November 3, 1970 for the purpose of renewing an application

Tract 29 North, Range 21 West of the Fourth Principal Meridian.
This matter has been considered by the Planning Commission
and I assume that you have a report from that body.

Minutes of the Lake Elmo Village Council November 4, 1970
Meeting called to order at 7:30PM 'by Mayor Brockman.
Present:Brookman,Watson_,Abercrombie,Shervheim,Friedrich,Park & Mehsikomero
Motion by Councilm.an.Abercrombie 2nd by Councilipan Watson that the
( minutes of -the October 20, 1970 meeting be approved as submitted.
Motion carried 5-0:.
Correspondence: Clerk read letters from the Village Counsel, Raleigh,
to Mr. Caldwald and Mr. St.John relative to the Council decision that
they both be required to move the fences, which they have installed,
back out of the road rightwa-way.
Letter received from residents on Kressin Lane requesting the install-
ation of street lights. Clerk instructed to write the individuals that
made the request and advise them that Kressin Lane is not a Village
Street and the Village can not accept the responsibility to put lights
on private propertyo
Letter from.Dennis Gonyea regarding developing the area formerly awned
by Russ Morgan. Clerk instructed. to write and inform Gonyea that they
should make arrangements to appear before -the PlanningCommission.
Letter received from the Watershed District regarding a meeting on
Wednesday November 18,. 1970 at the Lake Elmo VFW Tull. Clerk instructed
to consult with the Village Engineer and determine in.he fel(b that it
required attendance of all or part of the Village Council.
Mmxx Mr.Driscoll,.Mr.Milner, Mr.Hartman and Mr. Pechan appeared relative
to Carlson Acres.. They objected to the requirement of a 100° dedication
for a roadway. Since legal counsel for the Village wasnot yet present
the matter was delayed. Mr. Driscoll, Attorney, was advised that the
Village Attorney,.Don Raleigh, would be advised of the discussion an the
property involved and the decision required as to whethek'=we were ask-
ing for an easement or a piece of dedicated property and that Mr. Ral-
eigh would be advised to contact Mr. Driscoll to explain our position4
Norman Wendt appeared on behalf of Norman Schwartz and a building per-
mit to enlarge the Twin Point Tavern with a 361 x 36' addition Some
doubt existed as to the submitted floor plan and ;possible changes. Mr.
Wendt said he would get this question .resolved. The description of the
property was vague and a detail of area for parking was based on.a
guess rather than actual measurement. The Council_ advised Mr. Wendt
that a special meeting would be scheduled at which time he should be
prepared to submit the final floorplan, a detail of the parking lot.
showin measurements and proving that the reduced area was adequate to
park the required number of cars and also, to supply a statement to the
effect that the trusses to be used would withstand the weight that might.
be placed on. them for the size involved.. Don Raleigh was charged with
the responsibility to write to Mr. Schwartz xxk explaining what was
required . A copy of this .letter should also be directed to Mr. Wendt,
Special Meeting set for Monday November 99 1970 at 7:30PM.
Cimmaron had requested through the bmi].ding inspector approval for
privacy fences for installation in the Cimmaron Park Area. Ben Friedrich
Building inspector was authorized to approve a certain size and type
privacy fence that can be used. Once this decision had been arrived at
permits could be issued by the inspector as the need arose4

Dick Lambert and Mr. Spanner came before the Council asking for a
Special Use Permit to permit do racing within -the Vill-age of Lake 'Elmo.
Location to be within the West of -the SV4- of Section 169,T29,R21 W
lying between the Southerly right of way line of the Minnesota State
Trunck Highway 212 and the Northerly right of way line of the Chicago
Northwestern RR.
The Council reviewed the minutes of the Planning Commission regarding
this request. Moved by Councilman Abercrombie with 2nd by Councilman
Shervheim that we approve the request for dog racing subject to the
following conditions which will be spelled out on the Special Use Per.
mit. 1Sunday Racing, 1:OOPM to 6:OOPIVI only.
2.Saturday racing,, 9:OOAM to 6:00PM only.
3.Snow -fence acceptable to: fence in track for duration of 3st yr.
4.East border of property to be screened with a planting of Con-
ifer Treec.
5.Special use permit allowed for 1 year with a hearing prior to
re —issuance of special use permit, with official notification
to all area residents. Reviewed each year thereafter.
6.Owner or operator shall take steps to abate noime or any nuisance.
7.Approved site plan filed with. clerk.
8.Premises shall be maintained in a safe clean sanitary manner.
9.Sanitary disposal systemx shall be approved by engineer and
.subject to periodic inspection.
10.Pleasing view shall be maintained (no junk, weeds, ill repair).
11.1f nuisances occur,the permit may be revoked or amended fol.
lowing a public hearing.
12.Refer-to. pages 61-63 zoning regulations-- conditions for special
use permits.
Motion carried 5-0.
Letter received from one of the residents of 'Tablyn Park that one
additional light was required to complete the lighting of the area.
Clerk instructed to write to Mr. Graham of 1VSP and ask for expanation
since the lighting was based on NSP recammendationy
Arrangements should. be made for a, Public Information Meeting on the
possible acceptance of the Metro area. Street naming and Numbering
program. Donn. Pepper to be contacted and if such a meeting could be
set up in November then set it up if not meeting should be planned for
January,.
Don Raleigh, Village Counsel, presented a copy of a proposed snowmobile
ordinance. Since it was rather involved Clerk was instructed to dist—
ribute copies for the Council to study so a decision could 'be arrived
at during the November 17, 1970 meetin:.
Counsel requested to draw up a Special Use Permit -to cover the requested
gun range for the 3M Club. This would be reviewed and a decision due
from th; Council at the Novembe*1'7, 1970 meeting...
Clerk advised that the judges of the election had submitted the fol.
lowing results. For Councilman Lehart Friedrich 721, Jess Mottaz 3559,
James Lohmann 1, David Loas 1 and 34 ballots with no vote
For Constable James Eder 716, Brian Smith 3209 James Lohmann 19
Willard Eder 1, Al Haseley 1 and 73 ballots with no vote.
Motion by Councilman Abercrombie 2nd by Councilman Watson that results
of election be approved as presented by clerk and that; Lehart Friedrich
and James :Eder be shown.as -the winners of their respective office.
