6. APPOINTMENT TO PARKS COMMISSION AND MAINTENANCE
ADVISORY COMMISSION:
The Parks Commission and the Maintenance Advisory Commission have one vacancy
each. The Council received four applications, two for each commission, and scheduled
interviews for all. Ms. Susan Dunn was out-of-town, and unable to interview. City
Council thanked Ms. Dunn for all of her contributions to Lake Elmo and requested -that
slie be red- or the next vacancy.
M/S/P Smith/Conlin — to appoint John Booher to fill the Parks Commission vacancy.
(Motion passed 3-0)
M/S/P Smith/Conlin — to appoint Steve Gurney to the Maintenance Advisory
Commission (MAC), and Steve Ziertman as an Alternate. (Motion passed 3-0)
The City Council directed Staff to verify that City Ordinance allows appointment of an
Alternate, or have the Ordinance amended to reflect such change.

8. CITY ENGINEER'S REPORT:
A. Resolution No. 2006-105: Adopt Assessments for the Phase IV Water
Interconnect Protect Response to the two objecting Property Owners
The City Engineer reported that he met with the two objecting property owners, Dr.
Ostrander and Donald and Joan Tauer, and discussed the proposed assessments. The
Ostrander assessment continues to be valid and the City Engineer recommended that it
not be modified. In regard to the Tauer properties, the City Engineer reported that he is
recommending the driveway easement parcel not be assessed, but that the pet cemetery
be assessed as proposed since there does not appear to be any restriction as to future use.
He also reported that Mr. Pechan has recently purchased 0.65 acres from the Tauers'.
Because of that, the Tauer assessment would be reduced and the Pechan parcel would be
increased.
City Attorney Filla advised Council that since the Pechan would be increased, it will be
necessary to conduct a new Public Hearing regarding his assessment alone.
M/S/P Smith/Conlin — to deny the objections of Dennis Ostrander and Don Tauer based
on the Findings contained in the TKDA report, to adopt Resolution No. 2006-105,
approving the proposed Assessment for the Water System Interconnect Phase IV project
as recommended by the City Engineer in his letter of October 13, 2006, excluding the
Pechan. A new assessment hearing will be noticed for November 8, 2006, on the Walter
Pechan parcel. (Motion passed 3-0)

B. Resolution No. 2006-109: Award Bids for Plumbing Contract A• and
Resolution No. 2006-110: Award Bids for Plumbing Contract B
The City Engineer reported that the only one bid was received for each contract, and
recommends awarding the bids to Lakes Mechanical Services, Inc. These contracts are
for plumbing services within the homes to disconnect well water and connect city water
to the inside plumbing. He reported that Contract A was for 102 services and Contract B
for 96 services.
City Engineer Prew said that approximately 60 homes have the ser-vices-installed from
e street o e house. He continued that the balance of connections is approximately 2-3
weeks out.
M/S/P Conlin/Smith — to adopt Resolution No. 2006-110, and Resolution No. 2006-111,
awarding the plumbing contract for Contract A and Contract B, to Lakes Mechanical
Services, Inc., for their base bid of $527,410.00 for Contract A and $555,000.00 for
Contract B. (Motion passed 3-0)
C. Authorization for Sanitary Sewer Study for Old Village
City Engineer Prew requested City Council authorization to complete a Sanitary Sewer
Study for the installation of municipal sanitary sewer within the Village Area. He
reported that the Village Planners work had progressed far enough to estimate sanitary
sewer requirements and it was important at this time to take a look at how the sewer
would be constructed and how much it would cost.
M/S/P Conlin/Smith — to approve the authorization for TKDA to provide professional
services for the Old Village Sanitary Sewer Study. (Motion passed 3-0)
D. Resolution No. 2006-111 and Resolution No. 2006-112: Approve Plans for Well
Sealing for Contract A and B
The City Engineer presented plans and specifications for the abandonment and sealing of
all of the wells in the Tablyn Park/Lake Elmo Heights water service project area. He is
recommending ordering advertisement for Bids for the well sealing.

