LAKE ELMO CITY COUNCIL MINUTES DECEMBER 5, 2000
Mayor Hunt called the meeting to order at 7:00 p.m. in the Council
chambers. PRESENT: Siedow, Dunn, Hunt, Armstrong, DeLapp,
Administrator Kueffner, Attorney Jerry Filla, and City Engineer Prew

as amended. (Motion passed 5-0).
2. MINUTES November 21, 2000
M/S/P Siedow/DeLapp — to approve the November 21, 2000 City Council
Minutes, as amended. (Motion passed 3-0-2Abstain:Armstrong, Dunn)
3. CLAIMS
M/S/P Siedow/DeLapp —to adopt Resolution No. 2000-059, Claims # 18280
through 18323 in the amount of $66,440.67. (Motion passed 5-0).
4. PUBLIC INQUIRIES/INFORMATIONAL
A. (1)Public Inquiries: NONE
(2)Elizabeth Semler: A Message on Drunk Driving
Elizabeth Semler, a 13 year old Lake Elmo resident, read her letter
expressing concerns about drunk driving and told her story about her best
friend's father killed by a drunk driver. Mayor Hunt will send a letter of
thanks to her school, Mounds Park Academy.
(3) Sgt. Malinosky, member of south team of the Washington County
Sheriff's Dept., introduced himself and indicated he just returned to work
after being hit by a drunk driver on 100' and Manning and supports
Elizabeth's efforts in caring enough to do what she can to make this a safer
and better world to live in.
(4) Eric Lipman, State Rep Elect and former PZ member, will explore
education funding, lower taxes, insure greater control of local planning
issues, all extensions of his campaign for the new legislative session.
B. Resolution Adopting 2001 Budget

A. 2001 Liquor License Renewals
M/S/P DeLapp/Dunn - to approve the 2001 Liquor License Renewals.
(Motion passed 5-0).
7. MAINTENANCE/PARK/FIRE/BUILDING:
A. Update on Fire Dept. Activities: Greg Mamlquist
Fire Chief Greg Malmquist reported there were 373 calls for the year, on
December 161h they will ring the salvation army bell from 10-8 p.m. at the
Stillwater Walmart, and the 17th is Santa Day at the fire hall, from noon until
2. Malmquist asked if Fire Station One was approved for a lighting upgrade
and indicated the heating system needed upgrade.
B. LEFD Relief Association By -Law Changes: Brad Winkel
Brad Winkel, President of the LEFD Relief Association, went over the
proposed bylaw changes with the Council. No City Council participation is
needed. The Council thanked Brad and the Board for all their work on
updating these By -Laws.
M/S/P Dunn/Siedow - to approve the proposed changes to the LEFD Relief
Association Bylaws conditioned upon the staff receiving a copy of the
bylaws incorporating the changes and including the date of approval by the
City Council. (Motion passed 5-0.) Copy of minutes will be sent to Brad
Winkel.
S. CITY ENGINEER'S REPORT:
A. Feasibility Report for 15th Street
Tom Prow reviewed the Feasibility Report for 15th Street N. with the
Council. The money can be borrowed from a closed bond fund and paid
back so the project can be financed internally. Linders have an agreement for
participation in the 15th Street improvement under its CUP and asked if the
City would consider placing the assessment over a time period. The cul-de-
sac shows it goes into the Regional Park, but the City Engineer may put in a

