RESOLUTION OF VILLAGE OF LAKE ELMO
WHEREAS, The Council of the Village of Lake Elmo has approved
entering into a contract for police protection in the village with the Sheriff
of Washington County, and consistent therewith desires to rescind any previous
delegation of police responsibilities to the constables or any other
individuals heretofore made, and to provide for the orderly discontinuance
of the office of Constable, it is therefore
RESOLVED, that the duties of Constable of the Village of Lake
Elmo shall, until further action by this Council, be limited to those duties
set forth and described for such office in the publications of the Minnesota
League of Municipalities and shall not include any police or law enforcement
responsibilities; and
RESOLVED FURTHER, that any delegation previously made by
this Council or its predecessor governing bodies of any police power or
responsibility to any office or individual other than that contemplated under
the contract approved January 5, 1971 with the Sheriff of Washington County,
be and they hereby are rescinded, and the individuals affected are hereby
requested to restore to the custody of the Village Clerk or the Village Fire
Chief any and all flashers, sirens, or other equipment previously entrusted
to them to facilitate law enforcement activities; and
RESOLVED FURTHER, that the Fire Chief be and he hereby is
authorized to appoint such individual or individuals as he in his discretion
may choose and to provide them with flashers and such other equipment as
may be necessary to facilitate the control of traffic during fire calls
and other emergencies; and
RESOLVED FURTHER, that the office of Constable of this village
be abolished effective at the expiration of the terms of the incumbent
constables, and that the Village Attorney be directed to draw an ordinance
therefore for presentation to the Village Council at the next regular
meeting.

RESOLUTION
VILIAGE OF LAKE ELMO, MINNESOTA
A RESOLUTION AUTHORIZING SPECIAL USE; PERMIT FOR 3M CLUB OF ST. PAUL, INC, SHOOTING
RANGE
WHEREAS, the 3M Club of St. Paul, Inc. has made application for a special use
permit to operate a trap and shooting range for members and guests of said Club; and
WHEREAS, a public hearing with respect to said application was duly held by the
Village Planning Commission and said Commission has recommended the issuance of a
Special Use Permit under certain conditions and restrictions; and
WHEREAS, the Village Council has considered and discussed this application at
length and has reviewed all of the information submitted to the Planning Commission and
the Council,
NOW, THEREFORE, BE IT RESOLVED, that the Village Council of the Village of Lake
Elmo does, hereby, determine:
(1) The issuance of a special use permit in the form annexed hereto and bearing
the conditions and restrictions set forth therein will not be detrimental
to the health, safety,morals or general welfare of the community; and
(2) The issuance of such a permit will not cause any = ' raffic congestion
or other hazard; and
(3) The issuance of such a permit, particularly in view of the conditions
set forth therein, will not depreciate surrounding property
values; and
(4) The use permitted by such permit is in harmony with the general purpose
and intent of the Village Zoning Ordinance and the comprehensive plan.
BE. IT FURTHER RESOLVED, that the Village Clerk, is, accordingly, authorized
to issue a Special Use Permit in the form annexed hereto to the 3M Club of St. Paul,
Inc. upon payment of the necessary fees, if any, provided.by Ordinance, and upon
annexing to said Permit Exhibits "A" and "B" referred to therein.