E. Water Service Right —of —Ent — Tablyn Park/Lake Elmo Heights Water Project

City Engineer Prew informed the Council that a number of residents have not executed
the necessary Right of Entry Agreement that will allow the City to construct the service
lines from the street to their homes and seal their wells. The City has made several
written attempts to secure their Right of Entry and he now recommends the City now
consider a Resolution prepared by the City Attorney that would require compliance by

these few residents, and allow the City to seek the assistance of the Court of no
compliance results. He reminded the City Council that the City had adopted an
Ordinance earlier in 2006 that declared all the wells in this project area a hazard and a
public nuisance and requiring these wells to be sealed in the public interest.
Mayor Johnston asked if there was a sense of urgency to pass this abatement action, as
only three Council Members were present.

F. Reduction in Park Meadows
City Engineer Prew requested an Escrow Reduction for Park Meadows from $299,000.00
to $108,750.00, as presented in his Memo dated October 17, 2006.
M/S/P Smith/Conlin — to approve as recommended by the City Engineer in his Memo
dated October 17, 2006, from $299,000.00 to $108,750.00. (Motion passed 3-0)
9. PLANNING, LAND USE & ZONING•
A. Hardy House Move:
The City Planner reported that Ms. Hardy had fenced the site the day following the last
City Council meeting as required, and the footings for the house had been poured the
afternoon of this Council meeting. He presented a draft agreement that had been
prepared by Staff and the City Attorney providing for the completion of the balance of
the work at the Hardy house in various stages through the end of June 2007. He
recommended the Council consider the agreement as a condition of any extension beyond
the current November 1, 2006, expiration of the Hardy permit.
Ms. Hardy advised the Council that she had reviewed the proposed agreement and found
it be acceptable.
Building Official McNamara advised the Council that he has observed numerous
violations of exterior storage ordinances on the property and requested that correction of
these violations be an additional condition of extending the permit.
M/S/P Conlin/Johnston — to direct Staff to extend the date by which Ms. Hardy must
complete the project, on the condition that Ms. Hardy execute the proposed Agreement
and renew the Letter of Credit before October 31, 2006; also, the Agreement be amended
to provide removal of all illegal outside storage on the property by November 1, 2006.
(Motion passed 2-1: Smith — did not support the location of this home to a substandard
parcel a year ago. Deadlines have come and gone, and the job is still not complete. How
many more deadlines is the Council willing to approve?)

11. CITY ADMINISTRATOR'S REPORT:
A. Purchase of Two Ladder Fire Trucks:
The Assistant City Administrator presented the Council with the Fire Chief's request for
consideration of a proposed letter to a vendor regarding the purchase of two used ladder
fire trucks. The letter advises the vendor that the City is continuing to consider the
purchase of 75' and 100' ladder fire trucks at a price of one million dollars, with a
decision expected by November 8, 2006.
Attorney Filla said that he does not object to the proposed letter with certain
binding."
Council Member Smith is concerned with eh fiscal responsibilities to the City.
M/S/P Conlin/Johnson — to sign a "Non -Binding Letter of Intent" to Rosenbauer/General
Safety Equipment, as modified by the City Attorney. (Motion passed 3-0)
12. CITY COUNCIL BUSINESS AND REPORTS:
A. Mayor Johnston reported that he attended a recent meeting at the Metro Council,
along with Administrator Rafferty and the design team. The meeting was attended by
Chair Bell, Regional Administrator Weaver and Environmental Services Moore. At that
meeting the City was advised that the METC would favorably consider relocation of
future dwelling units south of 10`h street to the Village Area. He noted that this would
require an amendment to the City's Comprehensive Plan and the successful completion
of the village Area Plan to the satisfaction of the City Council, and therefore, constitutes
a work -in -progress.
B. Council Member Conlin proposed to the Council that it would be very appropriate
to have a plaque made in memory of Administrator Rafferty.
The Assistant City Administrator stated that the naming of a building is also appropriate,
and that the Parks Commission had recommended renaming Carriage Station Park, to the
Martin Rafferty Memorial Park.

