CITY ATTORNEY' S REPORT: I LCITY COUNCIL REPORTS: 12.UNFINISHED BUSINESS: 13.CITY ADMINISTRATOR'S REPORT: A. Hotel Tax Mayor Hunt called the meeting to order at 7:00 p.m. in the Council chambers. PRESENT: Siedow, Dunn (arrived 7:05 p.m.), Hunt, DeLapp, City Planner Dillerud, Administrator Kueffner, and Building Official Jim McNamara. ABSENT: Council member Armstrong L AGENDA M/S/P Dunn/Siedow — to approve the March 20, 2001 City Council agenda, as amended. (Motion passed 3-0.) 2. MINUTES: March 6 2001 Council member DeLapp: Page 7: E&H Earthmovers. The discussion he prompted is not included. Based on Roberts Rules of Order we are not able to bring the ordinance up for reconsideration allowing a special variance for one applicant to put an industrial site 50' from the propertyline. There is no LAKE ELMO CITY COUNCIL MINUTES MARCH 20, 2001 reference to the fact that we violated Roberts Rules of Order. The applicant told him that the open space would be kept open for 15 years. Is the intent to have everything screened a requirement or not? If interpretation by Council is different, this will be added as an agenda item. M/S/P DeLapp/Dunn - to postpone approval of the March 6, 2001 City Council minutes until the April 3rd Council meeting in order to have the recording secretary address minutes related to E&H Earthmovers. (Motion passed 4-0.) 3. CLAIMS M/S/P Dunn/Siedow — to adopt Resolution No. 2001-017, Claim Numbers 18587 through 18622 in the amount of $63,944.14. (Motion passed 4-0). 4. PUBLIC INQUIRIESANFORMATIONAL Charles Schneider, new resident in Hamlet of Sunfish, asked for interpretation of the lighting code in reference to clarify standards for interior lights in a screened porch and outside lighting. The Building Official would not give him a Certificate of Occupancy until the interior lights in his screened porch and outside lights were removed. Council member DeLapp advised that the intent of the lighting ordinance is to protect adjacent propertyowners and the traveling public from unwelcome glare of uncontrolled exterior lighting. The Council gave the interpretation of any structure -enclosed, glass or combination thereof, would constitute as an interior. M/S/P Dunn/Siedow — to direct staff to bring back an ordinance amendment to incorporate this interpretation and clarify interior lights in an enclosed structure, such as screened in porch, alcove area. (Motion passed 4-0). Mr. Schneider stated security lighting is his concern. Derrick Construction, his contractor, did not file with the City a lighting plan, and now he will have to get new exterior lights. Building Official Jim McNamara responded that Derrick Construction has a copy of the lighting ordinance and has done work in the City. It's the builder's responsibility to pass the lighting ordinance onto the homeowners. Council member DeLapp explained there is about 8 fixtures from Menards that meet the lighting code. He doesn't want to see the glare, to have light pollution, but to keep down the pockets of glow. Some homes have 6 to 8 lights that have hot spots pointing to their LAKE ELMO CITY COUNCIL MINUTES MARCH 20, 2001 2 neighbors. If motion sensor lights are to be considered, Mayor Hunt stated the lights should be a hooded light and project the light down and not into the treetops. M/S/P Dunn/Siedow — to revisit the lighting ordinance to consider including installation of motion sensor lights for security purposes. (Motion passed 4- 0.) 5. NEW BUSINESS 6. CONSENT AGENDA 7. MANTENANCE, PARK, FIRE, BUIIDING A. Update on Fire Dept. Activities: Greg Malmquist, Resolution approving appointments The following members of the Lake Elmo Fire Department were elected at the January 16, 2001 meeting: Brad Winkels Assistant Chief (2 Years) Dave Durow Captain (2 Years) Rich Springborn Captain (2 Years) Doug Pepin Captain (1 Year) M/S/P Dunn/DeLapp — to adopt Resolution No. 2001-016, A Resolution Certifying the Lake Elmo Fire Department's January 16, 2001, Election of Officers. (Motion passed 4-0). B. Update on Building Dept. Activities and Code Enforcement: Jim McNamara Jim McNamara provided a summary building report. February 2001: 12 New Residential permits, 19 plumbing permits, and 2314VAC permits. Council member DeLapp acknowledged that the Bldg. Inspector followed the intent of the lighting code. The Council drew the line as to what's inside and outside. A follow-up letter to the contractor was suggested letting them know this issue came up. 8. CITY ENGINEER'S REPORT: A. 2001 Sealcoating Program LAKE ELMO CITY COUNCIL MINUTES MARCH 20, 2001 Council member DeLapp pointed out for those that live on the roads that are going to be sealcoated can't use rollerblades on these roads. Paved shoulder with angular crushed rock proves dangerous for kids to fall off their bikes onto the sharp road surface. What other material can be used to be safe for snowplows because this doesn't address it. Council member Dunn suggested this be brought up to the City Engineer to discuss options when it comes back for quotes. M/S/P Dunn/Siedow — to approve 2001 proposed street sealcoating program. (Motion passed 4-0.) 8. PLANNING LAND USE & ZONING: None 9. CITY ATTORNEY'S REPORT: 10.CITY COUNCIL REPORTS: Mayor Hunt reported the Principal Land Use Coalition meeting on "What is the Future of our Suburbs?" on March 21. There was a Cluster Housing article in the St. Croix Valley Press. He attended the meeting on bus service with Cimarron residents, Marc Huginen, and Metro Transit. The proposed solution is carpooling or working them into other vanpools. The cost will never be higher than $75. There were 5 people besides staff in attendance. Hunt thought there was a need for reliable bus service for a larger period in the day, not just to and from work. There is a need to revisit bus service route and apply creativity to help. DeLapp suggested the City should announce the opportunity of vanpool service to all areas of the city, such as, Tri-Lakes, Tablyn Park. Council member DeLapp provided the Planner photos of a traffic circle near Austin, Texas. These are all over Boston and you never see a traffic light where new roads are being built. Council member Dunn attended the meeting with Holston and Bachmann, good exchange of information at the capital. In the St.Croix Valley Press, March 15 article on former Council member Dick Johnson worked on the Pioneers of the Big Lake Community, History of the Big Lake area. I LUNFINISHED BUSINESS: LAKE ELMO CITY COUNCIL MINUTES MARCH 20, 2001 4 Planner Dillerud received an Invitation from EPA to participate in an audio conference in May on recent federal legislation on religious uses. Community Block Grant: we are going to be funded this year beginning July 1. Administrator Kueffner reported there is a bill,co-authored by Rep. Eric Lipman, for off year elections. Lake Elmo always has a good voter turnout and the Council did not support off year elections and will let the legislators know its opposition. 12.CITY ADMINISTRATOR'S REPORT: A. Hotel Tax Council member DeLapp brought up local tax on hotels and thought it was automatic for local cities to get tax, but that is not the case. There are 50 cities in MN that are participating in a law that allows a City to collect up to 3% tax on a hotel bill, providing that the money is used to promote tourism. We can take a regional approach or a local approach. What is the definition of this? There is an opportunity for free money to improve the tourism economy of the region. The Administrator will add the statute as an agenda item for the next Council meeting.