WASHINGTON COUNTY
MINNESOTA
A RESOLUTION RELATING TO THE APPLICATION OF LOT SIZE REQUIREMENTS TO LOTS IN
THE PROPOSED PLAT OF CARLSON'S MEADOW FIRST SUBDIVISION.
WHEREAS, Walter M. Pechan and Gerald D. Hartman and others have proposed to
plat certain lands in the Village of Lake Elmo as CARLSON'S MEADOW FIRST SUBDIVISION;
and,
WHEREAS, in order to conform to the comprehensive development plan of the
Village of Lake Elmo, comply with Village Ordinances and insure adequate access to
the proposed subdivision, the proposers thereof have agreed to grant an easement to
the Village of Lake Elmo as follows:
The Village of Lake Elmo is hereby granted an easement for road
purposes over and across all of Lot One (1), Block One (1) and the
Westerly Twenty (20) feet of Lot Two (2) and Lot Three (3), Block
One (1) of Carlson°s Meadow First Subdivision so that said Village
may construct a road thereon at such time as the Village Council
determines such road to be necessary.
WHEREAS, the Village of Lake Elmo has established a minimum lot size of One (1)
acre for all residential lots within the Village which are not served by both sewer
and water; and,
WHEREAS, the Village Council of the Village of Lake Elmo has determined that the
purpose of said minimum lot size requirements will be served in this instance even
though the proposers of the subject plat include the Westerly twenty (20) feet of
Lots Two (2) and Three (3) Block One (1) as part of the land necessary to satisfy
the minimum requirements of the Village as to lot size:
BE IT THEREFORE RESOLVED that if the proposed plat of CARLSON'S MEADOW FIRST
SUBDIVISION is approved and the above described easement granted to the Village of
Lake Elmo then the proposers of said plat or the owners of the lands therein, as
the case may be, may include the Westerly Twenty (20) feet of Lots Two (2) and Three
(3) of Block One (1) in their calculations for the purpose of determining whether or
not a particular lot satisfies the present one (1) acre minimum size requirement.

WHEREAS, certain real estate subject to assessments for improve-
ments under the W.O.N.E. sewer district project has become property of
the State of Minnesota and is being held by the Highway Commissioner
of said state for highway purposes:
IT IS HEREBY RESOLVED that said real estate, as described in the
Washington County Auditor's tax plates numbers 24336-C and 24336-Lo,te,
and the same hereby is, deleted from the said assessment rolls.

WHEREAS, it appears to the Village Council that certain special
assessments for street improvements were erroneously levied against
property owned by Kenneth Isaacson:
IT IS HEREBY RESOLVED, that the said real estate, as described in
Washington County Auditor's tax plate Nos. 25516 through 25524,(the
same being Lots-78 through 86, inclusive, of. Lane's DeMontreville
Country Club Addition) be,and the same hereby is, deleted from the
assessment rolls.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FEES FOR THE PROCESSING OF APPLICATIONS
FOR OPEN BURNING PERMITS
WHEREAS, open burning is prohibited in the Village of Lake Elmo by the
regulations of the Minnesota Pollution Control Agency; and
WHEREAS, in certain instances special permits may be granted for open
burning in accordance with the exceptions provided by said regulations; and
WHEREAS, applications for special burning permits must be processed
by the Village Fire Chief under the procedures established by the Minnesota
Pollution Control Agency; and
WHEREAS, processing of said applications involves certain expenses to
the Village:
IT IS HEREBY RESOLVED THAT, a fee be established for the purpose of
defraying expenses incurred by the Village in the processing of said ap-
plications, and that each applicant for a special burning permit, accord-
ingly, be charged an application fee of $5.00 to be paid at the time of
the filing of the application.

WHEREAS, It appears to the Village Council that certain special
assessments for improvements relating to municipal water service were
levied against property which is now owned by the Village; and
WHEREAS, the billing of local assessments and handling of the

Whereas the assessment year of 1971 is not a real estate property year;
Whereas there does exist certain assessment that are inequitable in
certain plotted areas of the Village of Lake Elmo, Washington
County, Minnesota;
Whereas it is desirous to obtain equalization of valuations in these
plotted areas of the Village of Lake Elmo;
Therefore
Be It Thereby Resolved That: The Village Council of Lake Elmo directs
its assessor to make certain corrections in 1971 assessment
of Land Values only in those plotted areas that are improperly
appraised at the present time.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ADOPTING A COMPREHENSIVE
PLAN FOR THE COLLECTION, TREATMENT, AND
DISPOSAL OF SEWAGE:
WHEREAS, Section 473C.06, Subdivision 3, of the Minne-
sota Statutes requires that the Village of Lake Elmo adopt
a comprehensive plan for the collection, treatment, and dispo-
sal of sewage; and
WHEREAS, such plan has been proposed by the Village En-
gineer in a report entitled "Report on Sanitary Sewer System
Development Plan for Lake Elmo, Minnesota - 1971"; and
WHEREAS, said plan has been reviewed by the Village
Council:
BE IT, THEREFORE, RESOLVED by the Village Council that
the plan contained in said report be and hereby is adopted as
the official, comprehensive plan for the collection, treatment,
and disposal of sewage within the Village of Lake Elmo, and
that said plan be submitted forthwith to the Metropolitan
Sewer Service Board.

