M_.-- Mrs. Tom Hilpisch _ Negelected to secure building 9.00 P.M. --"Hearing" -- Development of Sewer on Section 32 ITEMS TO BE DISCUSSED Mr. Von Drashek of Mahtomedi School District #832, would like Council Members to submit a name of an individual from Lake Elmo to serve on the Advisory Council of their schools. Mr. Drashek will appear at the Sept. 21st.Council meeting to present this program, at which time the name of an individual from our area can be handed to him. -- Village Office and Meeting of the Lake Elmo Village Council September 7, 1971. Meeting called to order at 7:32PM by Mayor Brockman. Present: Brockman, Friedrich,Abercrombie,Shervheim, Park & Mehsikomer. Also present. -Counsel Raleigh, Eng. Bonestroo, Bldg. Insp. Friedrich Absent: Watson Motion by C. Shervheim 2nd by C. Friedrich that the minutes of the August 24, 1971 meeting be approved as submitted. Carried 4-0. Letter from Engineer Bonestroo received Sept. 7, 1971 advises that the grade on Marigold that causes water to pool can be corrected with proper grading. Motion by C. Friedrich 2nd by C. Shervheim that the clerk be instructed to send a copy of the engineer's report to Mr. Gib Swanson and advise him that he should make arrangements to have the blaektopping completed. Carried 4.-0. Motion by C. Shervheim 2nd by'C. Friedrich to approve SI 000018 (Sewer Installers License) for Sure -Flo. Carried 4-0. Received a report from the State of Minnesota ordering the Chicago Northwestern R. R. to install, withing the next 12 months, a new flashing signal at the crossing with Hwy. 17 in the Village of Lake Elmo. The cost of the new sign is divided among all the interested groups with the Village share being $1,695.00. Clerk instructed to include this in the 1972 budget. Mrs. Colosimo appeared before the Council asking for a decision as to whether or not her property on Lake Jane is a buildable lot. Counsel Ral.ei.gh read a letter he had prepared for the Council advising that although this property did not meet the current requirements tta t it did qualify as a buildable lot as far as lot size is concerned based on history of lot filings. The question then to be resolved is whether or not the lot, being on the shore of Lake Jane, is adequately above the 928' flood plain level. Mayor Brockman recommended that a committee of himself, C. Shervheim and C. Freidri.ch review the property and confirming to Mrs. Colosimo that this is a buildable lot and that a bldg. permit would be issued if the plans met all of the building and supplemental village codes. Joe Lenz asked the Council for a decision on whether or not a commitment had. been made on the entire layout of Kenridge Addition. He was advised that the only thing officially approved was the original Plat that is registered and this covered only the initial 10 lots. Suggested that he redo the balance of the area and submit it to the Planning Commission. Mr. & Mrs. Frank Hoffman 1641 Dusty Lane had appeared before the Planning Commission on August 10, 1971. They asked the Council about a permit to sell their 100' x 240' as a buildable lot. Description of the property is only a meets and bounds description and does not qualify as a buildable lot under the sub -division ordinance. Hoffman's were advised that they should file a request for a variance and then appear before the Planning Commission. Arrangement for this are handled through the Village Office. Mrs. Hilpisch, Rose Ave., appeared as requested by Counsel. She was advised of the infractions involved and what should be done. The foundation that was built on old Hwy. 212 right of way should not be used. The shed that she requests permission to move one=to her property is to be examined by the building inspector and if he agreed the building was worthy of moving on her property he would make a recommendation as to where they could place the building. Since the Hilpisch's have less than 20 acres horses arP not permitted. If they desired to keep horses they would have to fill out a special use permit and go through standard procedure to have it considered. Meeting recessed at 8:55P.M. Meeting of the take Elmo Village Council September 7, 1971 Conttd. pg. 2 Meeting reconvened at 10:OOPM, Peter VanDusartz presented the final plat for Lake Jane Hills for final approval. Motion by C. Abercrombie 2nd by C. Shervheim that the plat of Lake Jane Hills, which was approved by Don Pepper, be approved as submitted. Motion carried 4-0. Motion by C. Shervheim 2nd by C. Abercrombie that bills be ordered paid. Motion carried 4-0, Motion by C. Shervheim 2nd by C. Friedrich that on submission of a bond or a certified check for $7,000.00, Elmer Haase be given preliminary approval to use lots 20, & Lt as building lots, Bond to cover the cost of completing the plat and putting in an acceptable roadway. Carried 4-0. Building inspector advised that when the bond is filed that he may issue the permits. C. A.bed^crombie presented resolution R71-17 ORDERING PLANS AND SnECS FOR STORM AND SANITARY SEWERS in Section 32 and asked for its adoption. 