R- 72-1 RESOLUTION VILLAGE OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTIOW REQUESTING APPROVAL OF COMPREHENSIVE SEWER PLAN AND AUTHORIZING INSTALLATION OF TEMPORARY SERVICE WHEREAS, the Village of Lake Elmo has heretofore sub- mitted its Comprehensive Sewer Plan to the Metropolitan Sewer Board, as required by law, and requested approval thereof by said Board; and WHEREAS, said Comprehensive Sewer Plan included an alternate plan for temporary sewer service to certain western portions of the Village of Lake Elmo, including the so-called "Tri-Lakes" and "Old Village" areas by means of a temporary connec- tion to the interceptor sewer of the former W.O.N.E. Sewer District; and WHEREAS, the Village Council of the Village of Lake Elmo has determined that the recreational and residential quali- ties of said "Tri-Lakes" and "Old Village" areas may be damaged by the potential discharge and seepage of organic wastes into lakes Olson, Detlontreville, Jane, and Elmo; and FdiEREAS, the Village Council has further determined that the installation of sanitary sewer would tend to prevent the dis- charge or seepage of such organic wastes into said lakes: NOW, THEREFORE, BE IT RESOLVED, that the Village Council hereby requests the Metropolitan Sewer Board approve the Compre- hensive Sewer Plan of the Village of Lake Elmo and authorize said Village to proceed, at such time as the Village may determine it is necessary and desirable to do so, with the installation of a temporary connection to the interceptor sewer of the former W.O.N.E. Minnesota Laws 1969, Chapter 449, Section 5, Sub- division 3, terminated the existence of the Northdale, East Oak- dale, Oakdale and Woodbury Joint Sanitary Sewer Board (hereinafter called W.O.N.E.) as of January 1, 1971, and vested in the Board ownership of all assets and property owned by W.O.N.E. The Village of Lake Elmo, as a member of W.O.N.E. had an undivided ownership interest in such assets and property and also holds legal title to the sanitary sewers described in Exhibit "A", and permits, licenses, easements and other property rights necessary for the location, operation and repair of such sanitary sewer, for and on behalf of W.O.N.E. and its member municipalities. The Mayor and Clerk are hereby authorized and directed to trans- fer to the Metropolitan Sewer Board all right, title and in- terest of,the Village of Lake Elmo in and to the assets and property held by W.O.N.E. in its own name as of December 31, 1970, to the sanitary sewers described in the Agreement attached hereto and to all permits, licenses, easements and other property rights necessary for the location, operation and -repair of such sanitary sewers or any sanitary sewers contracted to be built by W.O.N.E. 2. The Mayor and Clerk are also authorized and directed to enter into a contract substantially the same as the one attached hereto fixing the amount owed by the Metropolitan Sewer Board to the Village for debt service on bonds issued by it and the other member municipalities of W.O.N.E. for acquisition of facilities taken over by the Board. Sewer Board's Obligation. The Board is obligated to use such grant funds to pay -costs of acquisition of the Inter- ceptors. Such costs have been paid by the Municipalities and the Board will therefore reimburse the' Municipalities .for tr,ese costs up to the amount of the grant funds received. Section 3. Following are the Council's comments and objections with respect to those regulations: 1. It appears from Section I, Subd. 3, of the proposed regulations that the Managers of the Watershed District are con- cerned with all construction or related operations within the flood plains of lakes and streams. Specifically, they intend to approve permits for any construction operations, including such matters as grading and filling (see Section IV, Subd. 1 and Section V, Subd. 1 of the regulations). The "flood plain" as described in Section II, Subd. 5 of the regulations is that area along the channel and waterways, including the area around lakes, marshes, and lowlands, which would become inundated as the result of a flood occurring on the average of onceevery 100 years. It is, therefore, important, if the village is to help enforce these regulations, to acquire a map from the Watershed District showing what they believe to be the boundaries of a flood plain within the meaning of that definition. 2. Section III, Subds. 1 and 2 of the regulations appear to require municipal clerks to furnish the Watershed District Managers with a copy of any preliminary plan or proposed plat. Similarly, Section IV, Subd. 1 would require the Village Clerk to provide the Board of Managers with applications for construction permits relating to sites within the flood plain. The Council feels that these subdivisions are objectionable in that any requirement for submitting preliminary plans or proposed plats to the Watershed District for its approval should be placed on the individual, not on the Village Clerk. The Council wants to cooperate as much as possible with the Watershed District and would have no objection to providing the Managers with copies of any plans or proposed plats filed with the Village, however, the Watershed District regulation should place the responsibility for submitting plans or plats for its approval on the individual pro- posing the plat. The Council is also concerned about Section IV, Subd. 1 dealing with application for construction permits. It feels that the Village Clerk should not become involved in conveying applications for construction permits between the applicant and the Managers of the Watershed District and that the proper procedure would be for the individuals seeking construction permits to get separate permits from the Village and the Watershed District. The Village could cooperate and assist the Watershed District by requiring a building permit from the Watershed District as a pre -requisite to the issuance of a building permit by the Village where the building site is located within the flood plain (provided, of course, that the Watershed District provides the Village with an adequate map designating the limits of the flood plain). In summary, it is the Council's concern that the Village avoid being placed in a position where it serves as intermediary between an applicant and the Managers of the Watershed District, at best it will create extra work for the Village staff and, more likely than not, it will place the Village Council in a position of having to defend any action taken by, or any failure to act on the part of the Watershed District. 3. Section V, Subd. 1 requires a permit be obtained from the Watershed District for any ditching, grading, filling, etc. which would result in removal of top soil or vegetation from one acre or more, or which would "increase, concentrate, or dispose of runoff ... which might cause or increase erosion". It seems that this requirement would apply to any land within the Village, and such being the case, the language seems a little broad. 