Minutes of the Take Elmo Village Council October 6, 1970.. Meeting called to order at 7:30PM by acting Mayor Watson. Present: Watson, Abercrombie;Shervheim,Friedrich and Brockman (late.) Also Paxk,Ral.eigh, Bonestroo and Mehsikooer/ Motion by Councilman Shervheim 2nd Councilman Abercrombie that the minutes of the Sept. 15, 1970 meeting be approved as submitted. Carried 4/0. It was reported that numberous vehicles are hauling waste to the county landfill area uncovered. This is in .violation of the ordinance. The Village Attorney was instructed to notify County Engineer of the situation and request corrective action. Letter also to include the fact that waste paper is accumulating along the fence surrounding the landfill. Meeting recessed to take up matter of Oace Bearing on vacation of an easement for street as published in the Gazette. Mr. and Mrs. Oace requested the vacation of said easement. The Village Engineer made several comments regarding access in case of emergency and in the case of expansion beyond -the present proposed Oace 5th Addition. No other persons presented themselves -to be heard and the hearing was closed at 8:1.2 PM. Meeting reconvened at 8:12PM. Councilman Shervheim moved that Resolution R 70 (copy attached) covering the vacation of ALL OF THE 33FOOT STREET LYING SOUTHERLY OF ANT) ADJOINING LOT 7, TIIRvE LAKES FARM ADDITION' Be approved. Councilman Abercrombie 2nd, the resolution and the Council voted 4/0 in favor of said resolution. Mr. and Mrs. Oace requested a hearing onthe proposed plat for Oace's 5tb Addition. Time was set for 7:15 PM on Wednesday, November 4, 1970, Village Counsel to arrange for necessary publication. Councilman Watson moved and Councilman Shervheim 2nd., motion that the following be included in the dedication of the plat on Oace's 5th Addition. Preliminary plat to Oace's 5th Addition be accepted as revised and presented at this meeting. `.chat Lot 1 Block 1 is hereby determined to be of a buildable size provided that the building inspector be instructed that no building permit is to be issued on said lot until the request has been presented to the Council for its approval with a site plan; fubther that -the easement of the additional. 2.7 feet to be dedicated along the Easterly side of such plat shall be dedicated for roadway use with the reservation that if vacated this strip shall revert separately to the abutting property owners on the Westerly side of said easdment. Carried 5/0. Motion by Councilman Abercrombie second by Councilman Friedrich tjiat the Council Meeting scheduled for November 3, 1970 be changed to November 4. 1970 inasmuch as it conflicts with the General. Election. 5/0. Ngtion by Councilman Abe#rcrombie 2nd by Councilman Watson that the Council accept the decision of the Planning Commission regarding moving house from the Pemtom property to Rose Street between 7th Street and Highway 21.2. Approval. given subject to the house being remodeled with all phases including building., plumbing, electrical etc., all meeting the required codes. Carried 5/0. Adeline Johnson requested a permit to put in a garage on North Shore Drive. Matter was referred -to the Building Inspector who was advised to inform Mrs. Johnson of the requirements. Elmer Richert reported that a basement home that was condemned (located on Eagle Point Road) is being lived in. Village Attorney Raleigh will investigate to determine, owner and write letter requesting that building be vacated. An estimate was received for improvement of roof or pumphouse of $6175. Motion by Councilman Shervheim, 2nd by Councilman Watson that we proceed. If it is determined that -the roof is wood braced and needs further repair decision to expend additional monies would rest with Councilman Abercrombie who is in charge of the Water Department. Carried 5/0. Elmer Richert reported -that the outside meter at the Austin Smith residence had been broken for the sedond time. Decision made not to replace unless a meter cabinet is built to protect the meter. Councilman Friedrich authorized to order 4 new tires for the Village Truck from Lake Elmo Oil Co. Clerk advised to prepare a copy of the employee benefits and distribute copies to the Village Employees. Jim Trudeau was on hand to request a special use permit for a kennel on Eagle Point Road. Motion by Councilman Shervheim 2nd by Councilman Abercrombie to approve the.permit based on -the .recommendation of the Planning Commission with the following changes: Item 3 should read 'Subject to renewal once each year?, and item 7 should read' If nuisances (noise, debris, safety hazards, etc.) occur during the year the special use permit may be revoked by the Council with notice 'to Mr. Trudeau. Carried 5/0 Ed Whitman and Diick Lambert .requested authorization to build a wood working shop on Lambert property zoned light industrial. Owner would be Mr. Pechan. Attorney Raleigh to make sure that the necessary easement is included on the description, and plat, Councilman Watson presented Resolution R 70 11 