2nd by C. Shervheim. Carried 4-0 C, Watson absent. Engineer ordered to prepare specs on a new trunk, box, plow and sander. Subject of Dutch Elm tree removal on road right of way to be discussed at the meeting September 21, 1971. Motion by C. Shervheim 2nd by C. Friedrich that the abatement request from E. M. Caulkins Blk, 5, Lots 9010, & 11 Tablyn Park Addition be denied. Motion carried 4-0, Motion by C, Shervheim 2nd by C. Friedrich that a fee of $20,00 be established on any request for the building inspector to inspect a completed home that is being bid on with the idea of moving house into the village. This fee paid in advance and is not refundable. Carried 4-0. C. Shervheim presented Resolution R711-18 regarding a hearing for a road on the Dawcin Acres Plat. Second by C. Friedrich. Carried 4-0. Hearing date to be shheduled for October 5, 1971, 7:00 PM in the Village Council Chambers. Because of the late date it was determined to request bids so that action can be completed this year, if approval results from the hearing. Bids to be opened at 10:00AM, October S, 1971 in the clerk's office. Motion by C. Shervheim 2nd by C. Abercrombie that the meeting be adjourned at 11s25PM. Carried 4-0. Respectfully submitted Donald Mehsikomer Village Clerk Lake Elmo, Minnesota Proceedings of public Hearing Regarding ,Storm & ,Sanitary Sewer in section 32 in the Village of sake Elmo. 9-7-71. Mayor 8rookman opened the proceedings at 9:OOPM. Present: Brookman,Friedrich,Abercrombie, Shervheim, Park, Counsel Raleigh, Engineer Bonestroo, Mehsikomer and approx. 25 residents of the area. Clerk read the Notice and advised that said notice -had been duly published and posted as required by law. Carl Rudeen, 3561 Hudson Road asked who would pay for the assessment on the property that would be taken up by the new Highway 194. Bonestroo advised that this was a legitimate improvement and that landowners who are being approached by the State should make this fact known so that they receive appropriate compensation for their property. Joseph Brockman asked about the assessment and was advised that it would be too late for next ,year, The .first assessment would be included with taxes that are due and payable in 1973. Robert Thul asked if contiguous property to the main could hook up to the system and was advised that this would be possible but that such a decision should be made before the system is installed. Also when would work be done. It would be completed in 1972 but would be started now. Herb Beyl asked how many would benefit. It was pointed out that now it would primarily help Cross -Road Ford but that all residents would gain in that it should increase the value of the property. Len Kirvi.da asked if the council had considered assessing the immediate benefactors more heavily and the outlying benefactors proportionately less. He was advised that the assessment had not been worked out but estimate was $56.20 per acre for the storm sewer and $125.00 per acre for the sanitary sewer. This is based on a total cost of $G58,000.00. Robert Thul advised that he was within 500 feet of the proposed system but would probably be the last to benefit. It was pointed out the Cross Road Ford plans calls for the removal of some of the fill, in the low part of the area and that by installing the system now the Village would not have the cost of excavating this area. This in itself helps to make the cost minimal for the installation. Carl Rudeen asked if they petitioned for the sewer to be extended to include them. The answer was tentatively yes but they would have to let their wishes be known now. Robert Thul asked what it would cost to run a 5001 lateral and was advised that it should be about $12.00 per foot. Len Kirvida asked what the interest ,rate would be on the assessment. Probable interest rate 8%. The summary brought out the fact that this system would to in this area eventually and the fact that Cross Road Ford is interested in the area only helped to bring the matter to ahead sooner that it may have -tinder normal conditions.