E. Council Member Smith stated that she supported Council Member Conlin's
recommendation of a plaque.

City of Lake Elmo
City Administrator
Position Profile
The City of Lake Elmo, Minnesota is a scenic and unique community on the eastern edge of the
Twin Cities Metropolitan Area. An attractive a chain of lakes, historic commercial corridor,
extensive park system, and a variety of housing characterize this charming community. Among the
City's greatest treasures is two-mile long Lake Elmo, three additional recreational lakes and the Lake
Elmo Regional Park Reserve. The population of Lake Elmo is 8,000 and the city will be able to
accommodate a population of 24,000 by 2030.
The City of Lake Elmo is located a few miles east of St. Paul with access provided via Interstate Hwy
94 and State Hwys 5 and 36. Major employers within the area include 3M Company in Maplewood
and Woodbury, Independent School District 834 in Stillwater, Hartford Companies and Ecowater
Systems, Inc. in Woodbury, and Imation Corporation in Oakdale.
Historic Old Village
In an effort to define future growth patterns, the city has performed a series of planning events. The
resulting plan addresses the development and redevelopment of nearly 1,000 acres in the downtown
and surrounding area. The city has hired master planners to present for approval plans to address
the needs of the city and village area growth. The overall goal of the Old Village Plan is to capitalize
on the character of the existing original buildings in the commercial district in the development of
new housing units, including affordable housing for seniors and disabled, pedestrian and bike trails,
a central park, and public facilities including a new library and city hall. The Plan will address
significant safety and environmental components.
Recreation
Lake Elmo Regional Park is comprised of over 2,000 acres with 20% of the area developed for
camping, swimming, and other recreational activities. Throughout the park are 24 miles of trails
including a fishing trail, five miles of paved bike trails and eight miles of horseback trails. The Park
features a boat launch on Lake Elmo and a canoe launch on Eagle Point Lake. The biggest attraction
is a sand bottom swimming pool that is the largest filtered body of water in the state. A variety of
programs and festivals are held throughout the year. The Park is operated and staffed by
Washington County Parks. In addition, the City of Lake Elmo maintains 15 parks. Many include play
equipment and ball fields. The City has several golf courses and practice facilities.
Huff-N-Puff Days has been held annually in August for over 25 years. The centerpiece of the four -
day community festival is an extensive and popular softball tournament featuring numerous
Minnesota teams. The festival also includes volleyball and golf tournaments, running races, and a
dance. The Lake Elmo Jaycees sponsor the event.
Education
Three school districts serve the Lake Elmo area. The Stillwater Area School District 834 covers the
majority of Lake Elmo with two other school districts serving border neighborhoods. District 834
includes 10 elementary schools, two junior high schools, and one high school. Lake Elmo
Elementary School and Oak -Land junior High School are located within the City of Lake Elmo.
Health Care
Two hospitals serve Lake Elmo residents providing comprehensive health care services: Lakeview
Hospital located in Stillwater and Woodwinds Hospital in Woodbury, which is a collaborative
between HealthEast Care System and Children's Hospital and Clinics. A number of clinics are
located within the City of Lake Elmo including the High Pointe Health Campus that includes a
surgery center.
The Organization
Lake Elmo operates under a Mayor/Council form of government. The Mayor serves a two-year
term and Councilmembers serve four-year staggered terms. The City Councill is assisted by several
advisory boards including the Community Improvement Commission, Parks Commission, Plarmin
Commission, and Environmental Commission.
Organizational Structure

