ADJOURN &�j) printed on recycled paper MINUTES APPROVED: November 5, 2007 City of Lake Elmo Special City Council Meeting Minutes October 11, 2007 Mayor Johnston called the meeting to order at 7 p.m. in Fire Station No. I PRESENT: DeLapp, Johnson, Park (arrived 7:04 p.m.), City Engineers Jack Griffin and Ryan Stempski, City Attorney Filla, Finance Director Tom Bouthilet and City Clerk Sharon Lumby AGENDA: Motion: Council Member DeLapp moved to approve the October 11, 2007 Special City Council Meeting agenda. Council Member Johnson seconded the motion. The motion passed unanimously. PUBLIC HEARING: Adopt Final Assessment Roll for the 2006 Minnesota State Aid (MSA) Resurfacing Project; Resolution No. 2007-073 City Engineer; Jack Griffin, reported the City Council is being asked to conduct the final assessment hearing and adopt the final assessment roll for the 2006 Minnesota State (Aid) Resurfacing. The project includes resurfacing streets with a bituminous overlay for 45th Street from Jane road to Julep Avenue, Julep Avenue from 451t' Street to Keats Avenue, and 47th Street from Keats Avenue to Kimbro Avenue. The total cost of the improvements will be $244,127.62; with the city cost participation in the amount of $218,479.62 and the amount assessed against benefited property owners is $25,648.00. For this project, all properties are RAD, and have a proposed assessment rate for this project of $1,832.00 per buildable lot. There are 14 assessable units on this project Mayor Johnston opened the public hearing at 7:07 p.m. There was no one to speak for or against the final assessment. Mayor Johnston closed the public hearing at 7:08 p.m. Motion: Council Member Johnson moved to adopt Resolution No. 2007-073 adopting the final assessment roll for the 2006 Minnesota State Aid (MSA) Resurfacing project. Council Member Park seconded the motion. The motion passed unanimously. SPECIAL CITY COUNCIL MEETING OCTOBER 11, 2007 PUBLIC HEARING: Adopt Final Assessment Roll for the 2006 Overlay Project: Resolution No. 2007-074 Jack Griffin, City Engineer, reported the City Council is being asked to conduct the final assessment hearing and adopt the final assessment roll for the 2006 Overlays Project, The street improvement project included resurfacing streets with a bituminous overlay for Irvin Court, Irvin Circle, Isle Avenue, Ivy Court, and Jamaca Court. The total cost of the improvements will be $204,150.00; with the city cost participation in the amount of $149,172.00 and the amount assessed against benefited property owners is $54,9781.00. For this project, all properties are zoned RI (SDR), and have a proposed assessment rate of $1,309.00 per buildble lot. There are 42 assessable units on this project. Mayor Johnston opened the public hearing 7:12 p.m. Thomas FIuebsch, 4285 Ivy Ct. N, explained there is a low spot filling in with sand in front of his driveway, the curbs are crooked and the contractor did a very poor job on this project. Mayor Johnston closed the public hearing at 7:14 p.m. MOTION: Council Member Johnson moved to approve Resolution No. 2007-074 adopting the final assessment roll for the 2006 Overlays project. Council Member Smith seconded the motion. The motion passed unanimously. PUBLIC HEARING: Adopt Final Assessment Roll for the 2006 Street Repairs, Tablyn Park Streets Project; Resolution No. 2007-075 City Engineer Jack Griffin reported the City Council is being asked to conduct the final assessment hearing and adopt the final assessment roll for the Tablyn Park Streets Project. The street improvement project included street reconstruction for 27th Street North from Inwood Avenue North to eastern cul-de-sac, Irish Avenue North, Ironwood Trail North from Inwood Avenue North to 271h Street North, 28th Street North from Irish Avenue North to Ironwood Trail North, and 271h Street Court North. The total cost of the improvements will be $326,853,30; with the city cost participation in the amount of $244, 386,30 and the amount assessed against benefited property owners is $82,467.00. For this project, all properties are zoned R-1 (SRD), and have a proposed assessment rate of $1,309.00 per buildable lot. There are 63 assessable units on this project. Mayor Johnston opened the public hearing at 7:20 p.m. Dan Novak, 8520 Ironwood Trail, asked why the assessment is the sane for Tablyn Park and for the 2006 Overlays. The City Engineer responded that all of the properties for SPECIAL CITY COUNCIL MEETING OCTOBER 11, 2007 these two projects are zoned R-1 (SRD), and have a proposed assessment rate of $1,309.00 per buildable lot. Mayor Johnston closed the public hearing at 7:26 p.m, MOTION; Council Member DeLapp moved to approve Resolution No. 2007-075 adopting the final assessment roll for the Tablyn Park Streets project. Council Member Johnson seconded the motion. The motion passed unanimously. Attorney Filla explained this is the time that all written and oral objections will be considered by the City Council and that no appeal may be taken as to the amount of any assessment unless a signed, written objection is filed with the clerk prior to the hearing or presented to the Mayor at the hearing. Bob Johnson, 10323 47th Street N., noted that 501h Street is full of potholes and that the unpaved road is unfit to drive on.
