Minutes of the lake Elmo Village Council Tuesday November 17 , 1970
Meeting called to order at 7:30PM by Mayor. Brockman.

Absent -Watson.
Minutes of the November 4, 1970 meeting approved as submitted. Motion
by Councilman Friedrich 2nd by Councilman Abercrombie. Carried 3-0.
Councilman Shervheim tardy & Councilman Watson absent.
regal Counsel,Donald Raleigh,: requested that the minutes of the Sept..
15, 1970 meeting be amended to show the legal. description of the Ziton
Property in question. Motion by Councilman Abercrombie 2nd by Council-
man Friedrich -to amend the minutes of the September 15 1970 meeting to
include:"All that part of Lot one (1), Section Ten (10�tTownship 'Twenty-
nine (29)North,Range(21) 'Twenty-one West, Washington County, Minnesota
described as followst Commencing at a ;point on the West line of Lot
One(l), nine hundred e9:ght and eight -tenths (908.8) feet South from the
Northwest corner thereof; -thence North 89003t :East two hundred forty--
five (245) feet; thence 2mx±kxXmz±k South 740tR± 39' East three hundred
fourteen and seven -tenths (314.7)feet: thence South 72052' East one
hundred 'thirty six (136) feet to the point of, the beginning, being the
Southwest corner of the tract being herewith described.; thence along
the last stated course a distance of twenty-five (25) feet; thence South
81013' :Fast one hundred (100) feet; thence North one hundred sixty-one
and four --tenths (161.4) feet; thence North 740 West one hundred twenty-
fi.ve(1,25) feet; thence South to the point of beginning of the tract
being herewith. described.# According to the United States Government
survey thereof. Carried 3-0.
:Elmer Richert advised. -the Council that there are a number of items that.
he feels the dounc:il should consider obtaining. They include: Air com-
pressor 1-�v - 3 HP. , creeper, acetylene torch and tanks, striper and a.
clock. Quotes will be obtained and items will. be compared and discussed.
Councilman Shervheim moved for -the adoption of Resolution 11- 70-4-2 14
(copy on file in Village Office) which.covered the establishing of speed
regulations on streets within the Village of lake Elmo. Second by Council
man Friedrich. Councilman Abercrombie and Mayor Brockman also voted in
favor of said resolution. Carried 4--0 with. Councilman Watson absent.
Letter from Gary Wright regarding the responsibility for the improper
apron extending into and above the village roadway on Garner Drive.
Clerk instructed to file correspondence.
Manx Miss Carol Kelm asked the Village if they would correct the apron
problem.that she has on North Shore :Drive. She claims to have exhausted
sources for this type of work because the job wastoo small or they
were too busy. Elmer Richert instructed to include thie on his repair,
agenda when he does do any blacktop work.
Fire chief J.Bjorkman asked the Couneil.what position it was taking re-
garding the '.Graining Schoolfof firemen being established in the metro-
politan area.. Cost of establishing such a, school would be divided amongst
the I communities sponsoring it. Chief Bjorkman was asked to investigate
further and set up. a meeting of the fire department and the Vi17a ge
Council along with one of the individuals working on establihing the
school who can fill us in.and answer any questions regarding the subject
that may be brought up). Meeting to be scheduled for some time after the
first of the year.

Tom Torseth, member of -the Planning Commsihiion, asked for Village
consideration g for a plan offered by Anton }Friedrich & G.Seigfreid Jr.
Plan called for 14 split level dwellings on a six acre tract North of
Eleventh Street just Fast of the old Village limits. The units would be
under Corporate Control with all residents being members. Council. was
asked if they would 'look favorably on such an approach. Motion 'by
Councilmen Shervheim 2nd by Councilman Abercrombie that Council give a
general approve to study the matter further such as streets, gas main,
percolation tests,etc, and was not to be considered as final approval.
Motion carried 4-0.
Notice of meetings. Nednedday November 1891970 at 1000AM at the VFW
a meeting on the Overall Plan for the Valley Branch Watershed :District.
All members who can are encouraged to attend.
Thursday November 19,1970 at 7330PIVI at the VFW Hall a meeting of the
Transit Commission. Attendance optional..
Bids were received from Haines Tree Service and from Ray Zoller for
removal of -trees in the Village of Lake Elmo which come under -the Village
jurisdiction. Zeller quoted V 50..00 per tree compared to $165.00 from.
Baines.. Motion by Councilman Abercrombie 2nd by Councilman Shervheim to
advise Zoller that he was low bidder and
would be awarded any 'tree removal business issued by the Village. Mr.
Zeller was to be informed -to include the Fake Elmo Council as additional
insured on his policy. Carried 4-0.
Dave Cady of Cimmaron requested. approval for privacy fences and door
covers. It was pointed out that the private fence question was turned
over to the building inspector and it was up to him xx& to vote approval
on type of fences and matter of permits. Mr. Cady was advised to take
( matter 'up with Mr. Ben Fktedrich. The plans for -the door covers was
being worked on by 'the Pemtom designer and Mr. Cady said he would have
a plan for Council consideration at the next meeting.
Clerk to invite B & E Patrol to next meeting to discuss the activitied
to date and see how program is working.
Resident of 2670 Shore Drive Demonttevi.11e complained that the drainage
facilities in 'the ditch near his property would not handle the water
adequately.. Village Engineer agreed to look at -the matter and make a
:recommendation.
Ray Schneider 2445 Lake Jane :Drive requested that the Village do some-
thing regarding the Panasow problem. Engineer and attorney advised. that
Mr. Pana.sow had been directed by the court to make certain repairs to
alleviate conditions that exist. The engineer felt that efforts were
'being made to carry out the order but that the weather was the: control--
ing factor. Given a chance the individual would amke the necessary im-
provements.
Rich Peterson,Village Forester, submitted copies of his report and went
over details briefly and then asked the Council to read it over and then
go over it more in detail at the next meeting. Mr. Peterson was set up.
on the December 11, 1970 agenda at 9.00PM.
Snowmobile Ordinance was discussed briefly but page 3 was missing so
clerk advised to distribute copies of page 3 and the ordinance would.
! be considered at the December 1, 1970 meeting.

Request received from Barton Contrac•tin Company for the Special Use Permit
to remove stock piles of crushed gravel from property of Fred I?i.chert,
Motion by Councilman Shervheim 2nd by Councilman Abercrombie that the
Special use Permit be reissued for another year but with stipulation that
no more material be crushed and that :Barton is responsible for any damage
to Village roads. Carried 4-0.
Minutes of the Special Meeting Of Monday November 9, 1970 kx were distrib-
uted and after review motion by Councilman Abercrombie 2nd by Councilman
Friedrich that they be approved was carried 4-0.
Clerk advised to prepare a list of all -the establishments in the Village
that may dox burning, other than residential. This information required
to complete work on decision o.z Polutibn Control Agency 'to 'ban burning
of any type before March 59 1971.
Motion by Councilman Shervheim 2nd by Councilman Friedrich that the
following liquor licenses be approved..