City Services
Fire protection is provided by a paid on -call fire department with 27 firefighters operating from two
stations. Lake Elmo maintains a water distribution system consisting of two wells. A portion of the
city's water is purchased from the City of Oakdale. Ongoing monitoring of water quality assures that
Lake Elmo residents have dean and safe water. Well mapping assures proper placement of future
wells. A small commercial area of Lake Elmo is provided with sewer service by the Metropolitan
Council. Lift stations are maintained by the city. Street and park maintenance is provided through
the city. Refuse hauling and septic pumping is privately contracted. The city contracts with
Washington County fox law enforcement and animal control services.
There are 13 full-time employees at the city. The general fund operating budget is $4 million.
The Position
The City Administrator serves as chief executive and chief operating officer of the city. The City
Administrator manages and directs all daily operational activities of the city and ensures that all
ordinances, resolutions and policies of the City and City Council are faithfully and equitably enfc
Specific duties include:
• Prepare and submit a proposed budget to the City Council for their approvaL Review and
execute financial activities including payroll and monitoring budgetary expenditures.
• Participate in Council meetings and numerous other committee or board meetings and public
hearings. Review and prepare written reports and recommendations for the City Council and
City boards and committees.
• Meet and confer with citizen groups.
• Review and update city policies, procedures, and codes and recommend improvements and
adjustments to the City Council.
• Serve as liaison to other local, state and federal agencies and organizations.
• Conduct human resources functions including job performance evaluations.
• Work cooperatively and negotiate with federal, state, county and other city governments and
organizations to ensure that the health, safety and welfare of Lake Elmo citizens are met.
• Provide strategic direction in the implementation of the City Council approved Comprehensive
Plan.
Background and Experience
Candidates for the City Administrator position will possess a Bachelor's Degree (Master's preferred)
and two to three years experience in an administrative capacity in a local government environment

• Human Resources background to include performance evaluations, staff structuring,

Minnesota Statute 176.001 subd.9, (5) provides that "municipal officers elected or appointed for a regular terns of
office" are considered to be "employees" for workers' compensation purposes only if the city has passed as ordinance
or resolution to that effect. This would provide coverage for elected officials injured while performing his or her
duties.

WHEREAS, the City of Lake Elmo obtains its Worker's Compensation coverage
from the League of Minnesota Cities;
WHEREAS, M.S. 1.76.011, subd. 9, (5) provides "that municipals officers elected

WHEREAS, as part of the renewal process, the City must decide whether or not

Background Information for November 8 , 2006
A new set of trucks lifts were programmed for the new Public Works garage. These were
proposed to be purchased by owner (the city) for $30,000 to $35,000. The Public Works
Department has had a new set of lifts in for a "demo" which has met our criteria. Specifically
they function safely and can lift the City's entire inventory to include the Fire Department.
The Public Works Department recommends the purchase of the new "demo" model, with an
extended warranty and a price reduction off the State contract of $800.00

The city has received a letter of resignation from John Heroff who has served on the Parks Commission
since 1998.

from the Parks Commission, and to direct the assistant administrator to send a letter of gratitude
for his service to the city and its residents.
With the previous action, Judith Blackford, I" Alternate Member of the Parks Commission can step into
the Full Voting Member position vacated by John Heroff.

Attached is a revised draft of the Hardy Site Development Agreement. Jim McNamara has
advised me that the excavation ($3,500.00) and the footings and basement walls
($16,367.00) are constructed. Therefore, the estimated cost of the remaining im rovements
is $30,353.00. The amount of the letter of credit to ensure construction o£ the remaining
improvements should be $37,941.25.
The letter of credit should clearly incorporate the site development agreement atd
indicate that the letter of credit is given to ensure construction of the improv Tents
within the time -lines indicated in the site development agreement. The letter or credit
should not expire until July 30, 2007 unless the City otherwise gives its written consent.
I would like to see a signed copy of the site development agreement and the letter of
credit on or before November 6, 2006, If this cannot be arranged, T am recommending that
the City call the existing letter of credit.

probation for one (1) year and required to complete the improvements within four (4)
weeks.
On September 5, 2006, we advised Mr. Podgorski's attorney that his client had not complied
with the Court's order.
On October 24, 2006, we received a copy of the Mayor's e-mail regarding the status of this
particular matter. On October 27, 2006, we requested that the Court place this matter
back on the calendar for a probation violation hearing. We have not yet been advised of
the hearing date.