hammerhandle and shorten the road. Council member DeLapp reiterated his
proposals for assessment policy changes.
M/S/P Armstrong/Dunn — to set the second Council meeting in January for
discussion of assessment policy and send Council member DeLapp's
assessment policy proposal onto Council for consideration. (Motion passed
5-0).
M/S/P DeLapp/Dunn — to adopt Resolution No. 2000-060, receiving the
feasibility report for the improvement of 15th street and to call a public
hearing, with discussion on width, appropriate landscaping and character, at
7:30 p.m. on January 16, 2001. (Motion passed 5-0).
B. 50th Street Improvement
Tom Prew informed the Council that he needs more time to prepare the
additional options for the proposed 50th Street Improvement. Staff
recommended this item be postponed until January 16, 2000 in order to
review this presentation before it goes to the Council and the affected
residents
M/S/P Dunn/Siedow — to postpone receiving the options for the
improvement of 50th Street, from State Highway 5 to Lake Elmo Avenue
(County Road 17) until January 16, 2001. (Motion passed 5-0).
9. PLANNING, LAND USE & ZONING•
A. Carriage Station Conditional Use Permit for Neighborhood
Identification Signs
At its November 13, 2000 meeting, the Planning Commission recommended
approval of this application for a Conditional Use Permit to construct two
permanent neighborhood identification signs at entrances to the Carriage
Station neighborhood. The sign at 55th and State Highway 5 would be 44
square feet in area and extend 5.5 feet above grade. The sign/monument in
the street median at Marquess Trail and State Highway 5 would be
approximately 24 square feet in area and extend 3.5 feet above grade.
Discussion by the Planning Commission and the Council centered on
whether permanent neighborhood identification signage was appropriate in
Lake Elmo.

Council member Dunn pointed out the developer of Carriage Station was
confined to a street name like "Marquess" because he had to follow the
Washington County's street name and numbering system. She would like
the City to opt out of this policy as Cottage Grove has done to give
developers more creativity in street names. The staff will prepare for the
next Council meeting a resolution pulling out of Washington County's name
and numbering system.
It was pointed out at the meeting that a new identification sign was erected
in the Fields of St. Croix without City approval.
M/S/P Siedow/Dunn — to adopt Resolution No, 2000-061 approving a
Conditional Use Permit for Carriage Homes IX to construct two permanent
neighborhood identification signs per the plans staff -dated November 9,
2000 and subject to the conditions listed by said Resolution based on the
Findings and recommendation of the Planning Commission. (Motion passed
3-2:Armstrong stated neighborhood identification signs signify more
suburbia, didn't like the resolution referring to another development that has
this type of sign. DeLapp: Identification signs are not appropriate in Lake
Elmo, cause a nuisance.)
M/S/P DeLapp/Siedow — the approved diagram does not have specific
dimensions and need to clarify dimensions that are not shown on illustration
that previous decision was made on and in keeping with cover page.
Schematics to PZ and CC are not to scale and need to define measure above
grade. (Motion passed 5-0).
M/S/P Armstrong/Dunn - to add to first meeting in February to repeal by
public hearing Neighborhood Identification Signs. (Motion passed 5-0).
B. Site Plan — High Pointe Health Campus
The Planning Commission recommended for approval of this Section 520
Site Plan application to construct a one-story addition of 2,533 square feet to
the north end of the existing High Pointe Health Campus Structure to
accommodate the need of the radiology tenant for expansion space. Staff
recommended applicant needed to depict, but not construct the two
additional parking spaces that would be required by formula for this small
addition, Proof of Parking, as was approved at the Cenex Station.

M/S/P Dunn/Siedow - to approve the site plan for a 2,533 sq.ft. one-story
addition to the High Pointe Health Campus structure, per plans applicant
dated November 15, 2000, based on the recommendation of the Planning
Commission and approval for "Proof of Parking". (Motion passed 5-0).
C. Comprehensive Plan 2000-2020
The City Planner provided the Housing Chapter Draft, recommended by the
Planning Commission and copies of the Inventory and Policy chapters and
Land Use Map of the 2000-2020 Comprehensive Plan.
The Council received letters dated December 4 and 5, from John Lang,
Messerli & Kramer, representing his client Dale properties, objecting to the
draft housing element of the Comprehensive Plan.
Alan Dale stated he would like to develop his 90 acres, at the Junction of
County Road 13 (Inwood) and County Road 10 (10t' Street), by using what
he thought was currently available sanitary sewer and the road infrastructure
which is in place with a housing density of three to four units per acre.
The Council had never talked about sewering this property as indicated in
the proposed comprehensive plan. They would not send the Housing Chapter
and Land Use Map back to Planning Commission to follow Mr. Dale's
suggestion. Once these chapters are adopted this doesn't preclude Mr. Dale
to file an amendment.
M/S/P Dunn/Armstrong — to adopt Resolution No. 2000-062, A Resolution
adopting the 2000-2020 Comprehensive Plan Inventory/Policy Chapters.
(Motion passed 3-1:Siedow: doesn't like the policies for the Old Village
housing which will turn into ordinances in the future, he doesn't have to do
research, but likes to go with his gut feeling, which usually is right, and
believes these policies are too restrictive.)
M/S/P DeLapp/Dunn — to amend page 20 add "manufacturing of products
for direct sale,"... (Motion passed 5-0).
M/S/P Armstrong/DeLapp — to adopt Resolution No. 2000-63 adopting
Housing Chapter of the 2000-2020 Comprehensive Plan. (Motion passed 4-
1:Siedow: Housing costs have accelerated in Washington County, nobody