regarding the step development and acquisition of park property for the Lake Elmo State Park. (copy attached) and moved its adoption. Second by Councilman Shervheim. Motion carried 5/0. Councilman Shervheim presented Resolution R 70 12 regarding the acquisition of tax delinquent property of. Howard Heubner (copy attached) and moved its adoption. Second by Councilman Abercrombie. Carried 5/0. Cimarron had requested that someone from the Village be available on Saturday, October 24, 1970 at the Park to process dog licenses for the Park Residents. Mr. Park agreed to handle this request. October 242 1970 from 8-12 noon had been designated as fall cleanup day when the residents of Lake Elmo will be allowed to bring all items that they want to dispose of, that are not normally picked up by local haulers, to the parking lot at the fire hall and it will be hauled to the sanitary landfill in trucks provided by the Village. Tires not included and you have to be able -to load the items on t he truck. Motion by Councilman Shervheim, 2nd by Councilman Abercrombie that the assessment of. The following members were present: r- �� and the following were absent: A101xle The clerk presented an affidavit showing publication of notice of hearing on the proposed assessments for the street improvements of 1970 in the official newspaper in accordance with a resolution heretofore adopted by the Council, which affidavit was examined, found satisfactory, and ordered placed on file. The Mayor announced that the meeting was open for the consideration of objections, if any, to said proposed assessments. A, Q/.L � iC4�l�'GC.�%� �%�4/�C-- :.�.'✓C-rt : "-CK^ -7.7 � ,7 i.•!�•.. j 1�i-Yf� -/�>io V Member sSll,-k V t1CI m then introduced the following resolution and moved its adoption: RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR STREET IMPROVEMENTS OF 1970 Ck- %© 13 BE IT RESOLVED by the Council of Village of Lake Elmo, Minnesota, as follows; tl) The Clerk,, with the assistance of a qualified person heretofore selected by the Council, has cdculated the amount proper and necessary to be specially assessed for the Street Improvements of 1970 against every assessable lot, piece or parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Chapter 429 of the Minnesota Statutes, and notice has been duly published and mailed, as required by law, that this Council would meet to hear and pass upon all objections' if any, and to amend said proposed assessments as might be necessary, and said proposed assessment roll has at all times since its filing been open for public inspection, and an opportunity has been given to all interested persons to present their objections, if.any, to such proposed assessments (and said proposed assessment has been amended as to certain parcels of land, by resolution duly adopted this date),* (2) This Council, having heard and considered all objections so presented, and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment roll(asso amended)* was and is specially benefited by the construction of said improvement in not less than the amount of the assessment set opposite the description of eac h such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied against each of the respective lots, pieces, and parcels of land therein described, (3) The proposed assessment roll (as amended)* is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with the interest at the rate of 8% per annum accruing on the full amount thereof from time to time unpaid shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessments shall be payable in equal annual installments extending over a period of 10 years, EXCEPT the assessment for the improvement of 7th Street between Lake Elmo Road and Rose. Avenue shall, be payable in equal annual installments extending over a 5 year period, the first of said installments' together with interest on the entire assessments from the date hereof to December 31, 1970" to be payable with the general taxes collectableduring the year 1971, and one of each of the remaining installments, together with one yearns interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year thereafter until the entire assessments are paid, *Strike the matter in parenthesis if a resolution was not adopted amending the assessment roll, (4) Prior to certification of the assessment roll to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment with interest accrued to the date of payment to the Treasurer of the municipality. (5) The Clerk shall, as soon as may be, prepare and transmit to the County - Auditor a certified duplicate of the assessment roll, with each then unpaid installment and interest set forth separately to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assessments in the manner providdd by law. (6) The proposed assessments heretofore made in respect of the improvements shall he and are hereby amended so as to read as shown below, and the Clerk is authorized and directed to indicate the said amendments on the face of said assessment roll.