RESOLUTION TO ADOPT THE
WASHINGTON COUNTY ALL HAZARD MITIGATION PLAN
WHEREAS, the City of Lake Elmo has participated in a hazard mitigation planning process
established under the Disaster Mitigation Act of 2000; and
WHEREAS, the Act establishes a framework for the development of a county hazard rni

WHEREAS, the Act as part of the planning process requires public involvement and local

WHEREAS, the Washington County Plan includes a risk assessment including past hazards,

Background Information for November 8, 2006:
At your last Council meeting you approved a "Letter of Intent" with Rosenbauer/General Safety (a fire truck
builder) regarding the possible purchase of used ladder trucks, a 100' and a 75'. This letter gave the city until
November 8, 2006, after such time Lake Elmo would no longer have a "hold" on the trucks and they would be
released for sale. This allowed staff the necessary time to fully research this opportunity and prepare this
information for council. Staff has reviewed the CIP, researched financing options, contacted the former
owners and test driven both ladder trucks throughout the city. Due to the inability to schedule a joint
workshop, this information has been passed on to each council member independently.
Both of these vehicles were built in 2003 for the City of Stow, Ohio. After delivery it was discovered that the
vehicles were over weight for their roads (this has since been corrected by reducing the water amount). Rather
than lower the weight of the vehicles, Stow opted to purchase new ladders. General Safety took them in on
trade. In today's dollars these vehicles combined would cost approx. $1,500,000.00. When purchased new in
2003 the combined price was $1,360,000.00. Asking price for the vehicles is $1,055,000.00 (100' - $610,000.00
and the 75' - $445,000.00). The expected life span on these vehicles is approx. 20 — 25 years.
You have several options before you, purchase both, purchase the 100' ladder, purchase the 75' ladder or
purchase neither. Both of these vehicles are in the CIP plans for the fire department in the not to distant
future. Although in the current CIP the first ladder isn't scheduled until 2010, in last year's CIP it was
proposed in 2007. These items have been repeatedly moved out in the CIP due to financial shortfalls.
Based on this information the recommendation is as follows:
1. Purchase both the 100' & 75" ladders with a potential savings of approx. $450,000,00 or
2. Purchase the 100' ladder.
(If either truck is purchased, it is recommended that the purchase be contingent on a thorough inspection by
Emergency Apparatus Maintenance to the satisfaction of the city)

Background Information for November 8, 2006:
It came to the attention of the truck committee, by the vendor, that we inadvertently missed the two items
listed below while writing the specifications for the Pumper/Tanker. This equipment is standard for tanker
operations.
#1 — Drop tank or Dump tank. This is a folding water tank that is carried on the truck to the scene. Once on
scene the tank is deployed and the water load from the truck is dumped into it allowing the truck to proceed
to get another load of water.
Cost of the 3000 gal. tank is $1192.00
#2 — Extensions chutes for the two dump chutes on the truck. The extension chutes are needed to extend out
from the truck and over the drop tank to get the water in the tank and not on the ground.
Cost for the extensions is $1050.00 each X 2 = $2100.00
Total $3292.00

RESOLUTION NO.2006-118
A RESOLUTION ADOPTING ASSESSMENT FOR THE
WATER INTERCONNECTION PROJECT — PHASE IV
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment for the
improvement of Water Interconnection Project— Phase IV Lake Elmo, Minnesota.
NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKE
ELMO, MINNESOTA:
Such proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against the
lands named therein, and each tract of land therein included is herby found to be
benefited by the proposed improvement in the amount of the assessment levied
against it.
2. Such assessment shall be payable in equal annual installments extending over a
period of seven (7) years, the first of the installments to be payable on or before
the first Monday in January, 2007, and shall bear interest at the rate of 5.75
percent per annum from the date of the adoption of this assessment resolution. To
the first installment shall be added interest on the entire assessment from the date
of this resolution until December 31, 2006. To each subsequent installment when
due shall be added interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of
the assessment to the County Auditor, pay the whole of the assessment on such
property, with interest accrued to the date of payment, to the City of Lake Elmo,
except that no interest shall be charged if the entire assessment is paid within 30
days from the adoption of this resolution; and he may, at any time thereafter, pay
to the City of lake Elmo the entire amount of the assessment remaining unpaid,
with interest accrued to December 31 of the year in which such payment is made.
Such payment must be made before November 15 or interest will be charged
through December 31 of the succeeding year.