4. Section VI, Subds. 1 and 2 require the Village to submit copies of proposed ordinances relating to flood plain zoning, surface waters drainage and shore use be submitted to the Watershed District before publication; this is a reasonable expectation on the part of the Watershed District and the Council wants to follow such a procedure whether or not it is in the regulation. B ookman, Mayor ATTEST: OIL' Donald Donald Mehsikomer, Clerk . w IviENIORANDUM In view of the fact that the Minnesota Municipal Commission is considering the proposed annexation of all of the property within the Town of Baytown to abutting municipalities, the Village Council has determined that it is in the best interests of the Village of Lake Elmo, and that it appears that it is in the best interests of all concerned, that the following described part of Baytown Township be annexed to the Village of Lake Elmo: Sections 6, 7 and 18 and the West One Half (W2) of Section 17, Township 29 North, Range 20 West. This land is adjacent to and abuts the easterly boundary of the Village of Lake Elmo. It includes the Lake Elmo Airport, the Washington County Fair Grounds, a church and several residential dwellings. Most of the land, with the exception of the Airport and the County Fair Grounds is used for agriculture purposes. One of the major reasons the Village of Lake Elmo is interested in annexing this land is the effect on the Village of Lake Elmo of the activities relating to the Lake Elmo Airport and the Fair Grounds. These public uses generate a considerable amount of traffic and present special problems relating to the safety and welfare of nearby residents. It is possible that either or both of these public facilities will be expanded in the future and, thereby, have a greater impact on the residents of the Village of Lake Elmo. As a review of the maps will indicate, the two largest population centers near the Airport and the Fair Grounds are in the Village of Lake Elmo. They are the so-called EXHIBIT "A" "old village" area and the Cimarron Development. The Lake Elmo Village Council is of the opinion that any development in connection with or adjacent to the Lake Elmo Airport can have a serious effect on these population centers; that the development in the Airport area may be of either complementary or detrimental to these population centers but, in any case, the Village Council feels that it is important that the Village of Lake Elmo have the planning and regulatory responsibility for most of these areas. As long as the Town of Baytown remains unincorporated the zoning and land use in the Township is to some extent regulated by Washington County. The Village of Lake Elmo through its representation in county government is able to -- participate in the regulation of land use within the Airport area. if, however, any Village is to assume the role of planning authority for this land, then it is the position of the Village Council that it should be the Village of Lake Elmo. Another major factor in the Council's determination that the above -described land should be included in the Village of Lake Elmo, relates to the development which can be anticipated within the vicinity of the Airport and along State Highway 212. It seems apparent that development can be anticipated at an early date in the northernmost of these sections (Section 6) which includes the southern portion of the Highway 36 and Highway 212 interchange; the Village Council has been informed of proposed Lei -2- h elr developments in that area. While the Village Council is not aware of any particular proposed development for the Airport area it does seem reasonable to anticipate developments related to Airport use. In either case it seems these areas could best be served by the Village of Lake Elmo. For example, if sewer or water service were to be supplied to the Airport area from either the Village of Oak Park Heights or the Village of Bayport, it would be necessary to extend sewer mains and related facilities across several miles of undeveloped land in what is now Baytown 9 Township. On the other hand, the old Village of Lake Elmo, now served by municipal water services and having completed a plan for sewer service (subject to approval of the Metropolitan Sewer Board) lies within a mile of the Airport. Finally, there is a factor of community identity. While it is difficult to demonstrate such matters it appears to the Village Council of the Village of Lake Elmo that the residents of the three sections in question as well as those people residing in the neighboring areas have tended to identify with the Village of Lake Elmo and share a community of interest with its residents. Calvin J. grookman, Mayor Attest; .mil o»�' CL& r C�: � - Donald Me sh ikQQmer, Clerk R-72-27 RESOLUTION V I LIAGE OF LAiZEE'LMO WASHINGTON COUNTY, MINNESOTA RESOLUTION GRANTING VARIANCE FROM THE PROVISIONS OF THE VILIAGE SUBDIVISION ORDINANCE WHEREAS, Agnes Berschens and John Berschens own certain real estate in the Village of Lake Elmo, which said real estate is located in Government Lot No. 4, Section 10, and is more specifically described in the Certificates of Survey an- nexed hereto and made a part hereof as Exhibits "A" and "B"; and WHEREAS, said owners wish to divide the said real estate into two lots for use as single family residential building sites; and WHEREAS, said owners have requested that the Village Council grant a vari- ance from the provisions of the Village Subdivision Code which requires the plat- ting of all such subdivisions; and WHEREAS, the Village Council, having considered the Certificate of Survey submitted by said owners and ahe report of the Village Engineer dated October 15, 1971, has determined that the proposed subdivision is of small size and of minor importance, and situated in a locality where the conditions are well de- fined, and as such, the owners may be granted the requested variance under the provisions of Section 12(C) of the said Subdivision Code: NOW, THEREFORE, BE IT RESOLVED, that said owners are hereby granted a vari- ance from the provisions of the Subdivision Code of the Village of Lake Elmo in that the subdivision of the real estate described in Exhibits "A" and "B" into the two lots described in Exhibit "A" and Exhibit "B" respectively, is hereby approved Without the need to plat the same. PROVIDED, HOWEVER, that the variance herein granted shall be conditioned on the said owners granting to the Village of Lake Elmo an easement for the proposed 66 foot road and the 24 foot drainage channel easement as shown on the said exhibits. BE IT FURTHER RESOLVED, that the variance granted herein is a variance only from the platting requirements of the Subdivision Code, and shall not be construed as a variance from any of the provisions of the Zoning and Building Regulations or other applicable ordinances of the Village of Lake Elmo.
