Reading of ruling on bids by Village Engineer W. Banister. All bids were opened for the water system and the wm11xafk tower after which Banister Engineering requested a recess so that they could tabulate all the bids to determine low bidder and make a recommendation to the council. Mayor Urtel called the recess and advised that the meeting would reconvene at 7:30P.M. 7:30 P.M. meeting called to, order by Mayor Urtel. Present were L.Urtel, Roy Dornfeld, L.Ebne, and D. Mehsikomer of the council along with Bill Banister and Gil Lundholm of Banister Engineering and Peter Popovich Legal Advisor on the water project, Bill Banister reported that after tabulating the bids and checking on the bidder he recommended giving the award to the lowest bidder. Whereas pursuant to advertisement for bids for Water Improve- ment No.1, Project No.2 and Project No.3, according to the plans and specifications thereof on file in the office of the clerk of said village, said bids were received on May 22r 1962 At 3:00 P.M. opened and tabulated according to law and the following bids were received complying with the advertisement:(see above) Whereas it appears that Rivard and Sons Inc. of White Bear Lake is the lowest responsible bidder at the tabulated price of $103, 564.45 on Project No.2, and Universal Construction Co. of Ind- ianapolis, Indiana is the lowest responsible bidder at the tab- ulated price of $29,830.00 on Project No.3, Minutes of May 23, 1962 council meeting continued. ( NOW THEREFORE BE If RESOLVED by the Village Council of the Village of Lake Elmo, Minnesota: 1..The Mayor and Clerk are hereby authorized and directed to enter into a contract with Rivard and Sons Inc. for $103,564.45 in the name of the Village of lake Elmo for Water Improvement No.1, Pro- ject No.2; and Mayor and. Clerk are further authorized and direct- ed to enter into a contract with Universal Construction C. for $29,830.00 in the name of the Village of Lake Elmo for Water Im- provement No. 1, Project No.3, according to the plans and specif- ications thereof heretofore approved by the Village Council and on file in the office of the Village Clerk. 2.The Village Clerk is hereby authorized and directed to return forthwith to all bidders xxt the deposits made with their bids except the deposits of the successful bidders and the next low- est bidders shall be retained until contracts have been signed. The motion was seconded by Lloyd Ebne and upon vote being taken thereon, the following voted in favor thereof: Dornfeld, Ehne, and Mehsikomer. Against None. Whereupon said resolution was declared duly passes and adopted. Roy Dornfeld introduced and move the adoption of the following •resolutions RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENTS FOR BIDS Whereas, the village engineers Banister Engineering Co.,_ have prepared plans and specifieations for a pupp and appurtenances, designated as Project No.49, and a pumphouse, designated as Project No.5, both included within the water improvement ordered by resolution dated June 15, 1961,and have presented such plans and specifications to the Council for approval: THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF LAKE ELMO, MINNESOTA: 1. Such plans and specifieations, copies of which are attached hereto, and made a part thereod, are hereby approved. Said im- provement has heretofore been designated Water Improvement No.1. 2.The Village Clerk shall preapre and cause to be inserted in the Stillwater Weekly Gazette, the official paper, and in the Construction BAlletin advertisements for bids for the construction of said Project No-4 and Project N0.5. Water Improvement No.1 under such approved plane and specifications. The advertisements shall be published as required by law, shall spedify the work to be done, shall call for bids upon the basis of a cash payment for such work, shall state that bids will be opened and consider- ed by the council at 7:30P.M. on June 21, 1962 for Project No.4 and 7:30 P.M. on June 219 1962 for Project No.50 both in the Fire Hall in said village, that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit or certified check or bidder's bond payable to the Clerk for five percent(5%) of the amountof the bid and that the advertise- ment shall state a completion date of October 1, 1962 for Project N0.49, and October 1, 1962 for Project No.5. The Motion for the adoption of the foregoing resolution was duly secondedby L.Ebne and upon vote being taken thereon the following voted in favor: Dornfeld, Ebne, and Mehsikomer Against None. Whereupon said resolution was declared duly passed and adopted. Minutes of May 23, 1962 council meeting continued. Banister Engineering presented an approved bill covering the balance on the well of $8001.10 for a total of $12,781.50. The Clerk was authorized to make payment to Keys Well Drilling Co. Lloyd Ebne introduced and moved the adoption of the following resolution: RESOLUTION PROVIDING FOR PUBLIC SALE OF WATER IMPROVE* MENT BONDS Be it resolved by the Council of the Village of Lake Elmo, Minnesota. 