Attending were Mayor Urtel, Trustees Dennis, Dornfeld, and Ebne, and Clerk Mehsikomer. Also legal. advisor Rod Lawson. After a discussion period the following amendment was submitted. by Clerk Mehsikomer: Section I INTERPRETATION: SHORT TITLE PURPOSES: This Ordnnance is enacted for the. following.purposes: To promote the health, safety,moralsA and general.welfare of the inhabitiants of the Village of lake Imo by lessening congestion in the streets, securing safety frem.fire, panie.and other, dam- gers; providing adequate light and air; preventing the overcrowd- ing of land;avoiding undue concentration.of population; faciliting the adequate provision of transportation, waterm.sewerage, schools, parks, and other public requirements; conserving the value of pro- perties, and encouraging the most appropriate use of the land. SCOPE: From and after the effective date of this Ordinance, the use of all land and every building or portion of a building erected, altered,with respect to height and area,. added to or relocated, and every use within a.building or use accessory thereto, in the Village of Lake �lmoshall be in conformity with the,provisions of this Ordinance. Any existing building or structure and any existing use of properties not in conformity with the regulationd herein prescribed shall be regarded as non -conforming but may be continued, extendedly or changed subjedt to the special regulat- ionsherein.provided with respect to nonconforming properties and uses. INTERPRETATION: In interpr6ting and applying she provisions of this Ordinance, they shall be held to theminimum requirements for the promotion of the public health, safety,00mfort, convenience and general welfare. Where the provisions of this Ordinance im- pose greater restrictions than those of any statute, other ord- inanoe, or regulation, the provisions of this Ordinance shall be controlling. SHORT TITLE: This Ordinance shall be known and may be cited as the "zoning ordinance of the Village of Lake Elmo". SECTION II The entire Village of Lake Elmo, except those areas described as follows as a Business and Commercial District and..an.Indust- rial District is hereby designated as a Residential District and land therein shall be used for one familyprivate resident- ial dwellings only. riffage of taht '�Ztmv Vao4ingtnn (4vuutg aloe ovembberer fi1961 N Conttd Page 2 SECTION IIIZ The following described area is hereby desig- nated as a Business District and Commercial District: 1)That land in the Village of Lake Elmo lying North of the centerline of Minnesota Highway 212 as now Laid out. 2)That tract of land boundixged on the North by the center- line of Minnesota Highway 212, on the East by the centerline of KalmiaAvenuer on. the South by the South line of Sixth.Street,and on the West by the West boundary of the Village of Lake Elmo. Except that pant of said tract surveyed and platted as Block 2 of Elm �aa Park. 3)That tract of land bounded on the North by the centreline of Minnesota Highway 212, on the East by Juniper Avenue,on the South by 'Third Street and on the West by Kalmia Avenue. A.The Following regulations shall apply in said Business and Com- mercial District and a building may be erected or usedand a lot may be used or occuppied only for thefollowing purposes: otel or a Motel. 2 Retail store, restaurant, office, agency, or studio, bank personal service and craftmen's shop, mortuary. 3)Public garage, service station, automobile sales agency, parking garage,,or lot, provided all facilities are located and all services are condue.ted on the. lot. 4 Newspaper publishing; job printing establishment. 5�Theatre, provided a drive-in type obtain a special permit. 6)Public or private school, hospital, club, or lodge. 7)Hand or automatic self service laundry. 8 Bakery or confectionary shop, for the production of art- icles to be sold only at retail on the premises. B.The following uses are permitted when authorised by the lawful governing body as a special exception: 1)Distributing station for milk.or other beverages;oatting or hauling station. 2)Place of amusement, rereation, or assembly other.than a thaetre, when conducted indoors. 3)Yard for starage, sale, and distribution of ice, coal, fuel oil or building materials,when enclosed within a fence of not less than six feet in height, but not including junk yard, salvage, auto- mobile or other wrecking yard. 4)Any use of the same general character as any of.those set forthin Section III A. provided that no use which is noxious or hazardous shall be permitted. OThe following area and design requirements shall apply in.the Business and Commercial District: riffage o Nape Etmv '%U11104ington (lx+nntg Fgmhe gLYttO, A.Sltmovitt November 279 1961 Cont'd, Page 3. 