Mayor Hunt called the meeting to order at 7:00 p.m. PRESENT: Siedow, Dunn, Hunt, Armstrong,
DeLapp, Administrator Kueffner, Attorney Filla, Planner Dillerud, Building Official Jim McNamara, and
Finance Director Marilyn Banister
1. AGENDA
M/S/P Dunn/Armstrong — to approve the May 16, 2000 City Council Agenda, as amended. (Motion passed
5-0).
2. MINUTES: May 2, 2000
M/S/P Dunn/DeLapp — to postpone May 2, 2000 City Council Minutes until the June 6 City Council
meeting. (Motion passed 5-0).
MINUTES: April 18'" page 5: change from 119 to 109 units, delete (in) before last sentence.
M/S/P Dunn/DeLapp — to correct the April 18, 2000 City Council Minutes, as requested. (Motion passed
5-0)
3. CLAIMS
M/S/P Armstrong/DeLapp — to approve the May 16, 2000 claims in the amount of $29,600.65, as
presented. (Motion passed 5-0).
4. PUBLIC INQUIRIESANFORMATIONAL:
A. Charitable Gambling License for Lake Elmo Jaycees
The Lake Elmo Jaycees are requesting Council approval of a Premise Permit Application and a resolution
stating its approval to operate its Lawful Gambling at the Twin Point Tavern located at 11199 Stillwater
Blvd. A list of lawful gaming donations for January 1998 to December 1999.

M/S/P Dunn/Siedow — to adopt Resolution No. 2000-019, a Resolution approving the issuance of a
charitable gambling license by the State of Minnesota to the Lake Elmo Jaycees. (Motion passed 5-0).
B. Reminder of Nuisance Ordinance re:Parties
Mayor Hunt reminded residents who would be holding high school graduation parties that permitted
drinking under the age of 21 is illegal, and property owners, who have permitted underage drinking, are
liable for any injuries. The Sheriff's Dept. will ticket cars parked on streets where there are "no parking
signs". Our City parks are patrolled.
C. 300' Street Speed Study by MnDOT
The City received a 30"' Street Speed Study from Mn/Dot suggesting a 35-mph speed limit from Lake Elmo
Avenue to approximately 300 feet east of its intersection with Lisbon Avenue N. From there to Manning
Avenue, the report suggests a 40-mph speed limit. The study area is now posted at 30 mph, but the study
indicates that speed limit is too slow. The area that is now proposed to be posted at 35 mph, except for
extension to approximately 300 feet east of Lisbon, has been posted at that speed since before
reconstruction of the road. The remainder of the road was posted at 55 mph, which is a recommended
decline in that speed limit.
M/S/P DeLapp/Dunn —to thank the City Engineer for his efforts in the design process and following
through with the state to get a decline in the speed limit on 30" Street. (Motion passed 5-0.)
M/S/P DeLapp/Siedow — to accept the results of the 30"' Street Speed Zone and recommend speed limits
posted as recommended in the May 5, 2000 letter from Lars hnpola, Traffic Studies Engineer. (Motion
passed 5-0).
S. CONSENT AGENDA
A. Resignation from Planning Commission: Greg Gerard
The City received a letter of resignation from Greg Gerard, First Alternate on the Planning Commission.
Upon acceptance of Mr. Gerard's resignation, Eric Lipman will move up to First Alternate.
M/S/P Dunn/Armstrong — to accept the resignation with regrets of Greg Gerard from the Planning
Commission and move Eric Lipman to the First Alternate seat, and direct the staff to advertise the vacancy
in the City Newsletter and on cable. (Motion passed 5-0.)
6. MAINTENANCE/PARK/FIRE/BUILDING:
Building Official Jim McNamara provided the April building permit update.
The Council asked if there should be fencing around the wetland treatment area and asked the staff to send
a letter to the Fields of St.Croix HOA reminding them it is their responsibility that snowmobiles should not
be driving over system. There will not be streetlights in the Fields of St.Croix Second Addition unless
approved by the Council.
7. CITY ENGINEER'S REPORT: None
8. PLANNING, LAND USE & ZONING:
A. Referral from Planning Commission - Lot Size for keeping of horses
Planner Dillerud reported the Planning Commission considered letters from two residents of Midland
Meadows (CSAH 10/Lake Elmo Avenue) regarding amendment of the Zoning Ordinance to reduce the
minimum lot size for the keeping of horses from the present 10 acres to a standard parallel to those found in
some surrounding communities and Washington County. The standard proposed by the residents is 5 acres
for the first horse, and 1 additional acre per additional horse.

