Dear Mr. Iverson:
Pursuant to your visit to this office on April 14, 1971, we have examined
our records concerning the water levels of Lake Jane (I.D. No. 82-104),
Washington County.
No official natural ordinary high water mark for this lake has been
established. The Division installed a gage by which to read water levels
on April IS, 1967. Zero reading of the gage is an elevation of 917.17
(Sea Level Datum 1929). The maximum reading on this gage in the last three years
has been 920.5. The'"average" reading has been in the 918-919 range.
Historical estimates have placed the natural ordinary high water mark
at a greater elevation, and the original government land survey places the
meander line of Lake Jane at approximately the 930 elevation. Our gage
readings should not be interpreted as establishing a natural ordinary high
water mark, as the readings are available for only a limited number of years.
Due to the present character of the shoreline, the Division will not
require a permit for filling the area adjacent to the road, as you indicated to
us during your visit. However, the Village Council of Lake Elmo has the right
to set what development standards it desires in the interest of public health,
safety or welfare. You are entitled to access from your lot to the lake over
that portion of your lot within the original meander line, and this area should
be included when calculating your lot area.

Meeting called to order at 7:30PM by Mayor Brookman.

Motion by Councilman Watwon 2nd by (..Abe-rcrombie that the minutes of the:
April 4,1971 meeting be approved as submitted. Carried 5--0.
LeRoy Rossow came before Council to request a variance on lot 9,Block 3
in Tablyn Park. Mr. Rossow explained that he actually had a lot with a
113 .ftl frontage and that total area amounted to 47,000sa ft. which is in
excess of an acre. Further that .he had contacted the clek and been advised
that since the plat was approved- prior to adoption in 1968 of the sub -
'division ordinance that the lot was bu.ildabl.e. Motion.by C.Shervheim 2nd
by C. Abercrombie that the variance be allowed and the building inspector
be instructed to issue a permit if the building plans are acceptable.
Motion carried 5-0.
Mr. Milner. and Mr. Peehan appeared again regarding the plat for Carlson
Meadow 1st subdivision. Motion by C. Watson 2nd by C. Shervheim that the
plat be approved. Carried 5-0., A preliminary copy of the plat is on file
with the clerk; 4 copies of the finalized plat will be furnished as soon
as all the necessary signatures have been obtained.
1V1r, and Mrs. Herold Iverson appeared before the Council regarding a
variance on lot 21 Berschen's Addition. Repxkortedly lots 21 & 22 were
both listed as non buildable lots accori.ding to the Iversond. May 1, 1968
a building permit was issued to Panasow & Sjonblom to build on lot 22.
The conservation department had given the Iversons information that said.
the high water mark was 920ft and the highest level reached in the last
century was 917ft. and that was in 1965. 0. Watson explained that the
high waster mark is 920 ft. but the buildable area of the property must be
above 930 ft.r this is the point at which the water from the .lake would
start to runoff into another lake. The Iverson's claim that the xxazavxx
conservation department had advised them that they could haul in -fill for
all the property above 920 ft.. to which the council. agreeg. The Mayor
expressed concern that the members of the Council were all not fully aware
of the situation and the contour of the property and advised that the
Council would meet in special session on Tuesday April 27, 1971 at 7a00
PM at the Village Office and would make a tour of the property before
rendering a final decision. Counsel Raleigh was asked to check the status
of the road easement next to lot 21 which is Village property..
Clerk instructed to have a copy of the plat at the special meeting; also
instructed to remind Council members of the meeting a day ahead. .Also to
be discussed at this meeting is the comprehensive sewer study and several
ordinances that are still unresolved.
Mr. and Mrs. Iverson are to be on the May 4, 1971 agenda at N OOPK for
a decision prom the Council.
( ;Peter Bloomquist 1886 Lake Jane Drive appeared before the Council regarding
a special use permit for a, swimming pool. The Planning Commission had
reviewed this request at their meeting on April 13, 1971 and had made a
recommendation to approve the request. Certain conditions regarding the
installation were listed. Motion by C.Shervh.eim 2nd by C.Watson that the
Special Uwe Permit be granted subject to the conditions .laid down by the
Planning Rammm±± Commission. Carried 5-0.