WHEREAS, A petition has been presented to the Village Council of the
Village of lake Elmo by Ralph J. Oaee and others praying for the vacation.
of a certain portion of a public street in said Village which public street
is more particularly described below; and
WHEREAS, Said petition came before the Village Council for hearing at
a —meeting held at 700 o'clock p.m.' in the Village Hall in the Village of
Lake Elmo on October 6th, 1970, pursuant to notice thereof duly published
and posted as required by law; and
WHEREAS, The Village Council has now determined that the vacation of
the part of said public street hereinafter described is in the interests
of the public and that said petition should be granted;

RESOLUTION REQUESTING THE COMMISSIONER OF HIGHWAYS TO AUTHORIZE ERECTION OF APPROPRIATE
SIGNS DESIGNATING SAFE AND REASONABLE SPEED LIMITS WITHIN THE VILLAGE OF LAKE ELMO.
WHEREAS, the Village Council of the Village of Lake Elmo has determined that the
existing speed limit onthe streets and highways within the Village of Lake Elmo, as
hereinafter designated' are greater or less than is reasonable and safe under existing
circumstances;
BE'IT; THEREFORE, RESOLVED by the said Village Council that the Village of Lake
Elmo in compliance with Subdivision 5 of Section 169.14 of the Highway Traffic
Regulation Act, hereby requests the Commissioner of Highways on the basis of an
engineering and traffic investigation, to authorize erection of appropriate signs
designating a reasonable and safe speed limit on the Village streets described in
Exhibit "A"" annexed hereto and made a part hereof.

RESOLUTION
RESOLUTION EXPRESSING APPROVAL OF PROPOSED RESOLUTION BY THE BOARD OF
COMMISSIONERS OF WASHINGTON COUNTY WITH RESPECT TO A METROPOLITAN PARK
IN THE VILLAGE OF LAKE ELMO.
WHEREAS, the Village Council of the Village of Lake Elmo has
reviewed the proposed resolution of the Washington County Board of
County Commissioners which is annexed hereto as "Exhibit A" and which
generally provides that the County Commissioners will make application
for a grant from the Regional Open Space Funds for the purpose of
acquiring land in Phase I of the proposed Lake Elmo Metropolitan Park;
and
WHEREAS, the Village Council of the Village of Lake Elmo wishes
to make its position known to the Board of County Commissioners with
respect to the proposed resolution:
BE IT, THEREFORE, RESOLVED, That the Village Council
of the Village of Lake Elmo, hereby, expressed to the
Board of Commissioners, Washington County, the said
Council's approval of the resolution annexed hereto
as "Exhibit A" and, further, that said Village Council
does hereby urge the said County Commissioners to adopt

A RESOLUTION APPROVING AND URGING PASSAGE
OF A BILL FOR AN ACT GRANTING THE DISTRICT
COURT JURISDICTION TO ADJUST THE BOUNDARY
BETWEEN THE -VILLAGES OF LAKE ELMO AND OAK -
DALE : .1
WHEREAS, the present boundary line between the Village
of Lake Elmo and the Village of Oakdale divides certain pro-
perties and residences located in Sections 5 and S of Township
29 North, Range 21 West; and
WHEREAS, the division of said properties between muni-
cipalities appears to constitute a serious inconvenience to
the owners thereof and, in all probability, diminishes the
value of their property; and,
WHEREAS, there appears,to be some doubt as to whether
the governing bodies of the said villages will be able to con-
cur in and effectuate an appropriate adjustment of their mutu-
al boundary in said sections.,..and
WHEREAS, the Village Council of the Village of Lake
boundary line eliminated and at the same time have the boun-
dary line permanently fixed sometime within the not too dis-
tant future:
BE IT, THEREFORE, RESOLVED by the Village Council of the
Village of Lake Elmo that said Council recommend and urge the
passage of a Bill granting the District Court jurisdiction to
adjust the boundary within said Sections 5 and 8 of Township
29 North, Range 21 West, and that the Bill designated as
House File No. 3129 during the 1971 Legislative Session be
passed in substantially its present form provided however that
said Bill shall include provisions requiring all property owners
within said sections be given notice of any District Court pro-
ceedings and have an opportunity to be heard therein, and, also,
placing a reasonable limit on the time during which a petition
for adjustment of said boundary may be filed with the District
Court.

