Furthermore the problems we are headed for on Lake Jane# as it fills in# should not be compounded. Present:BrookmangWatson,Abercrombie,Shervhe m,Friedrich,Park & Mehsikoiner, Maynard Eder & Bruce Folz speaking in behalf of the trailway system thru parts of the Village of Lake Talmo asked that the Council reconsider the decision given as being opposed to such a system. Motion by Councilman Watson 2nd by Councilman Shervheim that the Council let their decision stand and instruct the Planning Commission to study the pros and cons in more detail and report back to the Council with their findings. Carried 5/0. Dick Lambert asked to be heard relative to the dog ordinance recently enacted by the: Council. It was his opinion that the ordinance adversely affected the: dog breeder who, under the ordinance, would be considered a~ kennel operator. It also opened up the distribution of animals to what Dick chose to call puppy mill breeders which produce an inferior type of animal. Dick said he did not know the answer but volunteered to pursue the matter and report back to; the Coucnil of his findings. Council accepted. Dexter Ziton appeared befog the Council regarding issuance of a building permit on property which he formerly owned and on which he had received as permit to build. Mr. Ziton sold the property to a Mr. Gordan Lane who was refused a permit to build.. Mr. Ziton said that he sold the property in good faith thinking that if he would be issued a permit that another owner would. receive the same consideration. Refusal was given to Mr. Lane to the grounds that the property did not: adhere to the minimum lot size as covered by Village Ordinance. Legal Counsel Raleigh advised the Council that: he had researched this matter and determined that the property had been divided before the ordinance was passed. Motion by Councilman Abercrombie 2nd by Councilman Watson that based on a decision of Village Counsel that the properrty in question was subdivided before the passage of the sub division ordinance that provisional approval of the Gordon Lane building permit be given. Provisional in that it has to meet the requirements of the building code and have a sewage system above the 930 ft. elevation.. Carried 5-»0. At; the request of Ralph Oace & Mrs. Oace a hearing was set up for Oct.6,. 1970 at 7:30PM at the Village Council Chambers to consider vacating a piece of roadway described as follows: All of the 33 foot street lying Easterly of and adjoining; the South 470 feet, of Lot 7, Three Lakes Farm Addition and its extension Southerly to the Northweserly line of Lake Jane Road extended Northeasterly: and, All. of Twk the 33 foot street lying Southerly of and adjoining Lot 7,Three Lakes Farm Addition. Peter Van DuSartz offered some preliminary plans for the development of ]sake Jane Hills. The Council asked the engineer to check into this and have some information for them at a special meeting of the Council on Monday September 28, 1970 at the Village Clerk's Office.. Mr. Van DuSartz was. advised that he would be placed an the agenda of the Village Council for October t:& 209, 1970 at, 8:50PM. Building Inspector advised that xxxk Irvin Friedrich had requested per -- mission to move a house from.Woodbury to Friedrich Heights in -the Village. Ben Friedrich .had inspected the: house and advised the Council that it was a good building and was within the building code of the 'pillage. Permission for the move was given based an Bens: recommendation.. Rich Peterson was on hand to discuss the postion of Forester and wham he was expected to do. He was: advised to check several representative areas and give the council a general report based on this sampling. The Council asked for an educational program to inform the citizens of their position. and what they the individual could do -to correct it. Clerk advised to notify -the press that anyone in the Village that would like to discuss this matter as; it pertains to them with the Forester could leave their name at the Village office and they would be contacted. Minutes of the Lake Elmo Village Council September 115, 1970 Pale 2. Minutes of the September 1,1970 meetin approved as presented, Motion by Councilman Watson 2nd by Councilman Shervheim that the assess- ment levy on 7th Street be limited to 5 years. Carried 5-0. 4.H.requested the use of the Fire Department lot and facilitied for a car wash. Based on no expected objection from the Fire Chief James- Bjorkman permission would be given. Question raised regarding the approval of a special use permit for 3M Club for part of its property as a trap skeet range. In as much as objec- tions were voiced by both affected landowners neighboring the land the Council deferred the matter. Clerk advised to contact the 3M Club and advise them to anike an attempt to settle matter directly with the owners. If arrangements can not be made the 3M Club can request a hearing. of all parties involved before -the Council. Motion by Councilman Watson 2nd by Councilman Shervheim that we instruc,* the Police Committee to contact the sheriffs office and get additional infurmation on furnishing the Village Police protedtion and report back to the Council. Carried 5-0. Clerk authorized to pay bills received late, after meeting of Sept.l. listing to appear in October 6,1970 meetinp,;. Meeting adjourned at 11:302M.