Fifty residents of the take Jane area appeared before the Council re-
garding approval of the lake Jane Hills :Development. Rumor was that the
Council would render a decision on this matter at this meeting.. It was
1 pointed out that the Council was still awaiting a recommendation of the
Planning Commission and until such time as this was received no decision.
.would be handed down. Possibility is that this will be available .for the
meeting of May 4, 1971. A number of the residents were allowed to express
their opinions which basically amounted to three; objections; 1.they are
opposed to a variance that would cut the .required .lot size below the one
acre currently required, 2.they object to approval of any multiple type
dwellings in the area, and 3-they did not feel that sewer is a necessity
in t.heir area, at this time. Residents were informed that the Council
will keep their comments in mind.
Mr. Bill Parks advised that a Mr. Larry Johnson informed him of the avail-
ability of photographs taken over Lake Jane at the time of the establish --
went of the Washington Mxxxx*g County Landfill showing where four tesidents
were actually running raw sewage into kkx Lake Jane. The Council advised
Mr. Parks that they were unaware that such a photo existed and asked him
to pursue the possibility of obtiining the photo for the Council.
Henry Meier of Jurek.Constru.ction requested that the Council issue a
Special Use Permit allowing him to remove fill from the Morgan (Arrow
Development) Property in Section 32 Village of :cake :Elmo. :Purpose of the
removal :is to furnish cover for the sanitary landfill at Pigseye. The
complete contour of the area was rather vague and Mr. Meier was to, at his
expense, review the property with. the Village :Engineer and then report
back to the Village Council; this action taken ona motion by C.Abercrombie
and sedonded by C. Watson. It carried 5-0. Jurek Construction kal has a
one year contract for this work and would like the permit to cover this
period.
GRAVEL PIT PARK RECREATION AREA The first plans for development of the
17 acre parcel was submitted by the Village Engineer, Joe Anderlik, A
number of citizens from the Lake Jane Area interested in this area of
recreation were on hand to listen to the presentation. It was pointed out
that the Village had budgeted $4,000.00 for this project but that of this
amount $3,000.00 was for partial payment for the property. The first item:
of general interest is the installation of a ballfield., C. Shervheim.was
instructed to get bids on this phase of development.
It; was suggested that a committee of interested citizens be formed to
act as advisors in the development of the entire area and to assist in any
way passible in getting phase one moving. The following names were given
as volunteers for this committee:George Swanlund, Dave Morgan, Don Karnuth,
Tom Skalbeck, John Weaver,Dick Johnson, William Parks, Ron Weber, and
representing thePl.anning Comma±z ission Bruce Folz. It was pointed out
that everyone listed was from the immediate area and this brought about the
residents from other parts of the Village also be appointed so that their
is no feeling that this belongs to ant area and not the Village.
Mr. Jerry Mogren had asked the Village Council to consider the possibility
of annexing 400 acres, now in Grant Township, to the Village of :cake Elmo.
Motion by C.Abercrombie 2nd. by C.Watson that the clerk inform Mr. Mogren
that the Village did not feel this move in the best interest of all con-
cerned and that the Council did not look favorably on and would oppose
annexation. Motion carried 5-0.

Clerk instructed to send Grant Town. Clerk a copy of Letter to Mogren.
Carl Abrahamson submitted a request for variance allowing him to move a
f 3 car garage from St. Paul onto his property at 2681 Shore Drive. The re-
quest has previously 'been studied by the Planning Commission and by the
building inspector with the recommendation that the request be approved.
Motion by C. Shervheim 2nd by C. Friedrich that the variance be allowed.
Approval subject to the conditions spelled out by the Planning Commission
limiting use, etc. Carried 4--0 with C. Watson abstaining.
Counsel Raleigh was asked to make some recommendation at the next meeting
( regarding modification of the ordinance controlling this type request.
Counsel Raleigh was instructed to draft a letter for mailing to Carl
I-Ierman, attorney .for Pemtom advising that they should cease any construction
at Cimarron until. Phase 3, which is delinquent, has been submitted and
approved by the Lake Elmo Village Council.
Tri-Lakes Assn requested the use of a truck and driver :for their spring
clean-up on Saturday May 8, 1971 from 8AM until Noon. Council approved the
request and will furnish the truck and driver at 9$10.00 per hour.
The Village of Lake Elmo will hold a general spring cleanup with citizens
allowed to bring items not normally picked up by trash haulers. Date of
clean-up is Saturday May 19 1971. Materials may be brought to and loaded
on. trucks located in the parking lot next to the Village Hall. A second
clean-up date will also be scheduled in the near future.
Complaints have been received that residents are violating Ordinance #35
of East Oakdale which prohibits the use of blacktop streets .for horses.
Councilman Abercrombie was instructed to have the Lake Elmo Police issue
"tickets for those violators.,
I4ayor :Brockman had submitted to Robert Brown,Minnesota Senator, objecting
to S.F.1204 regarding the freeze on tax levy at the 1971 rate. Motion
by Councilman Abercrombie 2nd by 0. Shervheim that the Council support the
action of the Mayor and that a letter also be sent to Representative
Albertson expressing the same opinion regarding the corresponding H.F.
Carried 4-0. Mayor Brockman abstaining.. Amendment to be modified to state
"unless another alternate; -tax source is established, for local income..
Cimarron has submitted a request for an ON and an OFF sale 3.2Malt Beverage
License. Council has delayed action on this until Counsel has an opportunity
to submit a new revised Ordinance covering the distribution of Malt Bev.
Clerk advised to make copies of the, proposed ordinance on misdemeanors
to the 0ounci.l Members so that they can review and be in a position to
discuss and resolve at the special meeting on .April 279 1971.
The subject of Oak -Wilt and Dutch Elm Disease was again brought up. C.
Shervheim advised that an informational meeting would be held about the
( middle of May, exact date to be determined, at which a qualified person
would discuss the problem, will show films on the subject and will conduct
demonstrations in the use of chemicals for the attempted control of the
disease. Notices will. be published prior to the meeting assuring the best
possible attendance..
C. Abercrombie presented Resolution R71-6 (copy on file in clerk's office)
regarding establishing a $5.00 fee for special burning permits. Counsel to
( supply list of donditions under which a permit may be issued and if the
individual still wants to file the request he must pay the fee. Second. to
the resolution by C. Shervheim. Carried unanimously. 5-0.

C. Shervheim advised that the Lake Elmo Lions Club is donating to the
Village of lake Elmo a. new set of metal bleachers. Approximate cost
$19100.00. Quotes are being obtained for the installation of the mX
concrete slabs, called pads, xxgx±zx1 recommended for installation by
the council this year. C Shervheim to proceed with project.
Motion. by Councilman Watson 2nd by C. Shervheim that claims 150 thru
jib be approved for payment. Carried 5-0.
