of said Northwest Quarter (NW 1/4) for Six hundred seventy-six and seven -tenths (676.7) feet; thence East and parallel with the South line of said Northwest quarter (NW 1/4) for fifty (50) feet to the point of beginning of this description; thence East and parallel with said South line of Northwest quarter (NW 1/4) for Six hundred twenty and twenty-four hundredths (620.24) feet to the center line of Minnesota Highway No. 212, as now located and traveled; thence Northeasterly along said center line of Minnesota Highway No. 212 for One hundred three and ninety-seven hundredths (103.97) feet; thence west and parallel with said South line of Northwest Quarter (NWl/4) for Six hundred forty-eight and sixty-nine hundredths (648.69) feet; thence South and parallel and fifty (50) feet East of said West line of Northwest quarter (NW1/4) for One hundred (100) feet to the point of beginning. Containing 1.46 acres, more or less. Subject to the right of way of Minnesota Highway No. 212. According to the United States Government Survey thereof. (3) The territory described below is appropriate for annexation as it abuts and is contiguous to property owned by Glen R. Houle and Colleen E.F. Houle and Robert E. Engstrom in the City of Lake Elmo that is proposed to be developed. (4) That none of the territory is now included within the limits of any City. (5) That the territory is sixty (60) acres or less in area. Section 2. Population. the population of the territory described below is two (2) residents. Section 3. Territory Annexed. The corporate limits of the City of Lake Elmo are hereby extended to include the unplatted land described as follows, which land is situated in the County of Washington and State of Minnesota, to wit: All that part of the Northwest quarter (NW 1/4) of Section Seven (7) in Township Twenty-nine (29) North of Range Twenty (20) West of the Fourth Meridian described as follows; to wit: Commence at the Southwest corner of the Northwest Quarter (NW 1/4) of Section Seven (7); thence north along the west line of said Northwest Quarter (NWl/4) for Six hundred seventy-six and seven -tenths (676.7) feet; thence East and parallel with the South line of said Houle/Engstrom Annexation Northwest quarter (NWl/4) for fifty (50) feet to the point of beginning of this description; thence East and parallel with said South line of Northwest quarter (NW1/4) for Six hundred twenty and twenty-four hundredths (620.24) feet to the center line of Minnesota Highway No. 212, as now located and traveled; thence Northeasterly along said center line of Minnesota Highway No. 212 for One hundred three and ninety-seven hundredths (103.97) feet; thence west and parallel with said South line of Northwest Quarter (NWl/4) for Six hundred forty-eight and sixty-nine hundredths (648.69) feet; thence South and parallel and fifty (50) feet East of said West line of Northwest quarter (NWl/4) for One hundred (100) feet to the point of beginning. Filina: The City Clerk/Administrator is hereby directed to file certified copies of this Ordinance with the Secretary of State, the Washington County Auditor, the Town Clerk of Baytown Township and the Minnesota Municipal Board. Section 5. Effective Date. This ordinance takes effect upon its passage and publication and the filing of a certified copy as directed in section 4 and approval by the Minnesota Municipal Board, if required.