A RESOLUTION DIRECTING ABATEMENT ACTION
WHEREAS, on March 6, 2006, the Lake Elmo City Council adopted Resolution
2006-025 which declared that all private wells located within the West Central Lake
Elmo Area ("WCLE Area") are known or potential health hazards. The determination
of the City Council is based upon data received from the Minnesota Department of
Health, the Minnesota Pollution Control Agency, and the City's Consulting Engineer;
and
WHEREAS, Resolution 2006-025 also directed that the wells located within the
WCLE Area be sealed and that the private dwellings within the WCLE Area be
connected to the City's water system when it became available; and
WHEREAS, on June 6, 2006, the Lake Elmo City Council adopted Resolution
2006-047 which awarded a contract for the construction of water main, water
connections, and the sealing of wells ("Improvement Project")within the WCLE Area;
and
WHEREAS, the water main portion of the Improvement Project is substantially
complete and the City's water system is available to the parcels within the WCLE
Area; and
WHEREAS, the City has sent a certified letters to the property owners within
the WCLE Area requesting that the City be allowed to enter upon their property in
order to connect the residential dwellings to the City's water main and to seal their
private wells; and
WHEREAS, the following property owners, who reside within the WCLE Area,
have not responded to the City's certified mail request, and/or have indicated to the
City that they will not permit the City, its contractors, and consultants to enter upon
their property for the purpose of connection their homes to the City's water system
and/or for the purpose of sealing their wells ("Non -Compliant Property Owners"):

private welts and, upon failure of the Non -Compliant Property Owners to abate suc
health hazard nuisance, and the Lake Elmo City Council further directs the City
Attorney to commence the appropriate civil proceedings to require abatement of t
health hazard nuisances.

WHEREAS, pursuant to an advertisement for bids for the installation of the
SCADA System, bids were received, opened, and tabulated according to law, and 1
following bids were received complying with the advertisement.

Background Information for November 8, 2006:
The property owner has applied for a Waiver by Resolution to locate a 40 foot by 28 foot garage structure
nearer the front lot line than the principal structure (house) on the lot. The garage structure would be
located approximately 180 feet from the north property line (front). The proposed garage would be situated
north east of the house.
On the lot are two existing accessory structures which are planned for removal. One of the two existing
accessory structures is currently nearer the front lot line than the principal structure. This structure is
proposed to be removed and replaced by the proposed structure further from the front lot line. The existing
structure is approximately 140 feet from the front property line.
Section 300.13, Subd. 3C of the City Code provides that the Council must approve any application to
construct a detached garage in the R-R District that would be neared the front property line than the
principal structure.
Due to the substantial set back of the proposed garage from the front property line and its replacement of a
garage currently closer to the north property line, staff recommends adoption of the attached Resolution
a proving the garage location.

A RESOLUTION APPROVING THE PLACEMENT OF A GARAGE STRUCTURE
FRONT OF THE PRIMARY STRUCTURE AT 11989 30s' STREET NORTH
WHEREAS, pursuant to Section 300.13, Subd. 31 of the Lake Elmo Municipal
Code, Dean Otteson, the property owner, has requested approval to place a 40 foot by 2
foot detached garage structure nearer the front property line than the principal structure
11989 3 e Street North, in accordance with plans received by staff October 13, 2006,
NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of
Lake Elmo hereby grants permission for construction of a 40 foot by 28 foot detached
garage structure nearer the front property line than the principal structure at 11989 30a'
Street North, per plans received by staff dated October 13, 2006, subject to the followin;
conditions
1. The property line and right-of-way line for 30s' Street North must be located and
staked. A building permit shall not be issued until the Building Official verifies
that the garage will be located 30 feet or more from the front property line as
identified.
2. No trees or vegetation shall be removed within the 30 foot street set back area to
30'h Street North.
3. Prior to issuance of a building permit for the garage structure the property owner
shall submit a scaled drawing depicting the exact location of the proposed garage
structure in relation to the 30s` Street North right-of-wav line and any other
structures on the site. The drawing shall also provide the location, approximate
size and types of foliage and trees existing within 30 feet of the proposed garage
structure, together with an indication of which trees and foliage will be removed
during garage construction.
