HomeMy WebLinkAbout06-20-00 CCMAPPROVED Lake Elmo City Council Meeting Minutes Tuesday, June 20, 2000 Mayor Lee Hunt called the meeting to order at 7:00 p.m. in the Council Chambers of City Hall, 3800 Laverne Avenue North, Lake Elmo, Minnesota. Present: Council Members Armstrong, DeLapp, Dunn and Siedow. Also present: City Administrator Kueffner, City Planner/Assistant City Administrator Dillerud, City Attorney Filla, City Engineer Prew, Maintenance Supervisor Olinger, Parks Supervisor Bouthilet and Building Official/Code Enforcement Officer McNamara. Pledge of Allegiance 1. Agenda M/S/P DeLapp/Armstrong - to approve the agenda, as amended. (Motion Passed 4-0). Dunn arrived after this vote. 2. Minutes -June 6, 2000 M/S/P DeLapp/Armstrong - to approve the minutes, as amended. (Motion Passed 5-0). 3. Claims M/S/P DeLapp/Siedow - to approve the claims, as presented, noting the council receipt of the 4 month City Budget. (Motion Passed 5-0). 4. Public Inquiries/Informational 4.A Amendment to the VBWD 1995 Water Management Plan: Dave Bucheck Dave Bucheck opened his presentation by stating that BWSR had requested an amendment to the current plan. He noted the wide application of the review improves cost efficiency of the project. He discussed the current status of following land -locked lakes: SunnyBrook, Goetchel Pond, Cloverdale/McDonald, Downs, and Fahlstrom Pond. He explained that even though current water levels are low, the lakes might flood again if action is not taken. He reviewed the plan as found in the tables presented. Councilor Dunn asked how many homes in the SunnyBrook area were affected, to which Mr. Bucheck replied, "None, currently, but about a dozen homeowners want to keep the water in Brown's Creek, which is protected." He said VBWD wants to keep communication open with them, and will take another look at the water flow near the Stillwater Area High School site. Councilor DeLapp said the idea of taking Goetchel Pond should not be an issue at all, that is Lake Elmo's rule for developers, and does not like the idea of engineering ponds. "He explained that with the completion the 1% rule, it is unnecessary and that converting a clean spring fed lake into a storm sewer has happened and his pond is environmentally irresponsible, and if Lake Elmo works on an Old Village Plan, with say 50 acres of land becoming an infiltration pond, it will solve the problems with Down's Lake, taking care of things by capturing the water flow. Mr. Bucheck said VBWD and the DNR has the authority to "shut down" projects if they have no VBWD permit. M/S/P DeLapp/Dunn - to direct staff to engage in whatever resources necessary to report to VBWD, using the most recent technology available. (Motion Passed 5-0). On an unrelated topic, Mr. Bucheck asked the City Council to take a look at "used car lots" on some resident's property. 4.11 Resignation of Eric Lipman - Planning Commission Appointment of Dianne Taylor - Planning Commission M/S/P Dunn/DeLapp - to accept the resignation of Eric Lipman from the Planning Commission, and to direct the staff to send a letter of appreciation (and good luck) to Mr. Lipman. (Motion Passed 5-0). M/S/P DeLapp/Dunn - to appoint Dianne Taylor as the First Alternate on the Planning Commission. (Motion Passed 5-0): 5. New Business 5.A Petition for 50' Street Improvement Administrator Kueffner explained the City received a petition for the improvement of 50`h Street, signed by more than 35% of the property owners. She said the City Engineer already prepared a feasibility report for this improvement, and the Council may want him to update it, or make other changes they deem in the best interest of the residents. She said the Council might accept the petition this year, accept the petition and do the project neat year, reject the petition for cause, or grant a waiver. Mayor Hunt invited comments from the public. Maintenance Supervisor Olinger said a back-to-back cul-de-sac idea was implemented in the Foxfire development, and it does network, stating it is not feasible for snowplowing in the winter months. M/S/P DeLapp/Siedow - to approve Resolution No. 2000-022, Declaring Adequacy of Petition and Ordering Preparation of Report to Improve 50a' Street, directing the City Engineer to study traffic calming devices, back-to-back cul-de-sacs, and a bike path connecting to the Stillwater Area High School. (Motion Passed 5-0). 5.13 Right -of -Way Ordinance Administrator Kueffner said, in her opinion, the City is long overdue in adopting a right-of-way ordinance that provides for the protection of the City, and is specifically spelled out in the attached "Findings and Purpose" draft ordinance. She noted she had reviewed the draft with Dan Olinger, Tom Prew, and Jerry Filla, and they, along with the City Planner support adoption of the ordinance. She explained that there will be no changes to the dimensions of right-of-way, only use. M/S/P Armstrong/DeLapp - to adopt Ordinance No. 9756, and Ordinance Relating to Right -of -Way Management. (Motion Passed 5-0). M/S/P DeLapp/Dunn - to direct that a summary of Ordinance No. 9756 be published. (Motion Passed 5.0). 