Dealing with planning costs passed through to developers. 2. Park dedication or in lieu of funds on other than residential development. City position on landfill site proposed in Lake Elmo by Metro Council Staff. Waste Control Commission plans hearing on sewer proposal May 14, 1975 at the Oakland Jr. High. MINUTES OF THE LAKE ELMO CITY COUNCIL MEETING APRIL 1, 1975 pg. 1 Meeting called to order at 7:32 PM by Mayor Eder. Present: Mayor Eder, Councilmen Abercrombie & Pott & Councilwoman Lyons. Absent: Councilman Shervheim (excused). Also Present:Bldg. Insp. Mueller (9:30 PM), Counsel Raleigh & Engineer Bonestroo (9:15 PM). Minutes: Motion by Councilman approve the Minutes submitted. Carried Pott second by Councilwoman Lyons to of the March 18, 1975 meeting as 4-0. Councilman Shervheim absent. Legislation:Hubert Humphrey III has introduced legislation which places excessive controls in the hands of the Metro Council. Lake Elmo just became aware of it. Council to take copy of the bill and review it. A voice opinion poll of all members will be taken and a letter indicating consensus of opinion of the Lake Elmo Council be sent on to the legislature until formal action can be taken at a regular meeting of the council Landfill site: Mayor Eder has been in contact with county relative to the placement of a new landfill site in the Lake Elmo -Oakdale Area (Sections 20,28 & 29-Parts of). The committee has not finalized its decision. A second site of 280 acres is in May Township and a third site of 400 acres is located in Hugo. One advantage to the Lake Elmo -Oakdale site is the proximity to the metro area. It was pointed out that part of the run- off that ends up in Eagle Point Lake drains through this area. File turned over to PZC Chairman Johnson for review. Pebble Park:Park Advisory Board advised that David Kirst would like to make a presentation regarding the development of Pebble Park to the council and members of the PZC. One hour will be set aside during the council meeting April 15, 1975 for present- ation and a question and answer period. (7:45-8:45). Arrangements should be made for larger facilities so adequate space is available for interested citizens. Barton Timber:Mr. Benson & Mr. Auger were on hand to answer questions regarding subject operation. The large chipper was received last December 7. It is not housed but reportedly does not cause excessive noise levels. Equipment does not handle brush but a new piece of equipment is due this week that will handle the brush. Equipment produces 1050 yards per day of chips. The average yds. per ton is 4. Presently 2 acres of trees and brush are stockpiled. New chipper will definitely be noisier than original equipment. Mr. Benson to advise the Lake Elmo Office when equipment arrives on the site. Mr. Benson agreed to have all material 2" and over chipped by April 15, 1975. Mr.Beach will inspect and if material is a biological hazard it will be ordered destroyed.Mr. Benson requested permission to operate during the daylight hours until the material is cleaned up. Motion by Councilman Abercrombie 2nd by Councilwoman Lyons to authorize operation during the daylight hours up through May 1, 1975. Carried 4-0. MINUTES OF THE LAKE ELMO CITY COUNCIL MEETING APRIL 1, 1975 pg. 2 Planning costs:Question has been raised relative to planning costs being charged to developers. Counsel presented report indicating ( that this was adequately covered by the Municipal Code. Park Dedication:Counsel presented memo on current policy. Copies of memo to Park Board & to the PZC. Road Plan: Engineer given approval to work with the chairman of the PZC in updating our comprehensive road plan. PZC Sub -committee: Question from PZC minutes relative to what differences exist between Oakdale and Lake Elmo PUD Ordinances. Counsel Raleigh instructed to contact Oakdale Counsel and determine the extent of the differences and report back to council. Water tank: Motion by Councilman Abercrombie 2nd by Councilwoman Lyons that we should take bids and set opening for bids for painting the interior and the exterior of the water tank for May 6, 1975. Carried 4-0. Engineer advised that specs would be available by April 21, 1975. Sewer: Mr. Jensen of S.D.834 asked about the possibility of the Oakland School hooking up to the Cimarron Sewer System. Motion by Councilman Pott 2nd by Councilwoman Lyons author- izing engineer to explore situation and report back to the council at the April 15, 1975 meeting. Carried 4-0. Roads: Motion by Councilman Pott 2nd by Councilman Abercrombie to have engineer review the gravel roads and come up with a proposal (possibly a five year plan) on retiring the gravel roads. Carried 4-0. Bike Trail: Clerk instructed to direct letter to DNR regarding dust control in the bike trail in Lake Elmo. Claims: Motion by Councilman Pott 2nd by Councilman Abercrombie to approve payment of claims 75176 thru 75206. Carried 4-0. RR Crossing:Motion by Councilman Abercrombie 2nd by Councilman Pout to install stop signs at all RR crossings in Lake Elmo that are not presently posted. Carried 4-0. Richert Gravel Pit:Request from Shafer Contracting to use North exit from Richert Gravel Pit until use of Southern route can be obtained. Matter to be referred to PZC. Board of Review:Clerk advised that county assessor has established May 22, 1975 from 9:30 AM to 3:30 PM for the Lake Elmo Board of Review. The assessor, clerk and council quorum should be present. Adjournment:Motion by Councilman Abercrombie 2nd by Councilman Pott that council adjourn at 11:35 PM.
