ITEMS FOR DISCUSSION MINUTES OF LAKE ELMO VILLAGE COUNCIL MEETING TUESDAY MARCH 6,1973 Meeting called to order at 7:45PM by Mayor Brockman, Present:Brookman,Abercrombie,Watson,Shervheim,Friedrich,Park & Mehsikomer, Also present:Counsel Raleigh,Enginser Bonestroo & Bldg, Insp, Mueller, Motion by C,Shervheim 2nd by C,Abercrombie that .minutes of the February 20,1973 meeting be.approved as submitted. Carried 5-0. William Parks addressed the council and advised that he was involved in a scout jamboree that would be taking place at the Washington County Fair Grounds on May 405 & 6, He requested that the village make available a method of disposing of the excess refuge which might result from 1500 campers, Council agreed that it would supply some method of disposal. Further suggestions were that village put up a sign welcome to Lake Elmo, It was suggested that possibly the Lions might make this available, William Wacker spoke on behalf of the Fire Department asking for the use of the street area in front of the fire hall for a street dance on June 29,1973 from 8;30PM to 12:30AM, They would be nerving 3.2 beer and setups and food. Matter was turned over to counsel to see if any problems existed. Counsel to report back at the next meeting, Charles Weinke presented a petition to the council asking that the street now having different identification at each end of the street be renamed to its original name; specifically that portion of 45th St, North which is adjacent to Lake Jane and starts where it connects with Lake Jane Trail and'.runs to where it intersects with Lake Jane Road, Eighteen of twenty homeowners on this street signed the petition. Based an the reasons stated in -the petition 404atson moved and C,Abercrombie seconded that the name of the road from Ideal to Lake Jane Road now known as Lake Jane Trail and 45th St, N. be known only as Lake Jane Trail. Carried 5-0. Clerk advised to relay this information j to the county surveyors office. Counsel advised that this matter should be handled as A RESOLUTION and a copy of this will have to be forwarded on to the surveyor. Council on a motion from C,Abercrombie 2nd by C,Shervheim approved the expenditure of up to $600.00 to send two members of the fire department to fire school scheduled for early this summer. Fire chief to determine who will attend, Carried 5-0. A new contract for police protection with the Washington County Sheriffs office was received. Motion by C.Abercrombie 2nd by C. Shervheim to allow mayor and clerk to ex- ecute contract if it met with counsel®s approval Carried 5-01 Council has received an Invitation to hold one of its meetings at the Cimarron Com- munity building, Motion by C.Abercrombie 2nd by C.Watson that the council accept the Invitation and schedule the meeting of April 3,1973 to be held at Cimarron. Carried 5/0, Clerk to notify Tom Backstrom so that necessary arrangements can be made. Motion by C,Watson 2nd by C,Abercrombie that the council approve the installation of tfi-ethvve additional 175 watt mercury lamps In tablyn park according to the study and recommendation made by Mr, Frank Graham of NSP, Cost of the three lamps Is 3.95 ea. Carried 5-01 Clerk to advise NSP to proceed with installation and also to send a letter to, Mr. F.Graham informing him.of the need for service in the Pebble Park area for lights and for a pump that will be Installed this spring, Motion by C.Shervheim 2nd by C,Abercrombie authorizing payment of bills for the montP of February. Carried 5-0. MINUTES OF THE LAKE ELMO VILLAGE: COUNCIL MEETING TUESDAY. MARCH 6,1973 pg.2 NSP has proposed a 9" high pressure gas main through the Village of Lake Elmo (map on file in clerk's office). Motion by C.Watson 2nd by C.Abercrombie to approve the installation subject to approval of whatever legal action that may be involved, carried 5-.0. Carl. Rudeen and several of his neighbors asked the council if they could be serviced by -the sewer system in section 32 and what it would cost. Council requested the citizens involved and interested -to submit a petition asking for service. Motion by C.Watson 2nd by C.Abercrombie authorizing Bonestroo to proceed with a preliminary engineering study to determine the best method of serving this area, Carried 5-0. Motion by C.Shervheim 2nd by C.Watson to advise Watershed District that the Kennedy incident has brought to our attention that they control the flood plain and lakeshore area and polution control is dependent on their judgement. It is up to them to screen the request and make recommendations. Carried 5-0. Clerk to send copy of ordinance. Motion by C.Watson 2nd by C. Shervheim authorizing counsel to initiate legal proceed- ings against Mr. Landra for failing to comply with council order and being in vio- lation of village ordinance, Carried 5-0. Steve Herwitz of the Minnesota Highway Dept, spoke in behalf of Mr. Ray Salus. A g6ick take order ordering Mr. Salus to move out of his home by May 15,1973 was issued by the state. Mr. Salus would. like to set up a. temporary mobile unit to be attached to the electrical and the sewer facilities presently on the property at 4014 Lake Elmo Blvcd. N. Motion by C.Shervheim 2nd by C.Watson to approve the issuance of a Special Use Permit for a mobile home at this address to expire November 15,1973. Mr. Salus mobile home must comply with all the requirements for a mobile home trailer of the state building code. Carried 5-0, Motion by C.Abercrombie 2nd by C.Shervheim to approve the Special Use Permit for a swimming pool for Mrs. Ludwig subject to all the requirements as to overhead wiring, non climbable fence etc. Carried 5-0. Next meeting March 20,1973 to start at 5100PM, Motion by C.Abercrombie 2nd by C.Shervheim to,, appoint Mr, Jack Zi.gnego -to serve out the unexpired term of Mr, Fran Pott on the PZC, Carried. 