can put up a home in Lake Elmo for $150,000 and what this amounts to is an
average person cannot live in Lake Elmo).
M/S/P DeLapp/Armstrong — to adopt Resolution No. 2000-064, Adopting
the 2000-2020 Comprehensive Plan Land Use Map (Motion passed 4-
1:Siedow: There's no light industrial zoning which could be located along
Highway 5, 36 or I-94).
IO.CITY ATTORNEY'S REPORT:
11.CITY COUNCIL REPORTS
Council member DeLapp reported Highwy 36 Committee has resumed its
design review committee on the Stillwater bridge which will meet Thursday
morning at the Washington County Government Center.
Council member Dunn reported the Washington County budget hearing is
on December 7, and proposes a 4.8% increase change from 2000 to 2001.
City Engineer Tom Prew attended the VBWD meeting on Downs Lake and
the Plan would not lower the 100-year flood level on Downs and Eden Park
pond. The plan to place pipes to lower the ponds would cost $1,000,000.
The VBWD would assess the affected people.

12.UNFINISHED BUSINESS
13.CITY ADMINISTRATOR'S REPORT
A. Wildflower Shores Park Dedication Fee
Staff met with Scott Renne regarding the appraisal done for Wildflower
Shores. Mr. Renne had appraised the Carriage Home property, not the
Stillwater Investment property and the result was the established value of
$20,000 per acre. Then the resale from Stillwater Investment to Carriage
Homes IX, Inc., was brought to Mr. Renne's attention and he revised his
report using the applicable Certificate of Real Estate Value, which shows a

land value of $15,000 per acre. Staff recommended that the park dedication
fee be based on the appraisal's recommendation of $15,000 per acre.
Mark Vargo, representing Rehbein Co, reiterated what their appraiser, Mr.
Dahlen, stated at the last Council meeting land value of $13,500 per acre.
M/S/P Armstrong/Dunn — to accept the appraisal of Scott Renne for
Wildflowers Shore with the land value of $15,000 per acre. (Motion passed
5-0).
B. Update on Meeting with Washington County Board of Commissioners
The City did not dispute the traffic at the intersection of County Road 13/10
needs controlling, but proposed an alternative of a roundabout, which is
more in keeping with maintaining the City's rural atmosphere. The
Commissioners thought a roundabout was an innovative idea, but who
would be responsible for funding and conducting a safety study of the
roundabout alternative. Council members Hunt and Armstrong will attend a
workshop on other street items on Wednesday at 1:30 with Don Wiesnewski
and Doug Fisher. A suggestion was made to take Washington County's
study they are using for the area and have TKDA interpret report.
C. Advertising in City Newsletter
At the budget public hearing the Council discussed the appropriateness of
advertising in our City Newsletter. Advertising was originally suggested to
help offset the cost of preparing, printing, and distribution the Newsletter,
but was done with a condition for review. The newsletter editor provided a
memo showing prepaid advertisements until April, 2001.
M/S/P Dunn/DeLapp — to look into the status of printing and advertising in
the City's newsletter the first of the year when year-end final costs will be
available. (Motion passed 5-0).
D. Street Lighting
The City does not pay out of City funds for streetlights on private property
per Finance Director Banister. The City should only consider lights if it
affects health, safety and welfare of residents.

