RESOLUTION OF
THE VILLAGE OF LAKE ELMO
A RESOLUTION DELETING CERTAIN PROPERTIES FROM THE W.O.N.E. SANITARY
SEWER PROJECT ASSESSMENT ROLLS.
WHEREAS, it appears that the real estate owned by the Commissioner
of Highways of the State of .Minnesota, which real estate is more fully
described in "Exhibit A" annexed hereto and made a part hereof, is not
subject to special assessment for improvements made in connection with
the W.O.N.E. sanitary sewer district project; and,
WHEREAS, it further appears that the amount which would have been
assessed against said property if said property had been privately
owned may be collected from the Commissioner of Highways through the
procedure provided by Chapter 435 of the Minnesota Statutes, but not
through special assessment procedures;
NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the
Village of Lake Elmo, as successor to the Town Board of the former
Town of East Oakdale, Washington County, Minnesota, that the assess-
ments against the said property owned by the Commissioner of Highways
be, and hereby are, stricken from -the said assessment rolls.

WHEREAS, it appears that the real estate owned by the Commissioner

BE IT HEREBY RESOLVED, that Councilman Robert Watson be, and :Hereby
is, appointed to the Board of t'rie W. O. N . E . Sanitary Sewer District to
serve thereon as the representative of the Village of Lake Elmo.

COUNTY FOR FEDERAL -AID HIGHWAY

THIS AGREEMONT made by the (Village) of bake Elmo
Minnesota, herinafter called the "Municipality" with the County of
Washington
, hereinafter called the "County", WITNLSSETH:

WI-I-EIC,AS, the United States Government, through the Bureau of Public
Roads of the U. S. Department of Transportation does apportion Federal funds for
the construction, reconstruction and improvement of highway projects on approved
systems of public roads, and
WI-E,IZD S, said. State slid. Highways _iTithin . the,-limi.ts of. a Municipality
are now or may be eligible for the participation of these Federal funds in their
improvement or construction, and
WHEREAS, the Bureau of Public Roads as a condition to the use of
Federal funds on approved State .-.id Projects requires the agreement of the
Municipality to control road signs, traffic control devices, advertising signs,
miscellaneous installations, speed and parking,
NOW, TTL:'.21FORE, The iunicipality in consideration of the expendi-
ture and use of Federal funds for the construction, reconstruction, or emprove--
ment of any State Aid Highway Within the limits of the i`uiiicipality agrees with
the County as follows:
(1) No signs, traffic control devices or other protective devices.
shall be erected on any Federal -Aid Secondary project within the lunicipality
limits except as shall conform with the current Manual on Uniform Traffic Cont-
rol Devices for Streets and Highways of the State of vlinneaota.
(2) All right of way within the limits of the Municipality on any
Federal --Aid Secondary project shall be held and maintained inviolate as a

public highway and no posters, billboards, roadside stands, curb pumps,
curb service devices or other private installations and no signs, other
than traffic control or protective devices shall be permitted within the
right of way limits of the projects. The Municipality will with respect to
such items as are within its jurisdiction which may be or cause an obstruc-
tion or interfere with the free flow of traffic or which may be or cause a
hazard to traffic or which may vitiate or impair the usefulness of the pro-
ject and which may be required to be removed by the County at its own
election or at the request of the Federal. Highway Administrator remove or
cause removal of the same.
(3) The speed limits on any Federal -Aid Secondary project shall
be not less than 30 miles per hour.
(4) Barking regulations generally recommended by the Commissioner
of Highways and the Federal Highway Administrator for use under similar
conditions shall be adopted on any Federal -Aid Secondary project.

