Pott;-.4 MINUTES OF THE LAKE ELMO CITY COUNCIL MEETING, July 6, 1976. Meeting called to order at 6:18 p.m., by Mayor Eder. Present: Mayor Eder, Councilmen Abercrombie, Shervheim and Pott Councilwoman Lyons (6:45 p.m.) Also present: Bldg. Insp.Mueller, Counsel Raleigh and Fna. Noyes(7:10p.m.) Nekton, Inc: 10092 Stillwater Lane, Peter Sajevic. Proposal is for home to have 6 full time residents and a caretaker couple. Present persons considered are six partially mentally retarded women; ages 18-40. Legally the city can't deny request as long as building meets all the code require- ments. Spokesman said last fall communities were in- vited to attend a meeting to offer input. Lake Elmo maintains initial notification was June 9, 1976. Motion by Councilman Shervheim 2nd by Councilman Abercrombie instructing clerk to write letter to Department of Public Welfare that we have reviewed the proposal, we are dis- appointed with late notice, we expect full compliance with the building code and we're confident that these residents will be good neighbors. Carried 5-0. Park Advisory Committee: Dave Morgan explained several improvements that the committee would like approval. Each was re- viewed. Motion by Councilman Abercrombie 2nd by Councilman Shervheim to approve expenditure which total $960. and include 8400. for two picnic tables, one in Lions Park and a second in Demontreville Park; $400, for grass seed for seeding 5 acres of Sunfish Park; $60. for membership in Minnesota Recreation and Park Assoc. ( 9 members) and finally $100. for 2 benches to be installed at tennis court. Carried 5-0. Olinger Plat: Councilman Shervheim offered ResolutionCR76-i1.9`:accept- -- inq the recommendation of the PZC and approvng the minor sub -division plat of Carl Olinger for 2. lots of 1 acre size which abut the South right-of-way of Lake Jane Trail No., in government Lot 5, Section 10, and requested council confirmation. Second by Councilman Pott. Carried 5-0. Moris Plat Approval: Councilman Shervheim offered Resolution R76-20 to approve the minor subdivision plat of the Moris property (N 1/4 of SE 1/4 of. Section 10 ) and asked council confirmation. Second by Councilwoman Lyons. Carried 5-0. Dean Dworak: Motion by Councilman Shervheim 2nd by Councilman Abercrombie to amend the motion in the minutes of the June 15, 1976 meeting to require Mr. Dworak to furnish the City_ with a certificate of survey rather than a registered land survey. Carried 5-0. per. . 2 Minutes of the Lake Elmo City Council Meeting- July 6, 1976 Council meeting recessed at 8:00 p.m., in favor of hearing on 1975 Flood Control Project Assessment. Meeting reconvened at 9:35 p.m. Lake Elmo Elementary School Addition: Mr. Miller, Mr. Jenson and Mr. Windsor appeared relative to the plans for the building addition. Mr. Miller was the spokesman for the school district. Mr. Miller explained how thev were handling their septic problems. He further ex- plained that the increase in rooms would not increase the occupancy. Motion by Councilman Abercrombie 2nd by Councilman Shervheim to approve and authorize building inspector to issue permit. Carried 5-0. Burning: Clerk to investigate possibility of obtaining the Parranto gravel pit on 20th. St., as a burning site for diseased trees. Al Kiemele: Clerk instructed to contact Derrick Lane Company for a certificate of survey of parcels 1-5, SE 1/4 - NW 1/4 Sec. 4, T 29N, R21W. Cert. of Survey: Counsel reauested to prepare a list of definitions including_ registered land survey, certificate of survey, etc. Minutes: Clerk pointed out change on page one under joint meeting; it is W. Schwab rather than N. Schwab Motion by Councilman Shervheim 2nd by Councilman Pott to approve as amended. Carried 5-0. Claims: Motion by Councilman Shervheim 2nd by Councilman Abercrombie to approve claims 76701 thru 76737 and 76751 thru 767. Carried 5-0. Beer License: Motion by Councilman Abercrombie 2nd by Councilman Pott to approve a Temporary 3.2 Beer License for the Lake Plmo Lions --Pioneer Days, July 10 and 11, 1976. Carried 5-0. Sewer Fees: Councilman Shervheim offered Resolution R76-21 establish- ing sewer charges and requested council confirmation. Second by Councilman Abercrombie. Carried 5-0. Bullheads: Conrad Adams raised some concern regarding an excess of bullheads in Lake Jane. Mayor Eder researched and has written a memo, a copy of which will be sent to C. Adams. Lake Elmo City Council Meeting , July 6, 1976 page 3. Dutch Elm: Clerk advised that Forester Beach has submitted four reports of diseased trees on riaht-of-way. Clerk asked for disposition of matter since city has not accepted liability. No action taken. Adjournment: Motion by Councilman Shervheim, 2nd by Councilman Pott to adjourn at 10:35 p.m. Carried 5-0.
