1 Meeting called to„order at 7:30PM by Mayor Brookman.
Present:Brookman,Abercrombie,Watson,Friedrich,Park & Mehsikomer. Absent:Shervheim
Alsp present:Bldg.Insp.Mueller,Counsel Raleigh and Engineer Bonestroo.
Counsel Raleigh introduced Phil Nicolai who was hired indirectly by the village to
codify all village ordinances.
Motion by C.Watson 2nd by C/Friedrich to accept the minutes of the June 19,1973 meeting
as submitted. Carried 4-0. C.Shervheim absent.
C.Watson presented Resolution R 73-26 ordering the Jamaca Court improvement and requested
council approval. Second by C. Friedrich. Passed unanimously by those present 4-0.
Council had discussion regarding the 33rd.Street Lane N. Question of whether to put in
complete improvement since watermain was not in the South or East part of the road.
C.Abercrombie presented Resolution R 73-27 limiting the project to laying down a 6"
road base with sealer applied. Approximate cost of assessment for this partial improve-
ment is�?$3,000. Second by C.Watson. Passed unanimously 4-0.
Counsel advised that election has been set up for August 14,1973 at Washington County
Fair Grounds for residents in the affected area to vote on annexation from Baytown to
the Village of Lake Elmo. Baytown is appealing the annexation and election may be
cancelled or delayed however the Village of Lake Elmo will proceed las if appeal is
rejected.
Motion by C.Abercrombie 2nd by C.Friedrich authorizing clerk to pay claims that have
been received for the month of June. Carried 4-0.
Engineer recommended that council accept the low bid for the utility crossings of I94
from A.J.Chromy Construction Company at $33,150.00. C.Abercrombie presented Resolution
R 73-28 accepting the low bid of A.J?Chromy Company and asked for council confirmation.
Second by C.Friedrich. Resolution carried unanimously 4-0.
Council reviewed the report from Twin City Testing regarding quality of water in the
Tri-lakes area. Village engineer staff will be surveying all known sceptic system
problems. Clerk to advise press if any residents have information they would like to
report on defective systems they can do so by calling Mr. Noyes (636-4600) of Bonestroo
Engineering. All calls will be handled on a confidential basis .
Motion by C.Watson 2nd by C.Abercrombie that engineer be given authority to continue
testing lake samples on a monthly basis until we get more conclusive information.
Carried 4-0. Next sample will be taken week of July 23,1973.
Motion by C.Abercrombie 2nd by C.Watson to approve amending the Cimarron Special Use
Permit to include the installation of a 30' weather warning tower which will be activated
by the National Weather Service. Approval subject to the following: 1.Final OK of plan
by village engineer; 2.Location a minimum of 50' from lot 479; and 3.Installation of an
8' non climbable barrier all around the tower. Carried 4-0.
The G.Lundholms appeared relative to launching of boats on Lake Elmo. The launching
area is zoned residential and they maintain this is a commercial operation. Counsel
asked to research matter and report back to council by August 7,1973 meeting.