1.Pursuant to Minnesota Statutes, Chapter 429, as amended, and upon public notice and hearing as therein required, the Village has ordered the construction of an improvement designated as Water Improvement No.11 and has advertised for bids and entered into contraeys for a portion of such oonstruction, and the total cost thereof, includingthe cost of work under daid contracts and add- itional work to be performed, and all other expenses necessary to be incurred in connection with the improvement, is estimated at present to be $1909000. 2.Said improvement shall be financed by the issuance of improve- ment bonds, for the payment fo which the full faith and credit of the Village shall be pledged. A separate fund is hereby established for said improvement, which shall be designated the Water Improve= ment No. 1 Fund. The proceeds from the sale of the bonds herein provided for and from the collections of special assessments for the improvement and any other moneys appropriated thereto by the village shall be paid Into such fund. 3.This Council shall meet at the time and place designated in the form of notice herein contained for the purpose of receiving, 1 opening and ednsidering sealed bids for and awarding the sale of said bonds; andthe Clerk is hereby authorized and directed to cause notice of the time, place and purpose of said meeting to be published in the Stillwater Weekly Gazette, the official paper of the village, and in the Wommercial West, a financial newspaper published at Minneapolis, Minnesota, which notice shall 1ae in substantially the following farm: NOTICE OF SALE $190,000 Water IMPROVEMENT BONDS VILLAGE OF LAKE ELMO, WASEING'T'ON COUNTY, MINNESOTA NOTICE IS HEREBY GI13EN that the Council of the Village of Lake Elmo, Minnesota, will meet at the Fire Hall in said village at 8.00P.M., Central daylight saving time, on Thursday the 21st day of June, 1962, to receive, open, and consider sealed bids for and award the sale of its negotiable coupon general obligation Water Improvement Bonds in the principal amount of $190,0009 to be issued to pay expenses incurred and -to be incurred in the construction ofWater Improvement No.1, pursuant to the provisions and under the authority of Minnesota Statutes, Chapter 429, as amended. Said bondswill be dated July 1, 1962, will be in the denomination of $1,000each; will bear interest at the rate or rates to be desig- nated bythe successful bidder in integral multiples of or 1/10 of 10 perannum, payable July 1, 1963, and semiannually thereafter on January 1 and July 1 of each year and. will mature serially on January 1 in the years and amounts as follows: $51000 1964- 1967 l 10,0001968- 1984 i Minutes of. the May 239 1962 council meeting continued. The bonds maturing in the years 1976 through 1984 will be callable at the option of the village on January 1, 1972 and any interest paymentdate thereafter at par and accrued interest plus a premium of 2% of the par value thereof if prepaid on or before January 1, 1976. Of the bonds outstanding at the time of redemption, those bearing the highest coupon rate will be prepaid first,, in inverse order of their serial numbers. Principal and interest will be made payable at such banking insti- tution in the United States as shall be named by the purchasers. The Village will furnish, without cost to the purchaser, and within 30 days afterdate of sale, the printed and executed bonds and ap- proving legal opinion of Messrs. Dorsey, Owen, Marquart, Windhorst & West, of Minneapolis, Minnesota, and Messrs. Peterson & Popovich of St. Paul, Minnesota, together with the customary no -litigation certificate. Sealed bids marked "Bid for $190,000 Bonds" must be mailed or del- ivergdto the undersigned Villag e Clerk and must be received at his office prior to the time of the meeting. Oral auction bids will not be considered. Each bid must be unconditional except as to legality and must be accompanied by a certified check in the amount of $3,800. payable to the Village Treasurer to be retained as liq- uidated damages in case the bid will be accepted and the bidder shall fail to comply therewith. Eachbond is to b$ar a uniform basic rate of interest from date of issue untilpaid, but bidders may . specify that all or any of the bonds shall bear interest at an add- itional rate, to be represented by separate and detachable coupons, for a period expiring on or before July 1, 1964, provided that the aggregate amount of interest represented by such coupons does not exceed $3,800. The basic rate of interest payable oneach bond of the issue must not exceed the basic rate of interest payable on other bonds of the same or subsequent maturities. Bids will be compared according to the lowest dollar amount of net interest cost computed to stated maturities of said bonds, deducting therefrom the premium if any, and which is deemed most favorable tothe Village.