1) A complete plot plan showing the building or buildings and surrounding land areas of the entire project must be submit- ted for approval by the lawful governing body, when building per- mit is applied for. 2)A complete set of building.plans and specifications, sew- erage disposal, and water supply plans must accompany the plot plan. 3) The lawful governing body may submit theseplansfor consideration and recommendations for the: Planning. Commission® tsxs 4) Area and design requirements must be such as to est- ablish a Business and Commercial.District which will best serve the general welfare and benefit of the entire vi.11age,.andprovide service areas. 5)Adequate areas shall be provided for loading and unloading of delivery trucks and other vehicles including.emp.loyee parking; servicing of shops by refuse collection, fuel, fire, and other service vehicles; automobile accessways; and.pedestrian walks. Such areas shall be paved with anacceptablehard service. 6)Not less than 3 square feet.of automobile parking.space with suitalle access shall be provided for each square foot of gross floor area is devoted to patron use, SECTION IV The following described area is hereby designated as an Industrial District; 10 Block 2 of Elmo Park as surveyed and plotted. 2) That tract of land described as follows: Commencing at the intersection of the East boundary line of the:.Village.of Lake Elmo with the centerline of Minnesota Highway 212, runningthenoe S South along the East boundary line of the Village.of Lake,. .lmo to the South line of Sixth Street, running.thence Southwesterly along the South line of Sixth Street to the o.enterli.ne of Kalmia Avenue,running thence Northerly along the centerline of Kalmia Avenue to the centerline of third Street taxthxxxxxitXatixxxxi ikxnigiRrx*xRxxRX running thence East along the centerline of Third Street to the centerline of Juniper Avenue,running thence North along the centerline of Juniper Avenue to the centerline of Minnesota Highway 212, running thence Northeasterly along the centerline of Minnesota Highway 212 to the point of beginning. 3) The Northerly 133 feet of the Easterly 200 feet of the tract of land bounded on the East by Lake Elmo Road and on the North by Seventh Street. A. The following, regulations &hall apply in said Industrial District: 1) A building may be erected or used and a lot may be used or opupied for any lawful industrial or manufacturing purpose or any use authorized inthe Business and Commercial District except the purposes specified below or any purpose substantially similar to any specified below, provided that no use which is noxious or hazardous shall be permitted. The prohibited uses are as follows: a) Excavating of sand, gravel, rock or dirt for the purpose of processing or selling such excavated materials. Abattoir, stock yard. o) Distillation of bones and wood. d) Incineration or reductions of garbage offal and dead animals. e) Junk yards, salvage or wrecking yard, or the baling of rags or junk, except when enclosed within a building. f) Manufadure of: Asphalt of asphalt products, including refining thereof. .Explosives, fireworks, including storage thereof. Fertilizer, when manufactured from organic materials. Gypsum, cement, plaster or plaster of parts. iiubber, caoutchouc, or gutty perpercha. Sulphorous, sulphuric, nitric, picric, or hydrochloric or other offensive or corrosive acids. g) Manufacture of wood pulp and fiber. h Trailer camps. 2) No building may be erected, altered or used and no lot or premises may be used in or within 200 feet of a residence district. 3) All of the area and design requirements set forth in Section III 0. preceding shall apply as the area and design re- quirements of the Industrial District. Section V..Any additional area of land becoming a.part of the Village after the date of this Ordiance shall be zoned as a Residential District and governed by Section IT of this Ordinance. SECTION VI. Any person who shall violate any of the provisions of this Ordinance shall be guility of a misdemenor and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or by imprisonment of not to exceed 90 days. SECTION VII This Ordinance shall become effective from and Xfx*x after the date of`its passage and publication according to law. Motion by Clerk Mehsikomer second by Trustee Dornfeld that amendment be acoepted. Carried 4-0. Clerk advised that this would be amendment # 27.