The Planning Commission recommended the City initiate an amendment to the zoning ordinance in line
with that standard. The 10-acre standard now applies to all "domestic animals, livestock or kennels". If it
is the intent to amend only to horses, the City must be able to distinguish a difference between the use in
keeping horses and these other types of animals.
The Council found that horses are typically kept for riding, used as a recreational animal. The staff was
asked to check with West Lakeland or other communities with 5-acre minimum if they have encountered
any problems, such as, setback issues, feedlot concern. A Conditional Use Permit or a variance could do
approval.
M/S/P Dunn/Armstrong —to direct the Planning Commission and staff to initiate an amendment to reduce
lot size for keeping of horses. (Motion passed 5-0).
B. Planning Commission Referral: Ag Zoning Classification amendments
Planner Dillerud reported the Planning Commission initiated consideration of amendment of the AG
Zoning District standards and provided a draft of the proposed amendments. In his memo to the Council,
Chairman Armstrong asks for Council advice and direction on the proposed amendments.
The Council asked for the following: delete brewery/winery as one of the permitted uses because of
concerns with bringing in other products that could be sold at the same time and becoming a retail
operation; have offices restricted to permitted uses, and delete small landscape operations.
M/S/P DeLapp/Dunn — to proceed ahead with the Ag Zoning Classification Amendments, as amended, at
the May 16 Council meeting. (Motion passed 5-0.)
C. Sign Variance Appeal: Richard Kosman, Leslie's Floor Decor
Planner Dillerud reported the Planning Commission unanimously adopted a Resolution denying the Sign
Ordinance Variance application of Mr. Kosman to construct a replacement sign at Leslies's Floor Decor of
72 square feet area, at a height of 14 feet, and set back from State Highway 5 a distance of 9 feet. The Sign
Ordinance standards are 30 square feet maximum area, 6 feet maximum, eight and 15 minimum setback.
Rich Kosman explained the sign surface coverage is 56 sq.ft., smaller than what he currently has now, and
will go with the one sign. He wants to raise sign for a better line of vision. The sign is lighted only during
business how's.
Mayor Hunt opened up public hearing at 8:05 p.m
Arlo Frost, Chair of the Lake Elmo Village Commission, submitted a memo in opposition to granting a
variance. The large signs near the road obstruct the view along State Hwy 5. The plants underneath will
make it a solid sign. There is evidence that larger signs tend to promote faster traffic. Concerns about
traffic were expressed at the Village Commission meeting. The sign's size, location, and appearance are
inconsistent with the proposed design guidelines of the Village Commission.
Arlo Frost requested the Village Commission be involved with decisions on applications in the Old Village
area.
Administrator Kueffner indicated the Village Commission does not have the authority to look at
applications now, and the code needs to be changed to include this requirement if applications are going to
be reviewed by this commission.
Council member Dunn is supportive of the variance because signage is important to a business. This is a
preexisting business located on a state highway, has a positive influence, and does not generate traffic. The
City should work with the business owner. The sign ordinance was to be reviewed because it's too
restrictive.

