Woodworth of 3515 Hidden Bay Road would like help with parking at his residence for an "Open House" he will be hosting on Sunday, December 19, 1971. Willard Eder has requested copies of a condensed "Snowmobile Ordinance" for posting in Twin Point Tavern and Ben's 'lnn, for informing people outside of our Village. COUNCIL MEMBERS SOCIAL HOUR: Mayor Brockman to serve hot chocolate. Minutes of the Hearing For the Installation of a '70' Antennae for Use By The Fake Elmo Fire Depatment Base Station. The hearing was opened at 7:00PM on Tuesday December 711971 at the Lake Elmo Village Hall, by Mayor Brookman. Clerk read the notice that was sent to the following landowners having holdings within 250 feet of the property on which the antennae was to be installed. E.H.Leitte Eugene Seidow State Bank of Lake Elmo G.A.Meyer Mercantile Co.. Gorman Barbershop Mrs. Joseph Ervin Mrs.Luella Haseikey Miss Dena Twetten Mr.Ed.gar Menard Wash.Cty Repub. Committee Mr.Ben Gorka Hagberg's Grocery Store Marvin Turner Stillbay Inc. M.M.Williams A post office receipt covering each account listed has been received which verifies delivery of the required notice. Clerk advised that the only acknowledgement received was from Mr. E.H. Leitte in which he .heartily approved the action requested by the fire department. Mayor Brookman three times asked if anyone else wished to be heard for or against the requestt Three times the request met with no respnse. Mayor Brookman adjourned the hearing at 7:10P1VI. Minutes of the Council Meeting December 7, 1971 Mayor Brookman called the meeting to order at 7:15PM. Present:Brookman,Friedrich,Wa-tson,Abercroinbie,Shervhe im,Park & Mehsikomer. Also present:Counsel Raleigh &Engineer Bonestroo. Motion by Councilman Abercrombie 2nd by C.Shervheim that the SPECIAL USE REQUEST for a 70' antennae by the Lake Elmo Fire Depatment to be used in conjunction with the high band receiving: and sending station be approved; and since it was a Village requirement and benefit that the special use permit charges be waived. Motion carried 5-0. Motion by C.Abercrombie 2nd by C.Shervheim that the minutes of the Nov. 16,1971 meeting be approved as submitted. Motion carried 5-0. Notice from the City of St. Paul was received relative to a storm sewer which will. be necessary in the Battle Creek area which would convey water from a nur4ber of surrounding communities in the area. A meeting is scheduled for December 13, 1971 at 2:OOPM for discussion on the pos- sible implementation of this project under a joint powers act. Engineer Bonestroo was instructed 'to attend and C.Abercrombie advised that he would attend if he could get away. C.Abercrombie presented Resolution R 71-24 relative to theIlwy 36 Inter change and asked for its approval.. Second by C.Friedrioh Carried 5-0. Motion by C.Watson 2nd by C.Abercrombie to reduce the bond required by Mr. Panasow from $$1,500 to $500. Carried 5-0. Motion by C. Watson 2nd by C.Abercrombie requesting the engineer to make a preliminary report for a road in section 32 from 194 to Minnehaha. Motion carried 5-0. Minutes of the Fake 21mo Village Oouncii-4�24 1971 cont'd pg.2 Mr.. & Mrs. Drank Hoffman appeared regarding their request for a hardship variance to permit the building of a house on a lot owned by them. The subject lot has only a 100' frontage instead of the required 125. Council man Shervheim moved that the requested variance be denied in accordance with the recommendation of the planning commission for the reason set forth in the planning commission's report and on the grounds that: (1) The Hoffmans purchased the lot while knowing thata building xmx±kxpxxi±2xlar_ ZN.%XXXX4RXXXIXK permit could not be issued for a lot of that size, and (2) Because building on the particular lot in question would be unreasonable and would adversely affect the existing or potential useof adjacent land because the Land. in question carries g substantial amounts of surface water from time to time, and construction thereon prior to the installation of storm sewer would. in all lilglihood cause damage to the structure built thereon and flooding in adjacent areas. The motion was 2nd'd by C.Watson after extensive discussion and consideration of the evidence presented by Hoffmans on earlier appearances as well as other evidence brought be- fore the cauncil, a vote was taken end -the motion carried unanimously. Mrs.Ray Schneider appeared before the Council relative to damage to her automobile caused by windrows of dirt & rock caused as part of the grading operation. Motion by C.Watson 2nd by C.Aberorombie that clerk determine if this is covered by insurance and if not authorized, payment of the bill_ by the Village. Carried 5-0. Clerk instructed to advise the news media to publish an article that the Village has an ordinance covering parking on Village streets and that during the snow season ears will be ticketed and possibly hauled away. Clerk to arrange for a meeting between Ben GorkatNorm Schwattz, Mayor Brockman and C.Shervheim for Thursday December 9 at 11:45AM at the Village Office to discuss the snowmobile problem after hours. Copies of the ord- inance to be made available for posting at both establishments. Mr. Frederick Zwar,, agent for Mrs. E.Sanft, appeared regarding the request of Mrs. Sanft for variance from the requirements of the zoning and subdiv- ision ordinances to permit division of Mrs. Sanft's property into two residential lots in excess of five acres each. The property in question is in the NWT of the SWt of section 14, to the North of Meadowlark Lane. Mr. & Mrs. Hubert Rhode,Jr., prospective purchasers of the property also appeared. I?io by C.Abercrombie that the variance be pranted subject to the con- 0 s listed below, as recommended by the Planning Commission for the reasons stated in the Planning Commission's report on the grounds that: 1:.The subdivision is of small size and minot .importance and situated in a locality where conditions are well defined because off the residential structures built to -the South & East of the property in question:. 2.Because of the physical conditions of the property, strict compliance with these regulations would cause an exceptional & undue hardship on the owner, while granting of the variance does not in any way have a detriment- aleffect on the public welfare. The variance will. not impair -the intent and purpose of the subdivision ordinance, for future subdivision can be carried out in strict conformity with the existing codes provided the following conditions are met. The conditions of the variances are: DEC. :" Minutes of the hake :Elmo Village Council Meeting X=:� 1971 pg.3 1.Prior to issuance of a building permit the owners of the subject property shall grant to the Village of Lake Elmo by easement, or dedication with right of reversion, a 33' tract of land for road and utilities which tract would be the Westerly 33' of the subject land. 2.Defore a building permit will be issued a survey is to be filed with the Village Clerk dividing the property into the new lots required. 3.The building permit shall be only for a house located on the Westerly lot approximately 150' South of the North line and approximately 50' West of the East line. Second to motion by C.Shervheim after discussion and consideration of the evidence presented by Mr. Z'war and Mr. Rohde, as well as evidence submitted at earlier hearings, and upon a vote being taken,the Council voted. xnxnzmxffi unanimously to grant the variance subject to the conditions listed above. The resolution regarding the Hwy 94 corridor to be scheduled for the Council meeting on January q, 1972. Copy of res. to engineer. Berschens be exempt from any cost. Carried 5-0. Motion by C.. Abercrombie 2nd by C.Watson that Clerk be ordered.& authorized to pay the bills. Carried 5-0. Motion by C.Shervheim 2nd by C.Watson that the meeting adjourn at 11:35PM. Motion carried 5-0.