6. Consent Agenda (n/a) 7. Maintenance/Park/Fire/Building 7.A.1 Update on Clean-up Day 2000 Supervisor Olinger reviewed Clean-up Day 2000 reports from Vasko Rubbish Removal & Recycling Systems. He noted, once again, the cost for Clean -Up Day was below the budgeted amount, for the third year in a row. He thanked additional staff who worked on Saturday, May 13, and noted Clean - Up Day 2001 is not scheduled for the "Fishing Opener/Mother's Day." 7.A.2 15a` Street Improvement Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 3 Administrator Kueffner said an annual inspection is made of 15`h Street to determine the level of maintenance necessary. She noted, to date, she had not received a report form either the City Engineer or the Maintenance Supervisor, but that both of them have looked at the street and that she had requested Dan Olinger perform another traffic count. She presented a bag of nails and other metal debris that a resident had brought into City Hall, which was gathered from 15th Street noting it may be the result of recycled gravel being applied. Engineer Prew suggested 22-foot wide/7 ton axle weight, and Supervisor Olinger said he had reviewed Linders use of 15`h Street. Olinger also said his crew had been grading every two weeks, and was asked to cease because of the dust that resulted. He explained that some gravel companies supply recycled product, and the debris may have come from that source. (Motion Passed 5-0). 7.B Update on Parks Department Activities: Supervisor Mike Bouthilet Supervisor Bouthilet reported that Arbor Day in Lake Elmo did not go un-noticed, in that Planning Commissioner/Resident Jeff Berg installed plantings in the City. He mentioned a discrepancy with Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 4 what the Parks Commission recommended and what the plan is for the Park in the Tana Ridge development, and will meet with the developer's representative, Tim Freeman. He reported a little league group was working to improve Pebble Park; he is sending our RFP's for Lion's Playground. Councilor Armstrong asked if the tennis court surface at Tablyn Park was scheduled, but not completed for re -surfacing, to which Supervisor Bouthilet replied, "No." 7.0 May Building Permit Fees Update: Jim McNamara Building Official McNamara reviewed the May 1, - May 31, 2000 Building Permit fees. He suggested information regarding new home starts in Lake Elmo may be of interest to readers of the City newsletter, and said he would coordinate this with the editor. City Engineer's Report 8.A 25`s Street & Lisbon Avenue Vacation Resolution (Postpone to July 18, 2000) (Enter kwrcgaz'ung this issue re vk&June 19, 2000 f rma A=nq Scott McDonald) 8.B Wastewater System Design Basis for Lots 2, 3, & 4, Block 2, DeMontreville Highlands, Third Addition. Engineer Prew stated that when the original plat for this subdivision was filed, groundwater testing was completed at the site, and the lots did not meet the code requirements. He explained the developer requested installing mound systems, but the request was denied, and subsequently, State Code changed, and alternate septic system designs are now permitted. The City Council took no action on this issue because Lake Elmo Code currently allows wetland treatment systems. The City Attorney will prepare language that would appear on deeds of conveyance advising purchasers that wetland treatments systems are allowed in the City and on this site. 8.0 Adoption of Performance Based Septic System Ordinance M/S/P Armstrong/Siedow — to adopt Ordinance 9755, whereby Minnesota Rules, part 7080.0179 is incorporated by reference into the Lake Elmo Municipal Code. (Motion Passed 5.0). 9. Planning, Land Use & Zoning 9.A Approve Sign Variance Appeal — Leslie's Floor Decor Councilmember DeLapp said he disagrees with the findings of fact presented by the applicant. He pointed out that the lot is smaller than other downtown businesses — why the need for a larger sign; applicant chose to change the sign; 10 variances to the applicant; does not know what the hardship is; people have different sensitivities, and the sign ordinance is meant for sight sensitive people & Lake Elmo people are more sensitive than people from other cities. Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 5 Council member Armstrong said she voted in opposition to the sign previously and said her concerns were similar to those of Council member DeLapp's. She said she has a problem granting variances when there is no real hardship. Mayor Hunt said he felt this situation has special circumstances and agrees that the variance should be granted. M/S/P Dunn/Siedow - to adopt Resolution 2000.021 an order issued by the Board of Adjustment and Appeals approving the requested variances on Appeal by Richard Kosman, Leslie's Floor Decor, based on findings. (Motion Passed 3-2). M/S/P Dunn/DeLapp - to amend the agenda to move Planning Issue 9.1) to follow 9.A (Motion Passed 5-0). 