MEETING OF '1'IM SAKE ,8I.MO VILLAG CODNCTL --- September 21, 1971. Meeting called to order at 7:30 PM by Mayor Hrookman. Presents Brookman,Friedri.ch,Wa'tson,Shervheim, Abercrombie,Park & Mehsikomer. Also present: Counsel Raleigh, Engineer Bonestroo & Bldg. Insn. Friedrich. The matter of Lake Elmo -Oakdale Boundary was brought up since according to the bill passed by the legislature, if no decision is reached by Oct. 19 1971.a petition can be filed putting the matter in the bands of the district court for a decision. Counsel Raleigh and/or C. Watson were to make a final attempt and get the reaction from the Oakdale Council. Clerk pointed out that he had received the latest tabulation of residents in Cimarron and that figure added to the 1970 census brings the total population up to 4077. At the present rate of increase the Village of Lake Elmo would exceed the 5,000 population figure within the next two months. Clerk instructed to pursue the matter and. determine the method of obtaining a special census and report back to the Council. The county engineer said improper parking lines were painted on Washington County State Aid Hwy. 17 in the area of Bents Elmo Inn. Corrective action blocking out the improper markings has been completed. Clerk advised that ads have been placed; a dvertisi ng for bids on a new truck in both the Construction Bulletin and in the Stillwater Gazette. Motion by C. Watson, 2nd by C. Friedrich that a Sewer Installers License be granted to C & P Excavating of Oak Park Heights. Carried 5-0. Mr. Ken Meyer of White Adv., appeared regarding the billboard located on property intended for County Rd. 19. Sign was located in the Village without proper permits or licenses. Mr. Meyer advised that he had been in touch with the county engineer and that he was agreeable to letting the sign remain temporarily but it would have to be removed by October 1, 1972. Motion by C. Watson, 2nd by 0. Friedrich that White Adv. be allowed to maintain the sign thru Oct. 13 1972 providing they obtain the proper special use permit. If sign is to be relocated that White Adv. will submit the design and location to the Planning Commission as required by the Village Ordinance. Carried 5-0. Mr. Van Drashek of Independent School, District 832 presented to the Council the plan for an advisory board to the School Board and asked the Council to supply the name of one responsible candidate who would be willing to serve on this advisory board if selected. Several names were suggested and C. Watson delegated to contact Mr. Rodric Guindon to determine his willingness to accept such an appointment if selected. Letter regarding the Colosimo property, prepared by Counsel Raleigh, was read and approved. Clerk instructed to sign and mail to the Colosimoos. Motion by C. Abercrombie 2nd by C. Watson that Counsel Raleigh check to de- termine that the final plat for Lake Jane Hills has been filed and that assessor affirm that request for reallocation of assessments has been received and been completed and the fee for this action also received. Upon receival of notification from counsel and from the assessor that everything is in order, clerk be ordered to release bond. Carried 5-0. Motion by C. Watson 2nd by C. Friedrich that clerk be instructed to write a letter of congratulations to VFW Post 5725 in Lake Elmo who will be celebrating their 25th anniversary on Friday, September 24, 1971 and as part of festivities will have a mortgage burning. Motion carried 11-0 with C. Shervheim abstaining. continued-- M1NVIES OF TIM 1AXE ETMO VILLAGE COUNCIL MEETING -- Sept. 21, 1971 pg. 2 Approx. 30 residents appeared before the Council to .listen and to voice their feelings on a snowmobile ordinance. Opinions were contradictory as owners and non -owners wanted to be heard. Mr. Bernard Klass stated he represented several neighbors in the Cohn Addition and he objected to being awakened in the early morning hours and to the television disturbance. Ron Swaggert, Mr. Winks both expressed the feeling that noise level was not a problem. Mr. Revoir thought that children under 14 should be allowed to cross Village Roads but not County or State lAiys. Speed limits also varied but it did seem to be agreeable to have one in the populated area, No further comments were forthcoming so Mayor announced that the Council would take all the comments under advisement and that the Council would render the final decision at the meeting on October 19, 1971. Dick Lambert appeared before Council to advise of forthcoming plans. 1. A report on ordinances would be duplicated and submitted to the Council for possible incorporation into a revised Ordinance .for the Village. 2. A pet cemetary is being considered and a special use permit would be processed through proper channels. 3. Want to add a new building 24'x4O' to be used for storage with a potential use of a sportshop for horsemen:. and doglovers. 4. Request also to increase the size of the kennels from 58 runs to 88 or 116 runs. Again this is in planning stage for next spring and -the request will be submitted through proper channels. Motion by C. Shervheim 2nd by C. Abercrombie that a special use permit be allowed in the case of Mrs. Tom Hilpisch to move a building on their property and placed on a site acceptable to the building inspector. A deadline of July 10 1972 to be established for having the building properly anchored on a foundation. Carried 5-0. Robert Landru, Rt. 11 Lake Elmo advised by Mayor that he was in violation of Village Ordinances by bringing a garage on to his property without the proper approval of- thePlanning Commission. Bldg, inspector reported that the garage did not meet code and that he had no opportunity to inspect. Motion by C. Watson 2nd, by C. Shervheim that Mr. Landru make up a site plan showing the location of the garage and other buildings on his property and present it to the Planning Commission for approval. Garage would have to be brought up to code by May 1.. 1972 or it would be ordered disposed of. Motion carried 5w0, Question of liability for trees on road right of way and who is responsible for removal of dead trees, was discussed. Since a great number of trees fitting this description are on county road right of way it was determined to ask the county how they handle this situation and what specific steps they follow before rendering a Village decision. Counsel Raleigh to discuss with County officials. Motion by C. Shervheim 2nd by C. Abercrombie to pay the bills. Carried 5-0, Clerk instructed to get together with C. Friedrich and determine which Village Streets, in addition to Friedrich Road, should be submitted to State of Minnesota Highway Dept. for speed zone review. Planning Commission had asked about the feasibility of requiring all new developments to have phone and electrical services underground. Village engineer recommended such a move. Matter to be considered further. continued-- MINUTES OF THE IAXt ELMO VILLAGE COUNCIL -- September 21, 1971 pg. 3 Counsel Raleigh advised to contact, the State of Minnesota Highway Dept. and advise them of the sanitary & storm sewer improvements that will be part of section 32, Counsel requested to send copies of the proposed contract to owners involved in the Berschsn Shores Town Road vacation for their approval. Councilman Shervheim authorized to discuss with County Commissioner Don Cafferty, possible joint powers act for the operation and development of the proposed park area should the State .Agency fail to complete their proposed plans. C. Abercrombie presented Resolution R71-18 regarding Road Plans for proposed road in Dawein Acres and asked for approval. Second by 0. Shervhei.m. Resolution carried unanimously. Motion by C. Watson, 2nd by C. Shervheim that the abatement request of Vera Horri.gan on Plate #15287 for reduction from $2500 to $500 be approved, that the request of Jerome Van Blairicom, 1925 Eagle Point Road for reduction from $1,000 to �$500 be refused; and that the request of Dean Cochrane for a reduction on lots 100 thru 121, lots 178 thro 185, lots 186 thru 200 be reduced from 9$15,7.50 to $8,000 be refused.
