PRESENT: Dunn (arrived 7:05 p.m.), Hunt, Armstrong, DeLapp, City Attorney Filla, City Engineer Prew, Building Official Jim McNamara, Maintenance Foreman Dan Olinger and Administrator Kueffner. (Motion passed 4-0.) LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 20, 2001 2. MINUTES: February 6,�.J01 M/S/P Armstrong/DeLapp - to approve the February 6, 2001 City Council minutes, as amended. (Motion passed 4-0). 3. CLAIMS The Claim for $625 Gunnar Isberg & Assoc, Planning Seminar session will be taken out of the in -training budget. This training was in lieu of sending commission members to Earl Brown Continuing Education Center for a planning seminar. M/S/P DeLapp/Armstrong — to adopt Resolution No. 2001-08 approving Claim # 18506 through 18543 in the amount of $161,220.19. (Motion passed 4-0). 4. PUBLIC INQUIRIES/INFORMATIONAL: 5. NEW BUSINESS 6. CONSENT AGENDA: 7. MAINTENANCE/PAR/FIRE/BUILDING: A. Update on Maintenance Dept. Activities: Dan Olinger Dan Olinger reported there is a possible watermain break in the Old Village because the water use has doubled. He asked that residents call the City identifying where frost heaves are located in city streets. B. Update on Fire Dept. Activities: Greg Malmquist was called out on an emergency. C. Update on Building Dept. Activities: Jim McNamara Summary Building Report for January 2001: 6 New Residential, 12 Other Residential, 15 Plumbing Permits, 12 HVAC Permits. Jim McNamara reported building permits are coming in fast in an attempt to beat weight restrictions. The Machine Shed restaurant's grand opening is Tuesday, February 20".'It is not the city holding up the building permit for Country Coffee on Lake Elmo Avenue, but its because no site plan has been submitted. 8. CITY ENGINEER'S REPORT: A. 50`h Street Design Options Tom Prew reported in his February 15th letter, what he thought the consensus of the design from the February 13`h workshop with the residents. Prew proposed the following: 1. A 26-foot wide parkway section, 9-ton design, MSA Street. 2. An 8-foot wide trail from the trail within Tana Ridge toTH5. 3. Because there will be no trail west of Tana Ridge, the design in that area would include some slight curves in the road in order to break up the sight lines. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 20, 2001 4. Street runoff to be infiltrated with stormwater gardens and in existing low area along the road. Storm sewer is not anticipated. 5. Trees to be planted with the media areas, and at other locations where they will aid in traffic calming. Prew asked for authorization to prepare a final plan for review with the Feasibility Report. Changes could be made after that, however, he asked that everyone is clear on what will be built once the decision is given. Mayor Hunt read the letter, which is made part of the minutes, from Mary O'Brien, 11311 50t' Street. Rebecca Tenpas voiced her opposition to curb and gutters and requested the shape of the intersection at Tana Ridge be changed. She was not in favor of the bike trail and wanted some say of what plantings are in the center islands. Gary VanCleve, President of Fields of St.Croix Assoc., supported the proposal and felt it was a reasonable compromise. Maintenance Foreman Dan Olinger voiced his opposition to the center islands because of drifting, limits visibility, and when the snow melts the road becomes slippery when melts and freezes. The 301h Street center island has become a maintenance nightmare. M/S/P Dunn/DeLapp — to adopt Resolution No. 2001-09, A Resolution ordering the preparation of a feasibility report for the improvement of 50th Street from State Highway 5 to County Road 17 identified as Option 4, as amended by the City Engineer's memo dated February 15, 2001. (Motion passed 3-1:Armstrong: opposed to center islands, parkway and trail, but in favor of a 9-ton road.) Tom Prew reported it would be four weeks before the Council would receive the Feasibility Report. The Council asked Dan Olinger to review report and submit his input and address concerns on center islands. 9. PLANNING, LAND USE & ZONING: A. Site Plan — Frauenshuh Company for Park Dental At its February 121h meeting, the Planning Commission recommended approval of the site plan application for demolition of an existing building and construction of a new brick faced dental office building of just over 10,000 sq.ft. The site is zoned Business Park, within the MUSA and served by both public water and sewer. The approval recommendation was subject to conditions. The site is a lot of record that predates the Business park zoning. When BP zoning was adopted a 3 acre minimum parcel size was LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 20, 2001 specified, together with a 10,uo0 sq.ft. minimum building footpniA. The subject parcel is 1.4 acres in the area. This item will be added to a Council agenda when the Planning Commission makes a motion on the variances. M/S/P Armstrong/DeLapp — to postpone approval of the Site Plan for Frauenshuh Company for Park Dental at 9880 East Hudson Blvd. until the review by the Planning Commission. (Motion passed 4-0). 