RESOLUTION OF
VILLAGE OF LAKE ELMO
RESOLUTION REGARDING THE PROSECUTION OF CERTAIN ORDINANCE VIOLATIONS.
WHEREAS, Complaints have been filed in the Washington County Municipal Court
charging five officers and employees of Fischer Construction Company with violation
of Ordinance No. 10 of the former Town of East Oakdale regulating the removal of
gravel within said Township (now the Village of Lake Elmo); and,
WHEREAS, said defendants have all entered pleas of "not guilty" and trial of
issues so joined is now pending; and,
HHEREAS, said Fischer Construction Company has, since the filing of said complaints
against the officers and employees, appeared before the Board of the former Town of
East Oakdale and has entered into a permit -agreement with said Town Board and posted
a bond conditioned on its proper performance thereof; and,
WHEREAS, representatives of Fischer Construction Company have represented to said
Town Board and this Village Council as its successor, that the violations of Ordinance
No. 10 resulting in said complaints were unintentional; and,
WHEREAS, This Village Council while of the opinion that the complaint of
violations were and are indefensible but have arrived at the conclusion that said
defendants should be given the benefit of any doubt in the interest of the furtherance
of justice and in consideration, of the fact that the Fischer Construction Company has
bound itself to correct any damage created by the activities of said defendants.
NOW, THEREFORE, BE IT RESOLVED That the Village Attorney be authorized to move
said Court for a dismissal of said complaints for the reasons aforesaid.
BE IT FURTHER RESOLVED, That any violation of ordinances relating to the removal
of gravel within this Village, whether on the part of any of the said defendants or
any other persons, be promptly prosecuted so as to invoke the maximum penalties
provided by law, and, thereby, prohibit and discourage such activities as may be
detrimental to the public interests.

A RESOLUTION RECO1,RVIENDING ESTABLISHMENT OF A METROPOLITAN PARK IN THE
VILLAGE OF LAKE ELMO.
WHEREAS, the Village Council of the Village of Lake Elmo has become
aware that the Metropolitan Park Board and the Metropolitan Council have
been considering a proposal for the establishment of a Metropolitan Park
within said Village - specifically, within the area of Eagle Point Lake
and the southwestern side of Lake Elmo; and
WHEREAS, various persons and organizations have, from time to time,
been heard by said Council in connection with said proposed park; and
WHEREAS, said Council is of the opinion that the establishment of
said proposed park, within the Village of Lake Elmo, would be in the
best interest of both the residents of the Village of Lake Elmo and the
residents of the entire metropolitan area; and
WHEREAS, said Council and its predecessors has been presented from
time to time with the plans of private developers for development of the
same area now proposed for a Metropolitan Park and is of the opinion that
such private development, inconsistent with the proposed park plan, is
an immediate possibility;
NOW, THEREFORE, BE IT RESOLVED, That the Village Council of the
Village of Lake Elmo recommend to the Metropolitan Park Board and the
Metropolitan Council that the said proposed park be established within
the Village of Lake Elmo and that such action as may be necessary for
the acquisition of lands be taken at the earliest possible date because
of the immediate possibility of conflicting private development.

RESOLUTION OF
THE VILLAGE OF LAKE ELMO
A RESOLUTION ESTABLISHING A VOTER REGISTRATION SYSTEM.
WHEREAS, it appears that the Village of Lake Elmo is required by
Chapter 201 of the Minnesota Statutes to establish a permanent system
for the registration of voters; and
WHEREAS, a substantial portion of the voters in the Village of
Lake Elmo have heretofore registered under the registration system
which was in effect in the former Town of East Oakdale:
NOW, THEREFORE, BE IT RESOLVED, that a permanent system for the
registration of voters, as provided by Sections 201.01 to 201.27 of
the Minnesota Statutes, be, and hereby is, established in the Village
of Lake Elmo, as of the date hereof.
Passed by the Village Council of the Village of Lake Elmo this
5th day of May, 1970.

WHEREAS, The following described real estate, lying in the Village of Lake
Elmo, has been forfeited to the State of Minnesota ,for non-payment of taxes, and
WHEREAS, Said land is well suited for use as a park and recreational area, dr
other public use,
NOW, THEREFORE, BE IT RESOLVED, That the Village of Lake Elmo make appli-
cation to the County Board of Washington County, Minnesota, for the release and
conveyance of Lot Five (5); Lot Six (6), except the South Ninety-six (96) feet
of the East Ten (10) feet; the West Sixty and Eight hundredths (60.08) feet of
Lot Seven (7); and the East Sixty and Eight hundredths (60.08) feet of the West
One hundred twenty and Sixteen hundredths (120.16) feet of Lot Seven (7) of the
First Re -arrangement of Lot Three (3), Block Three (3), Lake Elmo, according to
the plat thereof on file and of record in the office of the Register of Deeds

