Minutea of the Lake Elmo Village Council Meeting, ,rune 15, 1971.
Meeting Called to order at 7s30PM by Mayor 1rookman.
Presents Brookman, Friedrioh,Watson, Abercrombie, Park
Mehsakomer (late) Absents Shervheim
Also present Counsel Raleigh and Engineer Bonestroo.
Motion by C. Watson, 2nd by C. Abercrombie that the minutes of the June 1, 1971 meeting
be approved as submitted. Carried 4-0.
Clerk instructed to see that letter regarding Hwy. 94 be directed to the engineer and
not to the Sate of Minnesota Hwy. Dept.
Correspondence read and following action taken:
Letter from Mr. Taylor chairman of the street naming & numbering committee to Mr. Harris
of the Washington County Surveyors Office read and clerk was requested to include
Mr. Taylor and his committee on the agenda for -the July 6, 1971 meeting.
Letter from Fire Underwriter's Inspection Bureau advised that the new rating for the
area with water and hydrants was class 7 and that the outlying area was zoned 9.
Clerk instructed to include this as part of the news release.
Motion by 0. Watson 2nd by C. Abercrombie that Village 'Engineer be instructed to prepare
an estimate on an analysis of water distribution for the entire Village. Carried II-0.
Noted that notification had been published requesting bids for the Street Maintenance
and Seal Coat Project for 1971 and that bids would be received by the Clerk up to 10.00AM
on Thursday, July 1st., 1971 at which time the opening of the bids would take place.
Opening to be at the Village Hall at 570 Kalmi.a, Lake Elmo, Minnesota.
Motion by C. Friedrich.. 2nd by 0. Abercrombie that the Sewer Installers request (SI13)
from John Jeanette 2476 Century Ave., North St. Paul, Minn. be approved. Carried 4-0.
Clerk instructed to issue permit.
Fire Chief Bjorkman asked about obtaining a map showing all. the Village Street names.
Ile was advised that this was a matter that was in the state of change and that the
committee reporting on this matter would be at the next meeting and when the matter is
finally resolved such a map will be made available.
Mr. & Mrs. Iverson again appeared relative to a variance on Lot 21 Berschens Shores on
Lake ,lane. Letters were presented by C. Watson and by the Iverson each in contradiction
to the other. The letter to WAtsom stated that it was not the intent of the original
letter to the Iversons to allow filling. The letter to the Iverson's states that the
Iverson's have permission to fill up to 100' from the Old Township Rd. Both Letters came
from the Office of Mr. Hollenstein, Chief Hydrologist of the State of Minn.
Clerk instructed to set up a meeting on the site to include Mr. Hollenstein, Mr. Mentor
and Mr. Wright from the State of Minnesota, all possible Council members and the Iverson's,
Meeting to be set up as soon as possible.
Clerk also requested to ask the State of _Minnesota to establish or advise us of established
high water levels on all the Lakes in the Village.
Mr. Caulkin has 3 lots in Tablyn Park (lots 9,10,and 11) with 110' frontage. He requested
a variance so that these lots would be buildable. Council advised him that under the
present conditions a variance would not be given and it was suggested that if he wanted to
sell or build on the lots at this time that he split the three lots into two lots. With
this decision Mr. Caulkin then felt that he was improperly assessed for the property.