Council member DeLapp provided the following comments: If safety is
reason for installing a light, why are we waiting for local residents instead of
developers/police and engineers telling us where to put street lights.
If safety/police/Engineering is reason, why are people within 300 ft. paying
for installation when the travelling public is the beneficiary?
If people live in and move to Lake Elmo to take advantage of rural character,
why are there any streetlights except where imposed by County and State
Highway safety concerns?
The County and State pay for all lights on County and State roads if they
determine the lights are required because of their action building fast, wide
roads.
City to pay all costs where light is needed for safety, police and engineering,
but threshold of minimum vehicles per day on major roads and minimum
vehicles per day on minor roads must be met. Also, lights on Lake Elmo
Ave and in front of City buildings, fire hall, parks building in the public
interest.
Electricity for existing lights requested by residents who feel more secure
with a City light must be paid for by requesting property owners and all
owners within 300' must be agreeable to construction of lights. No lights in
subdivision on City property unless 12' high or lower.
M/S/P Armstrong/Dunn — to direct staff take comments from tonight's
meeting and draft new street light policy because the current one is 15 years
old, and requested recommendation on what type of intersections should be
lit, an inventory of lights are not necessary for the safety of the travelling
public, and to bring original draft to Council with PZ comments, with
deadline of first meeting in April. (Motion passed 5-0).
E. Employee Pay Plan
Administrator Kueffner provided the Council with a proposed employee step
pay plan for 2000 and 2001 with an explanation of the pay plan policy in her
memo dated November 16, 2000.

M/S/P Siedow/Dunn — to adopt the submitted 2000 pay plan. (Motion passed
3-2:Armstrong would like more information; DeLapp gets mixed signals
with proposed COLA.)
M/S/P Armstrong/Dunn — to establish a workshop on total employee
compensation the first quarter of 2001. (Motion passed 5-0).
Council member Dunn thought the City deleted the ($2000) donation for
community volunteers services.
M/S/F Siedow/Dunn — to take out the $2000 for community services.
(Motion failed 1-4:Dunn, Hunt, Armstrong, DeLapp: This is too late in the
game to change the budget for this.)
M/S/P Dunn/Siedow — to suggest sliding the $2000 from Community
Volunteer Services over to a building reserve. (Motion passed 5-0). Council
member Armstrong said this budget has too many reserves and next year she
will not vote for this amount in reserves.
M/S/P Siedow/Dunn- to adopt Resolution No. 2000-065, A Resolution
Approving the Proposed 2000 Tax Levy, Collectible in 2001, General Fund
$1,427,500.00, Levy $1,427,500.00. (Motion passed 5-0).
F. Tartan Park Sign Replacement Plan
The City received a letter from Wayne Sandberg, Traffic Engineer for
Washington County regarding a proposal made by 3M to replace all road
signs on the noted roads in the Tartan Park area. 3M has offered to pay for
these signs, an estimated cost of $1700 with the City picking up the
installation cost of approximately $500.
M/S/P DeLapp/Armstrong — to advise Washington County of Lake Elmo's
desire to accept the offer made by 3M for the replacement of signs within
the Tartan Park Area, and check into if our maintenance dept. can put up
signs, then do it. (Motion passed 5-0).
G. Request for Support of T.R.A.C.

M/S/P DeLapp/Dunn — to direct the staff to write a letter to the Governor
and our Legislators supporting the efforts of T.R.A.C. as proposed in their
letter of October 26, 2000. (Motion passed 5-0.)
H. Strategic Planning
The Council asked if the staff had a list of resources to lead them through
this process. Goal Setting will be added to next agenda.
I. Status of Shaeffer CUP
The Council reminded staff it needed to review the conditions of the
Shaeffer Mining CUP to address concerns brought forth by Council and
residents.