WHEREAS, Bernard Witzmann of 3710 Lane Boulevard is

CONTINUED SUPPORT FOR A METROPOLITAN PARK IN
THE VILLAGE OF LAKE ELMO
WHEREAS, the Village Council of the Village of Lake
Elmo on December. 1, 1970 passed a resolution favoring the ac-
quisition of land in the Village of Lake Elmo for a Metropoli-
tan Park and approving, generally, a method of operation for
the acquisition of the land designated as Phase I; and
WHEREAS, the Board of Commissioners of Washington
County has passed a resolution approving said method of oper-
ation for acquiring the Phase I land and has, pursuant there-
to, obtained appraisals of said land; and
WHEREAS, the Village Council is of the opinion that
the land for said Park should be acquired at the earliest pos-
sible time so that it may be secured before it becomes the sub-
je_et�_o_r___urban de-valapment a.n_d_is_,—therehy-, 1 forever for
park purposes:
BE IT, THEREFORE, RESOLVED that the Village Council
of the Village of Lake Elmo does, hereby express to the Board
of Commissioners of Washington County the said Council's con-
tinued approval of the method heretofore established for ac-

FOR PUBLIC HEARING ON SANITARY SEWER AND STORM SEWER
IMPROVEMENTS OF 1971
WHEREAS:
A. The Village Council deems it necessary and expedient that the
Village of Lake Elmo, Minnesota, construct certain sanitary sewer and storm
sewer improvements in the Village as described in and in accordance with the
preliminary plans and report prepared by Bonestroo, Rosene, Anderuk & Associates,
Inc., consulting engineers;
B. The Council has been advised by the consulting engineers that said
Sanitary Sewer and Storm Sewer Improvements of 1971 are feasible and should best
be made as proposed, and the consulting engineers' report to this effect has hereto-
fore been received by the Council, and filed with the Village Clerk;
C. The statute provides that no such improvements shall be made until
the Council shall have held a public hearing on such improvements following mailed
notice and two publications thereof in the official newspaper stating time and
place of the hearing, the general nature of the improvements, the estimated costs

NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Lake Elmo, Minnesota, as follows:
1. A public hearing will be held at the time and place set forth in
the Notice of Hearing hereto attached to consider said proposed improvements.
2. The nature of the improvements, the estimated cost of each major
portion thereof, and thee area proposed to be assessed therefor are described in
the form of Notice of Hearing hereto attached.
3. The notice of said public hearing shall be in substantially the
form contained in the notice hereto attached.
4. The Village Clerk is hereby authorized and directed to cause notice
of said hearing to be given two publications in the official newspaper. Said
publications shall be one week apart, and at least three days shall elapse
between the last publication and the hearing. Not less than ten days before
the hearing the Clerk shall mail notice of the hearing to the owner of each parcel
of land within the area proposed to be assessed as described in the notice.
For the purpose of giving such mailed notice, owners shall be those shown to
be such on the records of the County Auditor or, if the tax statements in the
County are mailed by the County Treasurer, on the records of the County Treasurer#

C. The Statute provides that no such improvements shall be made until
the Council has held a public hearing on such improvements following mailed notice
and two publications thereof in the official newspaper stating time—and—placethe— o the hearing, the general nature of the improvement, the estimated cost thereof,
and the area proposed to be assessed in accordance with law;
NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Lake Elmo, Minnesota, as follows:
1. A public hearing will be held at the time and place set forth in
the Notice of Hearing hereto attached to consider said proposed improvements.
2. The nature of the improvements, the estimated cost of each major
portion thereof, and the area proposed to be assessed therefor are described in
the form of Notice of Hearing hereto attached.
3. The notice of said public hearing shall be in substantially the
form contained in the notice hereto attached.
4. The Village Clerk is hereby authorized and directed to cause notice
of said hearing to be given as required by law.

