Minutues of the Lake Elmo Village Council -- October 5, 1971 Meeting called to order at 8.-PM by Mayor Brookman. Present: Brookman, Friedrich, Watson, Abercrombie, Shervheim, Park & Mehsikomer. Also present: Bldg. Insp. Friedrich, Counsel Raleigh & Engineer Bonestroo. Correspondence read and following action ordered: White Bear Lake Chamber of Commerce asked the Village of Lake Elmo agree to celebrate the holiday of Halloween on the 31 of October. Since the date falls on Sunday they wanted to have all the communities celebrating on the same date. Motion by C. Watson, 2nd by C. Abercrombie that the Village of Lake Elmo agrees to celebrate Halloween on Sunday October 31., 1971 and that the clerk notify the White Bear Chamber of Commerce on this action. Carried 5-0. Assessor & Mayor advised of the meeting on assessing that is required by law and that the date of said meeting is October 14, 1971 at 9:OOAM at the county courthouse. Letter from Dori Pepper regarding the requirements of new plats was read and clerk instructed to send copy to the Planning Commission. Received letter from the Metropolitan Council advising that Washington County was making application for HUD funds and that the Village had 10 days to make comment to the attached letter. Clerk noted that no attachment was received and that a request had been made for the Metro Council to send us a copy of the missing correspondence so that we could comment after we knew what comments were necessary and requested. Letter from Barton Contracting asking that they have their Special Use Permit to remove gravel from their stockpile extended Xor another year as they have not used all the material and they still have contractural work requiring additional. gravel. It was reported that additional material has been stockpiled and that this is in violation of the Special Use Permit. The Clerk was directed to write Barton Contracting and have them appear at the next Council meeting relative to this matter. Requests for Gas Installers Licenses were received from 2 firms. Thomas A. Olson for Ron Granger Plumbing & Heating and Will_Krinkie of the Snelling Co. Council asked that these be passed on to John Mueller and ask that he determine if they are qualified according to the Ordinance. Decision on approval of these licenses would be based on John's report. Letter from the State of Minnesota Insurance Division advising that if the Village of Lake Elmo wants to participate in the State -Aid Aonortionment for firemen's relief that they should file the Audit Report. Firechief Bjorkman and Counsel Raleigh advised that this matter would be taken care of. Letter from Bonestroo Engineering advising that the curbing around the Twin Point Parking Lot was not according to instructions. Otto points out that the opening on the north end onto Kalmia Ave., was supposed to be at the pole whereas it is 50 ft north of the pole. Also the opening is in excess of the maximum which was limited to 22 ft. Engineer suggested that the Council personally check this out to make sure that it is not objection- able. Committee of Friedrich (Chairman), Watson & Shervhei.m are appointed to review and determine action to be taken. Clerk instructed to send copies of Eng, letter to each member of the committee. Letter from Engineer regarding the drainage on the Hoffman lot on Dusty Lane. Engineer recommends that if a building permit is requested and issued we should get a drainage easement along the entire east -west side of the lot .for water conveyance. Letter to be referred to the Planning Commission. Minutes of the Lake Elmo Village Council. _- October 5, 1971. page 2. Letter from Engineer regarding 9.5 acres of land lying South of llth. St. & "West of Geranium that could get landlocked without proper development of •the area. Clerk instructed to turn letter, over to Planning Commission. Letter from Engineer advising that the appropriate method ofextending water to the proposed Hagberg Country Store is along Hwy. 212 to the center of the building. Line should incorporate an 8" cast 'iron pipe. Estimated cost of the improvement or extension is $$3,000, Letter from Engineer advising that Village should consider seal coating on the following streets during 1972. Eleventh St., Eagle Point Road North of KW. 212, Lake Jane Drive North of Lake Jane Rd., Lake Jane Road from Lake Olson to Lake Jane Drive, Harvester Road West of Rd. 80 and McNeely Road from 15 to 17. The estimated cost for budget purposes was $$12,000.00. Clerk instructed to include the amount in the 1972 budget. Mr. Jack Johnson advised the Council that because of delays he was not able to proceed with •the bowling alley at this time but that he planned to pursue •this in the spring. He &sked the Council for direction so that he would not be faced with the same -delays encountered this year. Counsel Raleigh recommended that he proceed with the hearing for a special use permit. A committee of Watson(Chairman), Shervheim, Abercrombie and Raleigh review the Village development program and determine appropriate direction. Jack Johnson will be advised what action he will be required to take. Mr. & Mrs. Charbonneau appeared before the Council and advised that they were being unfairly taxed. Request for abatement was not fruitful. They felt that they should present their own story. Motion by C. Watson 2nd by C. Abercrombie that the County Assessor's Office be requested to review this assessment and say if they agree with or, disagree with the Village Assessor and to what extent. Motion carried 5-0, Council advised Mr. Charbonneau that he would be advised what would happen and when. Tom Backstrom of Cimarron appeared and asked if the Council was aware of the vandalism •that had been taking place in the park area. The main building has been broken into twice in the past several months with about $$3 to $4,000.00 damage each time. New buildings have also been vandalized with all t be furnishings slashed. Mavor advised that Council was attempting to coordinate the police and Washington County Service and determine more exactly what is being done and what can be done to help this type of condition throughout. the Village. Clerk submitted a budget and after it was reviewed and several items completed it resulted in a total budget of $15:9,315.00. Anticipated revenue from other than Real Estate Taxes amounted to $62,454. Local mil rate would remain the same as far 1971 and would bring the Village approx. $99,850.00. Motion by C. Watson 2nd by C.Shervheim to approve budget. Motion carried 5-0. Copy of budget available in clerk's office for examination. C. Abercrombie advised that the cost of lowering the :lights and carpeting floor would cost less than $2,000 and moved that he be authorized to proceed. 2nd by 0. Shervheim and a final vote of 5-0 in favor. C. Abercrombie resented the following resolutions and asked for their adoption: 1. R 71-2A Parallel parking on County 19.; 2. R 71-2B Approval of Rd Plans submitted by County: 3. R 71-20 Village County agreement for Federal Funds useage on proposed county rd. Second by C. Shervheim and an unanimous favorable vote of the Council Minutes of the hake Elmo Village Council October 5, 1971 page 3. Minutes of the September 21 meeting were approved after changing page 3 to strike the mention of Resolution R-71-18 as this had been acted on and approved at the September 7, 1971 meeting. Bids were received from 13CA @ $lp296.80, OF @ $1.9247.00 and Motorola 0 $1,526.50 for new radio equipment for the fire department. Mire Chief recommended we accept lowest bid. Motion by C. Abercrombie 2nd by C. Shervheim that award be given to OE. Carried 5-0, Fire Chief authorized to place order for the equipment. Motion by C. Shervheim 2nd by 0. Abercrombie to pay the bills. Motion Carried 5-0. Motion by C. Abercrombie 2nd by C. Watson that Mr.. Oelbke be subcontracted to plow snow in parts of Lake Elmo. Rate per hour is $615. Carried 5-0. October 16, 1971.and October 30, 1971 have been designated as clean up days. Trucks will be available at the fire hall from 9:00 AM to noon on these two days to take away any waste materials including leaves but excluding tires. Clerk advised that word from the Census Bureau. was that a census may in itself be useless unless we have word from the state that they will accept and use figures resulting from the census for the purpose of distributing shared taxes. This includes cigarette, liquor & gasoline. Counsel Raleigh was to get determination of acceptance of a census and a determination to proceed or hold up would'be based on that decision.
