Senness Minor Subdivision Approval ITEMS FOR DISCUSSION: Correspondence Payment of Claims VA & FHA reports on water & sewer systems Authorize Sunfish Lake Park entrance Minutes of the Lake Elmo City Council Meeting. June 1. 1976. Meeting called to order at 7:37 pm by Mayor Eder. Present: Mayor Eder. Councilmen Abercrombie. Shervheim, and Pott and Councilwoman Lyons. Also Present: B1dg.Insp. Mueller, Counsel Raleigh and Engineer Bonestroo. Bldg. Insp: Motion by Councilman Abercrombie 2nd by Councilman Shervheim to authorize clerk to purchase a calculator with tape for building inspectors use. Carried 5-0. Parks: Councilman Shervheim advised that the estimate for entrance road to Sunfish Lake Park ran as high as $10,000. Paul Emerson has offered to complete work for $3,000. Motion by Councilman Shervheim 2nd by Councilman Abercrombie to accept proposal of Emerson to complete Sunfish Park entrance road for $3,000. Carried 5-0. Summer help program: Motion by Councilman Pott 2nd by Councilman Abercrombie to engage Dan Olinger at $4.75 per hour, to direct activities of and work with the two summer employees provided by state program. Carried 5-0. Discussion regarding city control and maintenance of VFW Baseball Field. City will continue maintenance as per original agreement. Moris: Request platting 1 acre which houses present farm house but excludes other farm buildings. They will continue as part of farm for housing of equipment and supplies. see exhibit A —dated 6/1/76). Secondly want to split off 5 acres from plate 2050 as a lot for Judy Moris and split off one additional acre from plate 2050 and added to plate 2100. Questioned access of emergency vehicles. Motion by Councilman Pott 2nd by Councilman Shervheim to approve the 5 acre split off and the additional 1 acre split off from plate 2050 with a private road easement. City to have access for emergency vehicles. Approval subject to agreement entered into: by all parties involved. Carried 5-0. Motion by Councilman Shervheim 2nd by Mayor Eder to approve plat of one acre as per present minor sub -division regulation but also pro- viding for 2 - 33' out lots (A-B, outlot A being tied to the one acre plat) for easement purposes. Carried 5-0. Lake Jane Hills 2nd. Addition: Bruce Folz—The recreational dedication, 7o of lst and 2nd Addition will be dedicated as shown in original plan. Council and engineer advised that utility easement between lots one and two, Block 2, should be increased from 12' to 201. Bond will be required for completion of roads. Mr. Folz asked if a letter of credit was acceptable. Mr. Folz will return to the next council meeting with revised plans for council decision and information on amount of bond. Demontreville Highlands: Roger Derrick- - Questioned whether the city council was in agreement with contingencies. Word has been received from Ray Marshall that Lake Elmo will receive $30,000. from Dept. of Local and Urban Affairs towards acquisition of Park Property. Minutes of Lake Elmo City Council Meeting, June 1. 1976 page 2 Demontreville Highlands continued- Motion by Councilman Abercrombie 2nd by Council- man Shervheim authorizing mayor and clerk to sign contract for the purchase of Demontreville Highlands Park Property subject to conditions specified in counsel letter of March 15, 1976. Cost is $56,250. plus city share of surveyor charges. Carried 5-0. Motion by Councilman Shervheim 2nd by Councilman Pott calling for Purchase Agreement Development Contract but approving previous park contract even if agreement not cleared by park anticipated closing on June 11, 1976. Carried 5-0. Flood Control: Engineer reported elevations on June 1, 1976 were as follows: Long Lake N 938.15 S. 938.12 Olson 929.43 Deer Pond 924.05 Berschens 914.79 Jane 922•38 Sunfish 892.61 Elmo 885.68 Motion by Councilman Shervheim 2nd by Councilman Pott that we cancel contract for rental of pumps and have them removed as of Thursday, A.M. (June 3, 1976). Carried 5-0. Board of Review: Councilman Abercrombie offered Resolution R76-17 requesting county to make overall policy on assessment -of property damaged by flooding. 2nd by Councilman Shervheim. Motion by Councilman Pott 2nd by Mayor Eder to amend resolution so any reduction may not bring the value below 85% of the market value. Amendment carried 5-0. Resolution carried 5-0. Copies of letters presented to Board to be distributed to council before next meeting so they can evaluate and make decision at next meeting of council, June 15, 1976 at 5:00 pm. Roland Bird: Request for minor -sub -division approval. Councilman Shervheim offered resolutiola,F-6 Motion by Councilman Shervheim 2nd by Councilman Abercrombie to approve minor subdivision for Mr. Robert Bird at 2244 Manning Ave. (3.8A pt. SEJ of SE4, Sec. 24) after receipt of a survey of property. Carried 5-0. Motion by Councilman Shervheim 2nd by Councilman Abercrombie to have building inspector check setbacks on Bird application for building permit to assure that it is not in conflict with proposed development of county Hwy. 15. Carried 5-0. Councilman Abercrombie presented Ordinances 7404 and 7405 amending section 301.02 of Lake Elmo Municipal Code relating to Zoning district boundaries and asked for council approval. 2nd. by Councilwoman Lyons. Carried 5-0. Minor Subdivision: Councilman Shervheim requested counsel to prepare resolution regard- ing possible changes in minor sub -division policy for consideration by council. Parking: Mr. Brian Crombie raised objection to continued parking on Demontreville Trail even though no parking signs had been installed. Clerk instructed to write to sheriff and copy Officer Furstenberg. Letter to_ include occasional visitation on Lakes by Officer Orth. Motion by Councilman Pott 2nd by Councilman Shervheim to approve as amended. Carried 5-0. Claims: Motion by Councilman Shervheim 2nd by Councilman Pott to approve payment of claims 76305 thru 76. Correspondence: Letter received from Mr. Licht of Midwest Planning that Barbara Senness has resigned. For time being Mr. Licht will assume responsi— bility for handling Lake Elmo. Contract received from Chicago & Northwestern Transportation Company for annual charges of $114.00 to maintain $" drainage pipeon South side of RR tracks at Klondike. Contract referred to engineer for clarification before approving. Letter from Handcrafts by Randicapped of Minnesota requesting approval to solicit door to door. Council instructed clerk to acknowledge. Letter from Metropolitan Waste Control Commission re Waste Management Policy Plan. Engineer advised that this was in direct conflict with orders from Bob Hoffman head of Physical Development Committee. Otto recommends no action advises we should receive a revised letter within 20 days. Adjournment: Motion by Councilman Abercrombie 2nd by Councilman Shervheim to adjourn at 12:30 pm. Carried 5-0.