Council member DeLapp pointed out that by a 9-0 vote by the Planning Commission denied the sign
variance because there is no basis to approve based on code. We are supposed to be enforcing our code.
What are the hardships that this sign is necessary that no other one in town would have? It's irrelevant that
there are larger signs in the city. Then we should change the sign code to fit the Old Village area.
Council member Armstrong liked the submitted sign drawing, but as it happen, one neighbor sees approval
of a larger sign as done with the 76 station and feels he should be approved to have a larger sign. The
Planning Commission denied the sign variance, even though the sign was smaller and neater than existing,
it still does not meet the sign standards and no hardship was submitted. The City should be more consistent
with applying our sign ordinance. According to the 1987 Council minutes, the Council granted 9
variances. It is time to stop the train of variances.
Planner Dillerud indicated the Planning Commission looked at the sign ordinance and decided they did not
want it changed. Dunn pointed out that in 1997 the Council asked to include input from the Lake Elmo
Business Community and that has not happened.
Council Member Siedow lives next to this business and found traffic blockage is not a problem with the
large sign now. There are other businesses on Hwy 5 that have larger signs already.
Mayor Hunt felt the sign ordinance became overly restrictive. This is a unique site, and the proposed sign
is much better than what is there.
Mayor Hunt closed the public hearing at 8:10 p.m.
MIS/ Dunn/Siedow- to direct the city administrator to come up with findings of fact, such as, lot
configuration, constraints, to approve the request for sign
Administrator Kueffner pointed out according to the code it is the applicant that has to show the hardship.
Council should give their findings of fact to the city.
M/S/P Dunn/Siedow — to direct the applicant Rich Kosman, to come back with findings of fact for proving
a hardship to be included in a resolution for Council consideration at the June 6`h Council meeting. (Motion
passed 4-1:Armstrong.)
Bicycle Path Request
Don May asked for a bicycle path because of the number of children riding their bikes to get to Oakdale.
Council member Dunn brought up this item since the Council just approved the new road.
M/S/P Dunn/Armstrong - to look at constructing a bike path from the new road, south cul de -sac to
Imperial Ave, as described in submitted map, because of the safety concern for kids riding their bikes to
Oakdale and to let Brian Bachmier know. (Motion passed 5-0)
D. 1-94 & Old Village Water System
Planner Dillerud gave a summary of the proposed plan for financing the improvements under consideration
for the Old Village Water System; and the construction of well, storage and pumping facilities to serve the
120 acre portion of Lake Ehno within the MUSA, a portion of which is now served with water by Oakdale.
Springsted, Tautges and Tom Prew have reviewed the entire package. The Council was impressed with the
financing package presented and asked for a copy of the sheet on tax abatement.
1VI/S/P Siedow/Dunn — to direct the staff to prepare plans and specs for stem for 1-94 and Old Village Water
System. (Motion passed 3-2:DeLapp: concern on future implications for higher development, Armstrong
have a water source with the City of Oakdale, self sufficient in 194 and could continue on, don't have a
problem with Old Village water system and let 194 sit by itself.)
Planner Dillerud volunteer to clear up the concern of further development and strategy concerns.

9. CITY ATTORNEY'S REPORT:

Mayor Hunt reported Friday, May 26; the Cimarron bike patrol will start up again and extended the
invitation to the Council to show its support.
Council member DeLapp passed out bill HF849 passed on reliever airports.
Council member Dunn pointed out Senator Laidig sent letter to Council with update on issues. Pictures
showing parking issues on Lake Elmo were submitted and should be passed onto the Village Commission.
She asked the staff to get a copy of the VBWD, Best Management Processes.
Council member Armstrong indicates May 3`a was the Elected Official's Meeting, and the #622 School
District Referendum was passed.
11. UNFINISHED BUSINESS:
Animal Control Ordinance
Arlo Frost, veterinarian and Village Commission Chair, volunteered his guidance on the animal control
ordinance.
12. NEW BUSINESS:
13. CITY ADMINISTRATORS REPORT:
A. Prosecuting Attorney
MIS/ Siedow/Hunt — to retain Jerry Filla, Peterson, Frain & Bergman, as the lowest bid for criminal
prosecution based on his experience, credentials, and have been well served by the firm.
Council member Dunn wanted to review Kevin Shoeberg's proposal and to get fresh blood into the system,
Council member Armstrong said this wasn't related to the low bid, that the City should be able to make
money and Mr. Shoeberg can do this for us. (Motion failed 2-3:Armstrong, Dunn, DeLapp).
M/S/P Armstrong/Dunn - to approve hiring Kevin K. Shoeberg, P.A., to provide criminal prosecution
services, as of June 1, 2000. (Motion passed 3-2Hunt, Siedow)
B. Hill Trail N.-
Administrator Kueffirer reported Hill Trail N. continues to deteriorate. A survey will be done, drainage
issues, easements need to be addressed, per the 1999 Public Hearing. Vegetative loss was a concern.
Council will give direction at the next council meeting.
C. Cancellation of the July 4°i Council Meeting.
M/S/P DeLapp/Siedow — to cancel July 4"' Council meeting, if there are no required agenda items. (Motion
passed 5-0.)