Mr. Caulkin;was advised by the assessor that he should fill out an abatement form in the
county assessors office and that this would be considered.
I Ar, & Mrs. Donald Anderson have a 3 acre plot on Sake Demontreville Rd. July 210 1970
Council instructed the Planning Commission to hold a hearing regarding rezoning from
agricultural to SFU. :August ll, 1970 Planning Commission held hearing and made recommendation
to the Council that area be rezoned. No action taken. Motion by C. Abercrombie 2nd by
C. Watson that Tract B - that part of the SW * in government Lot 7, all being in Section 5
Twsp. 29, R 21:in Washington County, Minn. described as follows: Beginning at a point, on
the South line of Section 5 said point being a distance of 1171 feet 'East, of the SW corner
of SW4 thence North at right angles to the South line of said Section 5, a distance of 2941,
thence Fast at right angles and parallel to the South line of Section 5 to the center line
of State Aid Highway 13, be rezoned from agricultural to SFU. Motion carried 4-0.
Mrs. Hedberg will initiate plans for platting thru.:the Clerk's office.
Mr. Bernard Witzman again appeared regarding a variance at 3710 Lane Road. Mr. Witzman
presented a plan showing the removal of some of the present quartessand remodeling the
new addition. C. Abercrombie presented and moved for the approval of resolution R-7141
dealing with subject =varianaev copy on file in clerk's office. Second by C. Watson.
Carried 4-0, Mr. Witzman advised that he must go thru the regular variance procedures
but that he would not be required to reappear before the Planning Commission that this
had been fulfilled. A plot plan must be supplied to the building inspector showing
details before a building permit will be issued for the alteration.
Dr. Schneider appeared before the Council asking if they would consider selling the
property that formerly was the location of the town hall. It was his intent to build a
building that would house 9. dentist, a doctor and possibly a lawyer. Dr. Schneider was
advised that the Council would consider the request and advise him of the action taken.
Mr. Peter Van Dusartz appeared regarding Take Jane Hills Development. Motion by
C. Abercrombie 2nd by C. Watson that since Mr. VanDusartz had taken the necessary steps
having the Planning Commission hearing on June 8, 1971 that the Council approve the
preliminary plat subject to the following revisions to submitted layout. Outlot A should
show that it is for road, water, sewer and utility easements; the plan should call for a
40' setback on all buildings and that the recreational contribution be taken as $.50,09
per lot rather than in acreage. Carried 4-0.
Elmer Haase asked premission to move 3 houses from the Highway 94 road clearance area
to his property to be set on foundations as soon as possible, Motion by 0. Abercrombie
the 2nd by C. Watson that permission be given subject to the following conditions:
That a performance bond, a certified check or a consigned bond in the amount of
$22,Q00.00 be supplied guaranteeing completion of platting, through standard
procedures, and installation of the houses on the foundations within six (6) months
from today. Homes would have to be modified as defined by the building inspector
to bring them up to code. Water & sewer facilities would also be completed.
Carried 4-0.

e , . o noon yen appeared regarding a new layout for the rezoned
property at the intersection of Washington County 17 and present Hwy. 94. After some
discussion it was apparent that no construction of a bowling alley would not even be
considered if a liquor license was not available. Council promised that the subject
license would be reviewed and a decision would be made and given at the next meeting
on July 6, 1971, Council also advised that proposed plan should be given to a professional
planner for an opinion on the layout. Also they should get together with the Village
Engineer regarding the road plan for the area. 'Estimated cost of the facility is $270,000,00.
Gilbert Meyer, William Hagberg, and Ken. Johnson asked the Council if it would consider
selling the property that previously held the town hall. It is the intent of this group.
to remove the present storeage buildings of Mr. Meyer and then rebuild a Country Boy
Grocery Store with adequate parking facilities in front of the store. Mr. Meyer would
also construct a new warehouse on the lot behind the present hardware store. The earlier
request of Dr. Schneider was discussed and this group thought that they could work out
an arrangement whereby another building could be built on the property under question
that would house the doctors and a lawyer. Further discussion on this would be hold
by the :interested parties. Village Council will check into the matter on selling and
if yes, will come up with a price. The group was directed to work out the preliminary
plan showing buildings, alley, parking lot, sewage, etc. Financing for the project
has been committed.
Notification received from the Washington County Assessor that the Personal Property
Board of Evaluation would meet at the Lake Elmo Village Hall on Monday, June 28, 1971
from IOsOO AM to 3:30 PM. It was pointed out that this was personal property only and
did not include real estate taxes.
Mr. Hammes and his son & daughter appeared before the Council regarding the removal of
gravel from his property, it was pointed out that the county has asked the village to
restrict removal in this area since it kept the ground level changing for the 194 roadway.
Mr. Hammes advised that he had a permit signed by Walter Larson permitting him to remove
gravel, The Council asked Mr. Hammes to produce the permit and allow the deputy clerk
to make a copy. The council would review at the next meeting if copy available.
Motion by C. Watson, 2nd by 0. Friedrich that Panasow be given a deadline of July_]., 1971
to complete the work that was directed by the court order, Motion carried 4-0.

Fran Pott of the fire department advised that he had an opportunity to use the
resuscitator to revive his pet monkey. It seemed that the monkey hanged himself and
with fast work on the part of Mr. Pott and the fire department equipment the monkey
was revived.
Clerk was instructed to write to Albertson, 0fdea and Brown and advise them that the
village was in .favor of getting the cigarette tax and.the liquor tax distribution
established at the rate dictated by the 1970 census rather than the 1960 census that
was used for the February share. The annual amount should be directed to adjust for the
entire year based on the 1970 ratio.
Motion by C. Abercrombie 2nd by C. Friedrich that clerk be ordered to pay the bills,
Carried 4-0.
Motion by C. Watson, 2nd by C. Friedrich that meeting be adjourned at 12s25AM. June 16, 1971.
