Ila is4INU'TES OF THF,0 LAKE ELMO VILLAG11j COIINCIL FEBRUARY 16, 1971 Meeting called to order at 7:35PM by Mayor Brockman. P.r.esent:Brookman,Friedrich.,Abererombie,Shervheim,Park a Mehsi.komer. Absent:Watson. Minutes of the February 4, 1971 meeting were approved as submitted on motion by Councilman Abercrombie with 2nd by Councilman Friedrich, Carried 4/0. Council discussed with John Mueller 3685 Lane Road _, North St.. Paul the possibility of his accepting the position of Plumbing Inspector as well as the interim position of Gas Inspector for the Village of Lake Elmo. Mr. Mueller explained that he was not a, master plumber but that he felt able to handle the position. His background is heating and :sir condition— ing and he is well qualified to handle the position of interim gas insp. Motion by Councilman .Abercrombie 2nd by Councilman Sh.ervheim that Mr. John Mueller(Phone 777 5675 ) be appointed to the positions of plumbing insp. and interim gas inspector for the Village of Lake Elmo. Carried 4/0.. Legal Counsel Raleigh was asked to get copies of the St. Paul oil and air --conditioning codes for review and possible incorporation into the Lake Elmo Village book of Ordinances. Building Inspector Friedrich would accept a plan with a variation on joices. Plan would call for A" x 12" laminated beams on 6' centers. The flooring on top of the beams would be 2" x 6" tongue & groove fir. Engineer Otto Bonestroo to determine the stress and weight load that such a floor would hold and would advise the building inspector, Norm Schwartz was required to post a bond covering the completion of the parking lot at the Twin Point Tavern to Village requirements. As of this date bond had not been received, Mr. Schwartz agreeable to furnishing a certified check in lieu of bond and the building inspector will follow thru on this when Mr. Schwartz returns from vacation. Clerk advised to call a noon luncheon (Dutcho for Thursday :February 25, 1971 at Ben's Elmo Inn. Invitations are to be sent out to those major property owners in the area abutting Highway 94 as well as the Lake Elmo Planning Commission, the Village Engineer, the Village Counsel , the County Planning coordinator and of course the members of the Council. Councilman Watson had interviewed three zluxtIal indivuals from the South end of the Village who have indicated a desire: to become members of the Planning Commission. One vacancy remains and the position is to be frilled by someone from this area. Mr. Watson recommended that the Council consider the appointment of Mr. Ed LeClair (Cimarron address) for this vacancy. Motion by Councilman Shervheim 2nd by Councilman Friedrich that Mr. LeClair be appointed to a one year term on the Commission. 4/0, Clerk instructed to notify Mr. LeClair of this appointment. Mr. Watson. is to be asked to attend the next meeting of the Planning Commission and make the formal introduction to the Commission. Councilman Shervhei:m presented Resolution R71-2 (copy on file in clerks office) to delete the assessment against property held by the State of Minnesota, as identified on assessor's plate numbers 24336 c and 24336 e and moved its adoption. Second by Councilman I'riedrich. Council members present,Brookman,Fri.edrich,Shervheim and Abercrombie voted in favor. Councilman Watson absent. Resolution carried 4/0. MINUTES OF THE LAKE ELE,'O VILLAGE COUNCIL YEBRUARY 16, 1971 page 2. Mrs. Helen Norton 2325 Leer Pond `.frail (Plate 26382-049) submitted an application for. :reduction of Real Estate Taxes. Assessor explained the property and. the assessment. :Motion by Councilman Shervheim 2nd by ( Councilman Abercrombie that r.•equest be refused. Carried. 4/0. Lehart Friedrich reported that two new front tires are needed for the grader. Council advised. him to get prices from Lake Elmo Oil for tires. Reported also that citizens have been clearing 'their driveways by plow— ing -their excess snow across roadway. This practice is illegal. and reports of such special activity should be turned over to the Lake Elmo Police Force so that it may be followed up on and the individuals warned that this practice is not legal and continued practice may be prosecuted. Reported also that children have been digging tunnels in the snow piled along roadways. Clerk informed to have this published. as a warning to parents that this is a dangerous practice. Roof on the maintenance building is leaking on the Northwest corner. Snow should be removed and work scheduled to repair it when the weather permits Question was raised by the Village Engineer as to whether he wasto make the proposed layout for -the gravel. pit recreation area. Clerk advised to relay to engineer that the design layout was his responsibility.. Councilman Abercrombie introduced resolution R71v3 (copy on file in Clerk's Office) regarding the property to be included in determing lot size in part of Carlson's Acres along the proposed roadway. 2nd by Councilman Shervheim. A vote being taken all Council members present voted in favor. Resolution passed 4/0. Councilman Watson absent,( The billing from the Metro Sewer Board was still under investigation by Joe Anderlik and he would advise the clerk of the action to be taken. Legal Counsel Raleigh was follow up on the Baytown annexation with the idea that the Village of. Lake Elmo would be interested in sections 6,7 and 18. Raleigh to make up a petition to present to Tom Torseth to see how this annexation would. be accepted by the Landowners. Clerk asked Counsel Raleigh what was involved in taking a mid term census and getting it approved. The Village has according to the 1970 census 4032 residents. This quantity does not include any of the rKsi-» dents now living in Cimarron. The Village is sure to go over the 5000 figure long before the 1980 census. If we can be .recognized as having an official population of 5000 or more we stand to share in the gasoline tax for road improvement. . Counsel will check and advise at next meeting. Clerk advised to contact Village Engineer and have him establish the amount of -the bond for required roadways in Oace's 5th Addition. Subject of Forester discussed as to wether to retain Rich. Peterson or what alternative would we have. Councilman Shervheim to investigate the status of the State with Mr. Beach of the Department of Agriculture and to what degree could we depend on them.
