Special Use Permit for Thomas Linrbeck .Minutes of Lake Elmo Village Council Meeting Oct. 16, 1973 Page 1 Meeting called to order at 5:08 p.m. resent: Brookman, Watson, Park and Mehsikomer Absent: Abercrombie, Shervheim and Friedrich Others present: Bldg. Insp. J. Mueller, Counsels D. RAleigh and Phil Nicolai and from PZC Wm. Lundquist and Dorothy Lyons. Codification: The preliminary draft of the codification was reviewed and changes were recommended. Nicolai will review the material and incorporate the changes and have ready for meeting of Nov. 20, 1973. Clerk advised council of quotation on 100 copies of final code. Based on 200 printed sides and having material collated and inserted in #258 Duotang binders cost for 100 sets was $477.75. 200 sets would cost $346.50 per hundred. Bid was received from Mason Publ. Meeting recessed at 6:25 for dinner. Reconvened at 7:02 p.m. Late arrivals: C. Friedrich and Eng. Bonestroo arrived at 7:15 p.m. Minutes approval:Motion by C. Watson second by C. Friedrich to approve minutes of Oct. 2, 1973 meeting as submitted Carried 3 - 0. C. Abercrombie and C. Shervheim absent. T. Lindbeck: File showed that PZC had held a hearing on Special Use Permit of Thomas. Lindbeck. Mr. Lindbeck reported that because of a mis- understanding he was out of town and did not attend hearing. PZC records show that five people showed up to object to issuance of Special Use Permit. Because of misunderstanding council agreed - to permit a new hearing. Mr. Lindbeck will reapply for hearing to be scheduled for PZC meeting Nov. 13, 1973. Attorney John Brandt represented Mr. Lindbeck. Clerk instructed to send Mr. Lindbeck a copy of PZC minutes for meeting of Oct. 9, 1973. Motion by C. Watson second by C. Friedrich to delay action until matter had been reviewed by PZC and until a full compliment of village officials was available. Carried 3 - 0. Nov. 6 Because Nov. 6, 1973 is election day council will delay start of Meeting: meeting until 8:15 p.m. which is 15 minutes after poles close. Graves -access Mr. Graves requested an easement for a driveway across village to property at owned property (100'X 15') from 33rd St. Lane N. 10940 32nd St.N. Resolution R73-34 C. Watson presented Resolution R73-34 establishing a driveway easement from 33rd St. Lane N. to lot at 10940 32nd St. N. since it was in the best interest village as property will be used for utilities. Second by C. Friedrich Carried 3 - 0. Minutes of Lake Elmo Village Council Meeting con';t Oct.16,1973 Page 2 Northbrooke Clerk read abstract of title, in part, where it spelled out convenants Farms: restricting use of property for intended use. Motion by C. Watson second by C. Friedrich that council will not entertain an application for use that Northbrooke Farms proposing until all land owners involved had waived rights of covenants Carried 3 - 0. Walkway Motion by C. WAtson second by C. Friedrich approving an expenditure Chain -Link of 1534.00 for chain -link fence on East and North side of walkway. Fence: Permit requirement waived. Carried 3 - 0. Letter from School Dist. 834 expressing appreciation to Village for action taken on this matter. Helmo Ave. Motion by C. Friedrich second by C. WAtson to approve additional Add'l Cost: expense of $1200.00 on Helmo Ave. project to cover cost incurred in piling trees removed for roadway. Responsibility for this having been imposed on village in condemnation proceedings. Carried 3 - 0. Oace 5th: Clerk instructed to send letter to Mr. and Mrs. Oace with a copy of engineers letter indicating work required before acceptance of road by village and release of bond. 694-Minnehaha C. Watson presented Resolution R73-35 approving proposed plans Interchange submitted for 694-Minnehaha fnterc ange but pointing out that Resolution R73- village still felt plan inadequate. Construction should be a full 35: diamond not a folded diamond. Second by C. Friedrich. Carried 3 - 0. Mayor Brookman read a letter from Hwy. Dept. establishing a Design Public Hearing on this project for Nov. 8, 1973 at District Nine offices. Time 7:30 p.m. Council requested Engineer Bonestroo to attend and present village position on this interchange. Claims: Motion by C. Watson second by C. Fri(drich authorizing clerk to pay submitted claims. Carried 3 - 0. Greg Wulff Greg Wulff who was scheduled on the agenda for 7:30 p.m. regarding 8743 Ironwood: driveway failed to appear. Brush Burning: A burning area, in the center of the newly leveled section, is approved. No official notice regarding brush burning will be given but any inquiries will be answered in the affirmative with directions on where to pile brush. Fire department will handle disposal. Election Clerk reported filings for offices for 1973 election. For Mayor Filings: Incumbent Calvin Brookman and Maynard Eder. For Councilman.Thomas Lindbeck, Conrad Adams, Francis Pott and Norm Wendt. Incumbent Friedrich did not file. Minutes of Lake Elmo Village Council Meeting Oct.16,1973 cont'd. Page 3 Park Letter received from Counsel Raleigh advised that negotiations with Acquisition: L. Friedrich regarding option for park property would be delayed until after Dec. 31, 1973 after his term as councilman had expired. Mayor Brookman and Counsel Raleigh had also talked to owner of property proposed for Reed Park. Property is not available at this time and a commitment has been made to another party who will have first priority. Dog Violations: Mr. Talcott 8051 Hill Trail N. advised that dogs belonging to Herbert Berrisford 8036 Hill Trail N. and Gerald Lien 8066 Hill Trail N. have been dumping garbage and annoying children. Requests letter be sent from village. Clerk to send letter citing ordinance. Street Lights: Mr. Graham has submitted plan for street lights for Legion. Matter to be reviewed at later date. N.S..P. has not as yet submitted a proposal for trouble light at Pebble Park. Adjournment: Motion by C. Friedrich second by C. Watson to adjourn at 9:35 p.m. Carried 3 - 0.