RESOLUTION OF
THE VILLAGE OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING VILLAGE REPRESENTATIVES TO THE W.O.N.E. JOINT
SANITARY SEWER BOARD TO APPROVE A RESOLUTION OF SAID SEWER BOARD PROVID-
ING FOR THE REPAYMENT OF CERTAIN OVERPAYMENTS TO THE VILLAGE OF LAKE ELMO.
WHEREAS, the Village of Lake Elmo (formerly the Town of East Oakdale)
has a credit due from the Woodbury, Oakdale, Northdale, East Oakdale
Joint Sanitary Sewer Board in the amount of $31,168.00 which credit is due
as a result of an area assessment paid to the said Sanitary Sewer Board in
excess of.the amount of participation ultimately determined to be required
from the Village of Lake Elmo; and
WHEREAS, the said Sanitary Sewer Board is presently unable to pay
the Village of Lake Elmo the $31,168.00; and
WHEREAS, a resolution has been presented to said Sanitary Sewer Board
proposing that, among other things, the Village of Lake Elmo be paid int-
erest at the rate of 7% per annum from the first day of November, 1969, on
said $31,168.00 until such time as that amount is paid to the Village of
Lake Elmo and, further, that said principal amount be paid to the Village
of Lake Elmo no later than December 31, 1971:
NOW, THEREFORE, BE IT RESOLVED, that a member of said Sanitary Sewer
Board representing the Village of Lake Elmo be, and hereby is, authorized
to approve the said resolution a copy.of which is annexed hereto and made
a part hereof.

has a credit due from the Woodbury, Oakdale, Northdale, East Oakdale
Joint Sanitary Sewer Board in the amount of $31,168.00 which credit is due
as a result of an area assessment paid to the said Sanitary Sewer Board in
excess of the amount of participation ultimately determined to be required
from the Village of Lake Elmo; and
WHEREAS, the said Sanitary Sewer Board is presently unable to pall
the Village of Lake. Elmo the $31,168.00; and,,
WHEREAS, a resolution has been presented to said Sanitary Sewer Board
proposing that, among other things, the Village of Lake Elmo be paid int-
erest at the rate of 7% per annum from the first day of November, 1969, on
said $31,168.00 until such tive as that amount is paid to the Village of
Lake Elmo and, further, that said principal amount be paid to the Village
of Lake Elmo no later than December 31, 1971,-,
NOW, THEREFORE, BE IT RESOLVED, that a member of said Sanitary Sewer
Board represeating the Village of Lake Elmo be, and hereby is, authorized
to approve the said resolution a copy of which is annexed hereto and made
a part hereof.

RESOLUTION OF THE VILLAGE OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
SANITARY SEWER CAPACITY OUTSIDE W.O.N.E.DISTRICT
WHEREAS, the Village Council of the Village of Lake Elmo has been
approached by several residential areas having sanitary sewer problems as
well as individual developers relative to Sanitary Sewer capacity outside
of the W.O.N.E. District limits, and,
WHEREAS, the Village of Lake Elmo is anticipated to have a population
of 15,400 by the year 1985, and,
WHEREAS, the Village of Lake Elmo feels that additional capacity for
sanitary sewage flow is necessary beyond that presently available and service-
able by the W.O.N.E. sewer capacity for the above projected growth, and,
WHEREAS, the additional area under consideration is felt to be required
for development and will require sewer service in order to grow properly
with economic utility service,
NOW, THEREFORE BE IT RESOLVED, that the Village of Lake Elmo requests
temporary additional sewage capacity through the W.O.N.E. sanitary sewer
facilities for the following property; all of Section 9 and Section 33,
which comprises approximately 640 gross acres in total by providing lift
stations and force mains wherever applicable, said temporary services to be
discontinued whenever permanent facilities are available.