10. CITY ATTORNEY'S REPORT: A. Reco, Inc. regarding Future Land Use Map in the Draft Comprehensive Plan Attorney Filla has submitted his response to the request of Reco, Inc. to the City Planner to be heard regarding the Future Land Use designation of their property on the corner of I-94 and CSAH 17. This item will be on the March 6 Council agenda. 11. CITY COUNCIL REPORTS: Mayor Hunt announced there would be a Met Council Rural Issues meeting on Wednesday, 1-3 p.m., Marc Huginen, Chair. The Council asked our City Planner to give an update as to his perspective. Representative Eric Lipman (56B) submitted a bill that would restrict the Met Council's ability to approve Comprehensive Plans. Councilman DeLapp advised the City that David Hartwell who runs Belwin has 1,000 red pines about 10 feet tall that need to find a new home or will have to be cut. The City can have them for the cost of removal. Steven recommended that one or two groups could consider purchasing a tree spade and could plant 1,000 trees along Highway 36, I-94 and Highway 5. The Council expressed concern on the risk in planting 10' trees, the expense to move them and made the following motion: M/S/P DeLapp/Armstrong — to recommend the Parks Commission restart tree planting program for city properties. (Motion passed 4-0). Council member Dunn commented on the wonderful planning presentation by Professor Gunnar Isberg, but it was unfortunate that the new member of the City Council and Planning Commission were not able to attend. There was an article in the St. Croix Valley Press on Dale Faust, Lake Elmo barber. Council member Armstrong apologized for notices not being sent out on the composition change to Special Project members of the Village Commission. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 20, 2001 Council member DeLapp ap6iogized for accusing the City website of advertising the Grand Opening of the Machine Shed Restaurant. There is another website (lakeelmo.com) that is a mock of our government website, and they should distinguish themselves a little better and should make an honest effort to provide information about our City Mayor Hunt responded we have to be very careful because its easy in the web world to create a website that looks like somebody else's and use it to push information out. For every piece of good information on the web, there is another piece of bad information on the web. He suggested looking into web URL. 12. UNFINISHED BUSINESS: 13. CITY ADMINISTRATOR'S REPORT: A. Cimarron Park — Bus Service Administrator Kueffner reported the portion of Metro Transit Bus Route 63 serving Oakdale and Lake Elmo and stopping at Cimarron Park will be discontinued on June 9, 2001. Route 294 service will continue. This does not mean that Cimarron Park residents, who depend on metro transit for their transportation, will have to search for alternative means of transportation. The Metropolitan Council has developed several new programs which they feel will provide better and more cost-effective transportation services to the Cimarron Community. A meeting will be held on Thursday, March 8, 7:00 p.m. in the Cimarron Park Community room for the interested Cimarron residents and the Metropolitan Council Transportation and Transit Development staff. If a second meeting is needed, it will be held at Oakdale Jr. H.S. The Met Council will be placing a notice in the newspaper. There are residents from surrounding communities that drive to the Park and Ride lot and use the bus service. Council member DeLapp asked what do we pay for bus service and requested an explanation of the tax capacity system. B. Strategic Planning The Council was asked to provide a summary of issues it felt should be discussed during our Strategic Planning session, but Administrator Kueffner has received only one response. The following firms that do Strategic Planning: Linda Giesen of the Milestone Group Don Salverda Jim Brimeyer County Extension Programs Cincinnatis LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 20, 2001 The Council asked the City Administrator to write a letter, which will be reviewed by the Council for its comments, and sent to these firms asking what strategic service could they provide and how would they deliver services efficiently to our residents. The "Code of Conduct for Elected and Appointed Officials" will also be included as an issue to be discussed. Council member Armstrong added she didn't want to spend a lot of money on this project. C. Letter to Editor on repealing sales tax on local government purchases The City received a memo from the League of Minnesota Cities asking that we participate in the effort to repeal the sales tax on local government purchases. The Council supported repealing this sales tax and would agree that the money would be better spent here meeting our community and citizen's needs and priorities and will be stated in a letter sent to the Editors of the three local newspapers. D. VBWD Update Administrator Kueffner reported that Jeff Berg, Washington County Soil and Water, updated staff that the City of Afton will present an amended plan to include 1 % rate and volume to the VBWD.