9.13 Open Space Concept Plan, D.T. Development/Tjosvold/Zehrer Planner Dillerud said at its May 2, 2000 meeting, the City Council tabled consideration for this OP Concept Plan for 17 home sites on a site of slightly less than 40 acres to allow the applicants an opportunity to reconsider several design features of the Concept. He noted the alterations/amendments to the previously submitted plan, as found in the observations of the staff report. He said, with the revisions to the Concept now proposed, staff finds it to be significantly more responsive to the intent and purposes of the OP Ordinance than the earlier version, sufficiently so as to recommend approval, with the following conditions: L) a finding by the City Council that introduced landscaping is responsive to the screening requirements required to reduce site property line setbacks from 200 feet to 100 feet, 2.) Modification of the Concept Plan to add site screening of equal scale and density to those lots on the East side of the plat where house pads are less than 200 feet from the East property line, 3.) City Council direction regarding the applicant's proposal for reduced side yard setbacks - it is the recommendation that such a reduction only be approved in cases where side loaded garages are actually constructed. Tim Freeman (representing the applicant) Folz, Freeman & Dupay Mr. Freeman explained that the applicant wants to preserves the woods in the North side of the site and will introduce landscaping in the South side, he encouraged the side load garage plan; said the plan met the code requirements for an OP Development. He mentioned that the Fields of St. Croix Village Greens were created to offer a meeting place for neighbors, and the village greens in this proposal were the same dimensions, he said he can alter the placement of the driveway for the flag lot. Neil Severson Resident Mr. Swanson said he would like to see a buffer where the current house is located and expressed his concern that 16`h Street might not be paved. Gary Axberg Resident - Parkview Estates Mr. Axberg said he had concerns about integrating a farm with a residential area; said he sees the current farm with animals creating problems and may devalue property; asked why preserve open space, yet allow a barn; said the flag lot impacts 4/5 lots in Parkview Estates; supportive of the Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 6 walking trail, but would like to see the flag lot removed from the proposal, and offer a walking trail for use by the entire neighborhood. Steve Wortman Resident - Parkview Estates Mr. Wortman said he was opposed to the proposed flag lot; concerned about farm animals close to residential development; wants to see 15thStreet paved. Ed Forletti 1743 Ivory Avenue Mr. Forletti said a driveway in the backyards of the homes in Parkview Estates makes no sense; he said he wants to see the flag lot removed from the plan. Council Member Dunn said although she is not a "fan" of the OP Ordinance, she prefers to see larger lots, noting the proposed plan does meet the criteria of the OP Ordinance. Council Member Armstrong noted she couldn't see a group of people from a neighborhood gathering on a 50' strip of land referred to as a village green. M/S/P DeLapp/Siedow - to approve the OP Concept Plan of D.T. Development - Tjosvold/Zehrer based on plans dated by staff June 14, 2000, subject to the following conditions: 1. Landscaping at the same scale and density as proposed at the West property line be added to the East property line where house pads are less than 200 feet from the East property line. 2. Side yard setbacks may be reduced to 10 feet (living) and 5 feet (garage) only where side loaded garages are constructed. (Motion passed 4-0). Opposed: Armstrong; feels the open space designated for a village green is a waste, and two lanes of traffic is a waste of village green, as well. M/S/P DeLapp/Siedow - to approve the Open Space Concept Plan of D.T. Development/Tjosvold/Zehrer, based on plans dated by staff June 14, 2000, subject to the following conditions: Landscaping at the same scale and density as proposed at the West property line be added to the East property line where house pads are less than 200 feet from the east property lines. Side yard setbacks may be reduced to 10 feet (living) and 5 feet (garage) only where side loaded garages are constructed. (Motion Passed 4-0). Opposed: Armstrong - opposed to the wasteful use of land for a village green. 9.13 Zoning Ordinance Amendment - AG Zoning District Uses Planner Dillerud explained the amendment is an effort to provide additional implementation measures to preserve open space within Lake Elmo by permitting (as a Conditional Use Permit) some non-agricultural uses within the AG zone. Present owners of large acreage's within the City will have economic incentive to retain those large holdings as an alternative to subdivision and Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 7 ( i development. The additional AG uses that would be allowed are limited in scope; and, the restrictions attached to allowing those uses are significant. Council Member DeLapp said the "sign" provision within the amendment should be deleted. M/S/P Dunn/DeLapp - to modify 3.j. Standards as follows: j. In the event that the property owner, or future property owner, initiates a Comprehensive Plan Amendment and Rezoning of any or all of the