A RESOLUTION TO ACQUIRE CERTAIN LANDS FROM THE STATE HIGHWAY DEPARTMENT
WHEREAS, the Minnesota State Highway Department has certain lands
within the Village of Lake Elmo which lands are owned by the State and
subject to disposition by the Commissioner of Highways; and
WHEREAS, the Village of Lake Elmo is desirous of obtaining such
lands for park and recreational purposes; and
WHEREAS, certain negotiations have been conducted by and between
representatives of the Village of Lake Elmo and the Commissioner of
Highways; and
WHEREAS, it appears that the Village of Lake Elmo will be able
to acquire said lands for the sum of Nine Thousand and No/100 Dollars
($9,000.00) to be paid over a period of four (4) years with six
percent (6%) interest on the unpaid balance thereof:
NOW, THEREFORE, BE IT RESOLVED, that the Village Council of the
Village of Lake Elmo intends to purchase said lands from the Com-
missioner of Highways for the sum of Nine Thousand and No/100 Dollars
or
($9,000.00) on the terms above stated/on such similar terms as may
be authorized by law and agreed to by the Village and the Commissioner
of Highways.

RESOLUTION
VILLAGE OF LAKE E LMO, MINNESOTA
A RESOLUTION ESTABLISHING GUIDELINES FOR PROCEEDINGS BY A DEVELOPER FOR
THE APPROVAL OF A "PLANNED DEVELOPMENT".
WHEREAS, the ordinances of the Village of Lake Elmo regulating and
relating to the zoning and subdivision of land provide for variances
from the provisions thereof for the purpose of developing a "planned
development" or "completed neighborhood"; and
WHEREAS, the granting of such variances will have a substantial
effect on the comprehensive plan of the Village; and
WHEREAS, the Council deems it of utmost importance that all of the
pertinent features and details of any such "planned development" or
"completed neighborhood" plan be presented to the Village Planning
Commission and the Council so that the Council may exercise its discretion
in an informed and meaningful manner both for the benefit of the Village
and the developer; and
WHEREAS, the Village Council has determined that the following
guidelines (set forth below) will tend to insure that all pertinent
information is before Council when they consider the granting of such
variances.
BE IT, THEREFORE, RESOLVEDby the Council that hereafter any proposal
for a "planned development" or a "completed neighborhood" not be pre-
sented to the Council for consideration unless:
1. The proposal includes a completed, detailed plan of develop-
ment for all of the land within the land area covered by
the proposed plat.
2. The proposal includes time tables for the proposed development
established either in terms of years or months or by reference
to specific future events (but, in any case, such specific
future events must be acceptable to the Council).
3. The proposal includes a description of the method by which the
proposed development is to be financed (and the developer must
be prepared to show such financial ability as the Council deems
necessary to assure completion of the proposed plan).
4. The developer has complied with all the procedural requirements
of existing Village ordinances.

RESOLUTION
WHEREAS, A petition has been presented to the Village Council of the
Village of Lake Elmo by Ralph J. Oace and others praying for the vacation
of a certain portion of a public street in said Village which public street
is more particularly described below; and
WHEREAS, Said petition came before the Village Council. for hearing at
a meeting held at 7:30 o'clock p.m. in the Village Hall in the Village of
Lake Elmo on October 6th, 1970, pursuant to notice thereof duly published
and posted as required by law; and
WHEREAS, The Village Council has now determined that the vacation of
the part of said public street hereinafter described is in the interests
of the public and that said petition should be granted;
IT IS, THEREFORE, RESOLVED, by the Village Council of the Village of
Lake Elmo that the following described part of a public street in said
Village be and the same hereby is vacated, absolutely and forever, to -wit:
All of the 33 foot street lying Southerly of and, adjoining
Lot 7, THREE TAKES FARM ADDITION$
IT IS FURTHER RESOLVED, by the Village Council that the Village deems
a benefit to accrue to the Village by being relieved of any responsibility
for said part of said public street and the same is sufficient considers-
tion for the vacation thereof and therefore said vacation is ordered with-
out payment of any cash consideration by the property owners along the vacated
parts of said public street provided, however, petitioners shall pay the
costs of said vacation proceeding.