5-0. Letter received from John Raisenen advising that he is forced. to resign from the PZC as he is moving from the village. Clerk instructed ti) issue a letter of apprecia- tion for time spent in service to his community. Motion by C.Abercrombie 2nd by C.Watson to adjourn at 10;20PM. Carried 5-0. Respectfully submitted Donald Mehsikomer Village Clerk Lake Elmo, Minnesota March 6,1973 Hearing on Road Improvements Meeting called to order by Mayor Brookman at 7:OOPM in the Lake Elmo Village Council chambers, Clerk read the notice of publication and verified that all property holders had been notified by mail of the hearing. Present were all members of the council plus the engineer and village attorney. Mr.&Mrs,Garl Stampfla 2005 Thom Drive St, Paul Bruce Folz 8488 Stillwater Blvd, N. Dorothy Lyons 10th St, N. Tom Schwartz 9515 10th St. N. Otto Bonestroo, Village Engineer, advised the general scope of the project. He advised why the road was proposed for the location . that it would. be in the best interest of all involved to have this work contracted along with the state on 1 94 to reduce costs and what problems were encountered in determining the exact roadbed area. It was the estimate of the engineer that each landowner would probably be assessed at $22.00 per front foot if assessment is on a front foot basis. This determination would riot be made until the assessment hearing. Mayor invited questions and comments from the floor asking that each person identify himself for the clerk's records. 9..Garl Stampfle How is property for road to be acquired? Answer. Some of the property is scheduled to be givers by Decoster & Gonyea the final determination on the balance yet to be made, Attorney advised that if agreement could not be reached on transfer of property the lest recourse was for the village tib Initiate condemnation proceedings if a road was determined to be in the best interest of the citizens of the village, 2.Bruce Folz - What type road are we thinking about? w Answer: Ultimately we plan on a 9 ton road- 2 lane - limited access. Road would have a 14" base and a 3" surface, The road would be 40, shoulder to shoulder with 24' of bituminous surfacing. 3.Bill Brochman - Why not a itraight road? Answer: The road was as straight as practicae. The first stretch came directly from the I 94 exit to the North -South line of the road. The jog at the North end of the ,road just before Hwy 70 was necessitated because an area of peat with a depth of 14' was found in the straight path of the road and this would have been very expensive to remove and replace, The slight jog was determined to be a more practical approach, 4.Carl Stampfle - How much land is to be acquired for the road? The required roadway would be 120' wide, 5.Carl Rudeen - Since the developers are the ones that are pressing for the road then lot Gonyea & Decoster pick up tlse'tab for the road since they will be the ones t hat March 6,1973 Hearing on Road Improvements pg.2 benefit from the road -the most. It was pointed out that regardless of what we do regarding the extension of the new road at this time Gonyea & Decoster will put in the road up to a point but they will not put in all of it. If we decide to let the road go for now, it will, when we de- cide to extend it be a heavier cost 'burden than it would be now, 6,Irvin Beyl - Agreed with Mr. Rudeen that devel,;,opers should put in road, Marl Stampfle - Doesn't the council realize that what they are doing is forcing Homer Dreher out of his home and property. Similar comments were voiced by Beyl and Rudeen. Mayor explained that we are not trying to move anyone out. He did point out that if all improvements were turned down because someone may be adversely affected then we would have to turn down every proposal that was submitted, 8. Carl Rudeen - What is the significance of the red and blue area on the map? Red area is the road area, the blue is just a strip map taken from a total sectio n, % unidentified - Why is the road not placed on the section line? Engineer advised that we were limited as to the road placement because of the 694 proximity by the state hwy dept, Carl Stampfle - What about Oakdale extending the road? Village has been lead. to believe that Oakdale will extend the road to the North, Unidentified - When would the road begin? Would it be this year,1974,1975? If we proceed we would want to go out on bid at thd.same -time as the state on 194 which is scheduled for taking of bids on ,Tune 22, 1973. If we meet this schedule a good portion of the roadwork'':, would be under construction this year, i Mayor called for further comments once.