Motion by C.Abercrombie 2nd by C.Watson that meeting of council of July 17,1973 be re-
instated to include tour of proposed park land at 4:OOPM and a short business meeting
at 9:OOPM in Village Hall to discuss Helmo Ave. improvement. Carried 4-0.
Don Durand operator and owner of Pierre's Pier submitted application for a 3.2 ON -SALE
beer license. Objections were received verbally from Mrs.Lundholm and Mr.Tom Keller.
Counsel to research and report back at August 7,1973 meeting on what is required.
Mike Ferderer appeared regarding solution to water drainage problem at the North end of
8350 38th Ave.N. Estimated cost of engineer recommended solution is $3,400. Mike was
informed that cost of improvement would be his to bear and if he decided to go along
with it village would arrange for easement for drainage ditch. Mr. Ferderer said he
would check and determine what action he would like -taken ----- — - ---
Mr.Bradley and 34 individuals appeared relative to RAPP I-94. Most of those present were
sympathetic to RAPP I-94 objectives. Mike Finneman voiced his opinion of opposing this
group and in favor of I-94. After listening to presentation council advised that they
would take the matter under consideration. Request for an immediate decision met with
reply that council would give matter consideration.
Hammes Special Use Permit -Gravel Mining extended on a temporary basis until village
engineer has an opportunity to inspect area to determine compliance with terms of the
original permit.
Motion by C.Watson 2nd by C.Abercrombie to extend moratorium on lake shore building for
additional 30 days (August 15,1973) to allow time for counsel and engineer to complete
Shoreland Management Ordinance. Carried 4-0l
Motion by .Abercrombie 2nd by C.Watson to approve Special Use Permit for a 6,000 gal.
oil tank, above ground, immediately North of garage building of Brookman Motor Sales
Inc. at 11144 Stillwater Blvd. N. with no diking required. Motion carried 3-0 with
Mayor Brookman abstaining because of his relationship to request.
C.Watson presented Resolution R 73-25 authorizing condemnation of property for Minnehaha
-694 interchange at such a date as engineer determines that we must act. second by C.
Friedrich. Carried unanimously 4-0.
Clerk read letter from Joseph Moris Jr. denying the village the rights to pump any
water from Lake Jane onto his property. Since approval of all affected landowners was
a requirement of the motion to pump Lake Jane pumping could not be carried out.
Clerk reported that brush is being hauled to Pebble Park by unknown individuals. News
media to be advised that this is in violation of village regulations and anyone caught
dumping material on this location will be prosecuted.
Motion by C.Abercrombie 2nd by CFriedrich to approve expense of up to $350. for assessor
to attend annual assessors school in Minneapolis from August 20 thruAugust 24.1973.
Motion carried 4-0.
Motion by C.Watson 2nd by C.Abercrombie to adjourn at 11:23 PM. Carried 4-0.

Meeting called to order at 7:10 P.N. by Mayor Drookman.
Present: Bookman, Abercrombie, Watson, Shervheim, "ark and.P°ebsikomer.
Absent: Friedrich
Also present -- Counsel Raleigh and Engineer Bonestroo.
Jm. Parksand Galen Smith who reside on 3tth and 39th. Streets No., complained
that traffic was using these roads improperly. They reauested traffic signs
indicating that these were not thru streets. Clerk instructed to arranne °or
posting of said signs.
Dick Huspek-- appraiser explained his report on property affected by the proposed.

Engineer explained that bids wore opened June 29 and we have until July 29th to
accept bids and make an award. 3ncineer reauested decision one may or the other.
Engineer gave a summary of the facts on costs as spelled out in. his July 16, 1973
letter. Mr. C. Sigerud, Pd nresota iNY. Dept. advised that state would allow
easement to cross 1-94 property to get to ]Iwy. 12 if I94 doesn't go thru.
Maynard Eder expressed opposition to Helmo 4ve.
iT. Dreher expressed opposition to Helms Ave.
Jim VcClue,attorney, advised that his appraisal di_d not agree with that of Mr. Hospek.
QcClue appraisal by Lafond Co.). Damages are figured at 0)57,000„. If road approved,
would probably oppose on consti.totional grounds.
Engineer again explained reasons for location of road, in its proposed position, and,
also that aashington County and Oakdale bad both agreed with its location with future
construction to continue road North.
C. Shervhe_i_m presented Resolution R-73-29 requesting that the Village proceed with
award of bids to low bidder on Friday, July 27, 1973 provided that by that time clerk's
office has received written agreements from the owners of Gonyea and. IleCoster parcels
donating right-of-way and agreeing to turn over the award of 158,560. from the State
of Einnesota ror construction of the 12001 access road and provided the State of
Yinnesota files a letter with the clerk indicating agreement to nay award for that
purpose and asked council confirmation. Second by C. Watson.
The following voted in favor: Brockman, Abercrombie, Watson and. Shervheim.
Against-- none. C. Friedrich absent. Resolution carried.
Motion by C. Abercrombie 2nd by C. Shervheim that we approve Special Use "ermit
for Lyle Slawson allowing a mobile home on the John Kleis farm subect to conditions
set forth by PZC in minutes of July 10, 1973 and also that appropriate sewage system
be installed. Carried 4-0.