IMPROVI' MENT
THIS AGREEHUNT made by the Village of Lake Elmo, Minnesota,
hereinafter called the "Municipality" with the County of Washington,
hereinafter called the "County", WITNESSETH:
WIER'EAS, the United States Government, through the Federal
highway Administration of the U.S. Department of Transportation does
apportion Federal funds for the eonstruetion,.reconstruction and
improvement of highway projects on approved systems of public roads,
and
WHRRM14SO said Federal Aid Highways within the limits of a
Municipality are now or may be eligible for the participation of these
Federal funds in their improvement or construction, and
WHEREAS, the Federal Highway Administration as a condition
to the use of Federal funds on approved Federal Aid Projects requires
the agreement of the Municipality to control road sins. traffic eont:
devices, advertising signs, miscellaneous installations, speed and parking,
NOW, THMMORE, The Municipality in consideration of the expendi-
ture and use of Federal funds for the construction, reconstruction, or
improvement of any Federal Aid Highway within the limits of the Municipality
agrees with the County as follows:
(1) No signs, traffic control devices or other protective devices
shall be erected on any Federal -Aid Secondary project within the Municipality
limits except as shall conform with the current Manual on Uniform Traffic
Control Devices for Streets and Highways of the State of Minnesota.
(2) All right of way within the limits of the Municipality on any
Federal -Aid Secondary project shall be held and maintained inviolate as a
public highway and no posters, billboards, roadside stands, curb pumps,
curb service devices or other private installations and no signs, other
than traffic control or protective devices shall be permitted within the
right of way limits of the projects. The Mmicipality will with respect
to such items are within its jurisdiction which may be or cause an obstruc-
tion or interfere with the free flow of traffic or which may be or cause a
hazard to traffic or which may vitiate or impair the usefulness of the pro-
ject and which may be required to be removed by the County at its own
election or at the request of the Federal Highway Administrator remove or
cause removal of the same.
(3) The speed limits on any Federal -Aid Secondary project shall
be not less than 30 miles per hour.
(4) Parking regulations generally recommended by the Commissioner
of Highways and the Federal Highway Administrator for use under similar
conditions shall be adopted on any Federal -Aid Secondary project.

mitted its Comprehensive Sewer Plan to the Metropolitan Sewer
Board, as required by law, and requested approval thereof by said
Board; and
WHEREAS, said Comprehensive Sewer Plan included an
alternate plan for temporary sewer service to certain western
portions of the Village of Lake Elmo, including the so-called
"Tri-Lakes Area" by means of a temporary connection to the
interceptor sewer of the former W.O.N.E. Sewer District; and
WHEREAS, the Village Council of the Village of Lake
Elmo has determined that the recreational and residential
qualities of said "Tri-Lakes Area" are endangered by the present
discharge and seepage of organic wastes into lakes Olson, DeMontre-
ville and Jane; and
WHEREAS, the Village Council has further determined
that only the prompt installation of sanitary sewer can prevent
serious damage to the recreational and residential qualities of

Elmo has latcrmined that the recreational and resi6ential quali-
-ties oj saiQ "Tri-Lakes" and "old Village" areas may be damaged by
the potential discharge and seepage of organic wastes into lakes
Olson, DeLantzeville, Jane, and Elmo; and
the village Council has further determined that
the installation of sanitary sewer would tend to prevent the dis-
charge or scej-
,ac,,e oC such organic wastes into said lakes:
hereby requc,,sts the Metropolitan Sewer Board approve the Compre-
hensive Sewer Plan of the Village of Lake Elmo and authorize said
Village to proceed, at such time as the Village may determine it
is necessary and desirable to do so, with the installation of a
temporary connection to the interceptor sewer of the former W.O.N.E.
Sewer District in accordance with the said alternate plan.