contiguous real estate from Agriculture to a more intensive use, the Conditional Use Permit shall terminate with all non -conforming structures removed within one year from the date of the City Council's adoption of the Comprehensive Plan Amendment and rezoning, unless the City agrees otherwise. This section shall not apply if the City initiates rezoning or if property owner is forced to transfer title to any part of the contiguous real estate due to Eminent Domain. (Motion Passed 5-0). M/S/P Dunn/DeLapp - to approve Ordinance No. 9757, as amended, and include Section 2 in "Definitions" - Section 150 of the Municipal Code, and Section 3 to appear as Section 300.07 Subd. 6. (Motion Passed 5-0). M/S/P Dunn/DeLapp - to amend item j. of Ordinance No. 9757, to include removal of all nonconforming structures from the site within one year from the date of adoption of the Comprehensive Plan Amendment and rezoning. (Motion Passed 5-0). M/S/P Dunn/DeLapp - to adopt Ordinance No. 9757, as amended, including Section 150 - Definition of Non -Agricultural Low Impact. (Motion Passed 5-0). 9.0 Old Village Planning Area: 2000 - 2020 Comprehensive Plan Amendment Planner Dillerud will bring the update concerning the Comprehensive Plan to the City Council at its July 18, 2000 meeting. 9.E Final Planned Unit Development, Final Plat, Zoning & Development Agreement: Carriage Station. (Res. No. 2000-024) Planner Dillerud stated that Carriage Homes IX (Stillwater Investment Co.) had applied for the Final PUD Plan, Final Plat and development Agreement approval for the 110 home and 4.5 acre Limited Business neighborhood. He noted all grading and infrastructure construction plans have been reviewed and approved by the City Engineer and the Development/PUD Agreement has been reviewed and approved by the City Attorney. He explained that staff has reviewed the Final Plat and found the drawings in conformity with the approved Preliminary Plat, and Chapter 400 standards for conventional plats and that the Valley Branch Watershed District permit has been issued. He said the City Engineer also approved the design of the Wetland Treatment System, and an MPCA Permit for the system has been applied for, but not yet issued. He reminded the Council that final zoning of the site remains unclassified. The Council reviewed the Development Agreement and made the following motions: Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 8 M/S/P Siedow/Dunn - to amend Section 4.07 of the Development Agreement, the date for City Improvements from November 15, 2000 to December 15, 2000. (Motion Passed 5-0). M/S/P Siedow/DeLapp - to amend the Development Agreement Section 4.01 F. Lateral Water Mains: Lateral water mains shall be sizes and diameter as ap roved by the City Engineer, and the improvement shall be completed on or before the 30 ' day of November, 2000. Lateral water mains shall be dedicated to the City. (Motion Passed 5-0). Council Member DeLapp asked why the Park Dedication fee was so low. Planner Dillerud explained that based on a certified appraisal by the City Assessor, completed to Chapter 400 requirements, those specify that the appraisal is made on the raw land value prior to development. He said the concern expressed by Councilor DeLapp is he understands that Mr. Arkell purchased the land well in excess of what the assessor has it valued. He explained that the purchase price paid by Mr. Arkell was reflective of the assumption that the land would be developed in Oak Park Heights at a use intensity far in excess of that in Lake Elmo. He noted that the assessor couldn't make changes based on the selling price of property. M/S/P DeLapp/Siedow - to adopt Resolution 2000-023, A Resolution approving the Final Plat and PUD Development Agreement for Carriage Station. (Motion Passed 3-2). Opposed: Dunn and Armstrong - based upon the recommendation from the Planning Commission to deny. M/S/P DeLapp/Siedow - to adopt Ordinance No. 9758, an Ordinance amending Section 300.07 "Zoning District Map" of the Lake Elmo Municipal Code, reclassifying Lot 15, Block 1 and Lots 2-6, Lots 1-14, Block 1 of Carriage Station, from unclassified to Limited Business, and from unclassified to R2 One and Two Family Residential, respectively. (Motion Passed 3-2). Opposed: Dun/Armstrong - based upon the recommendation to deny from the Planning Commission. 9.17 Tax Abatement: Set Hearing Date M/S/P DeLapp/Dunn - to direct staff to publish Notice of Public Hearing regarding Tax Abatement to be held July 18, 2000; and, to direct the City Attorney to prepare the appropriate Tax Abatement Resolution to be considered July 18, following the hearing. City Council Reports 11.A Mayor Hunt Mayor Hunt announced the Lake Elmo Jaycees would receive the Outstanding Citizens Award from the Stillwater Chamber of Commerce at the Lake Elmo Banquet Hall, Tuesday, Jure 27, 2000. 11.B Council Member DeLapp - no report Lake Elmo City Council Minutes Tuesday, June 20, 2000 page 9 11.0 Council Member Dunn Councilor Dunn reported that the Historical Preservation Society's driving tour was well attended by nearly 40 people, and said she found it to be very enjoyable and informative.
