The Council nesting on Tuesday, May 18th, will adjourn promptly at 10:oo p.m. -- Kelly Brookman ITEMS TO SE DISCUSSED MINUTES OF THE LAKE ELMO,MINNES'OTA COUNCIL MEETING MAY 180971 Present;:Brookrnan,Friedrich,Watson,Abercrombie,Shervheim4Park,Attorney Raleigh,Engineer Bonestroo & Clerk Mehsikomer (late). Meeting called to order at 7:OOPM and the entire Council toured the Village streets to determine the work necessary in 1971. 3rd & Kalmai. Drainage problem- new profile necessary. S'ealcoat all streets in the old Village of Lake Elmo. Rose St. Regravel & grade. Poppy St. North -South direction remove blacktop and replace base & matt. Lake Jane Drive Request county to seal coat this year. 7th St. Level and fill holes and seal with oil. Park St.011 street. North Shore Drive Strip out or Level but must be re-examined after drying out. Village engineer will re-examine. Motion by Councilman Shervheim 2nd by C.Abercrombie to accept the minutes of the May 4, 1971 meeting as submitted, Correspondence read, discussed and ordered filed. Mayor Brockman indicated that he would attend the meeting called by the Public Service Commission for Tuedday June 29, 1971 at 10:OOAM in the new Washington County Office Bldg.to discuss the crossing of the Chicago & Northwestern Railway & Washington. County 17 in Lake Elmo. Letter from the Village Engineer'm regarding the proposed Hwy 94 was reviewed. Motion by C.Shervheim 2nd by C.Watson that Clerk write to D.R. McFadden and send him a copy of tbte Engineer's report and recom- mendations. Carried unanimously. Petition, signed by 17 residents or land --owners on bake Jane, received asking the Village of Lake Elmo. to vacate certain Village property (see petition for complete description). Motion by 2. Mayor Brockman 2nd by 0. Watson that this matter be turned over to the Planning Commission for recommendation before hearing.. Carried unanimously. Letter from Mr. Zinchlag of the Insurance Commission read and discussed with the recommendation that the Clerk write each Village employee and advise him that all injuries on the job must be reported immediately, after proper medication and examination is taken, to the Village Office so that either Mr. Ginchlag or Mr. Beutel can be notified of the injury. Motion by C. Abercrombie 2nd by C.Shervheim to proceed with improvement of Village roads as per the recommendation and review. Carried uni_mously. Robert bang & William Pennings regarding a variance representing Mr. Lang was attirney Ted. Collins. 801x200t lot on Demontreville-basement home- for sale i by Lang to Pennings. Basement put in in 1953. Boathouse built 1964 Photos of structure presented 'to Council. Property is listed by Dunn & Stringer. Motion by C.Abercrombie 2nd by C. Watson that the Village Council accept the recommendation of the Planning Commission and deny the variance. Carried Unanimously. Mr. Pennings was directed to try to obtain additional footage in order to approach the minimum frontage of 125t. Clerk advised that $he 3M Club has a building, presently located behind bldg 209 at 3M, which they planned to move to Tartan Park. Blgg size is 11, x 111.,,no other specifics known. Council recommended that this matter be turned over to the Planning Commission for disposition. Page 2. Minutes Village of Lake Elmo Council meeting May 18, 1971 C.Sh.ervheim offered resolution R-71.-7 (copy on file in village office) relative to DELETING CERTAIN LOCAL ASSESSMENTS. Second by C. Watson A vote being taken shows that all councilmen and the mayor voted aye no nayea.. Motion by O.Abercrombie 2nd by C.Shervheim to issue a license as a sewer installer to Dale Elkin 1986 Ridgewood Ave. White Bear Lake,Mn.55110, Motion carried unanimously. Motion by O..Shervheim 2nd by C.Abercrombie to approve payment of claims 202 thru 2/,g. Carried unanimously. Ordinance #120 Regulating fees and useage of Juke boxes cigarette machines and vending machines and pinball machines was discussed.(Copy an file in clerks office) Motion Vy C.Abercrombie 2nd by O.Watson that the Ordinance be adopted with Fee for cigarette vending machine set at $15.00 and the fee: for pin ball amohines and juke boxes set at $10.00. Fees are annual, Motion carried unsn imouely, Ordinance 121 (copy on file in clerks office) covers the regulations covering beer licenses in the tillage of Lake Elmo. Motion by 0, Shervheim. 2nd by C. Watson that Ordinance 121 be adopted with the ON Sale license fee set at $35.00 and the OFFSale at $15.00, Carried unanimously, Motion by 0.Abererombie 2nd by C.Shervheim to approve the application of Cimarron for an ON SALE Beer License as soon as the ordinance has been legally published. Carried 5-0. C.Watson presented Resolution R-71-8 (File copy in Village Office) which authorises the assessor to make certain corrections in. the 1971 assessment of land values only in those plotted areas that are appraised at the pre- sent time. and moved its adoption. Second by C.Abercrombie. Carried 5-0, Mr., Dave Boorman submitted his letter to the Mayor resigning his appoint- ment to the Planning Commission because of his intent to move from the Vil.. Motion. by C.Abercrombie 2nd by O'.Friedrich that the Council reluctantly accept the resignation of Mr. Boorman and that the clerk be instructed to write a gratitude letter to Mr. Boorman. Carried 5-0. Motion by O.Watson 2nd by C.Friedrich that Mr. Fran Fott be appointed to fill the vacancy on the Planning Commifisi..on created by the resignation of Mr. Boorman., Carried 5-0. Councilman Watson was instructed to inform.the Planning Commission that rather than receive recreational property as part of the Lake Jane Hills Development they should accept the cash payment, John Hanner request for abatment of taxes. Motion by C.Watson 2nd by C. Shervheim to establish the total ±axxt#z assessed liability at $17,690. (Land$10,125 Bldg. $7,,565). Carried 5-0. Letter from John Zignago stating that his taxes were too high in relation to other homes in the area. His quoted market value was in line with the: tax statement for 1971. Motion by C.Watson 2nd by C.Abercrombie to deny. request. Village assessor requested to advise the county assessor to relay, the information on the tax structure and how his home was assessed. 5-0.
