Council members invited to attend PZC Hearina,held on
September 27th., at 8:00 p.m., for the first reading of the
revision to Subdivision Ordinance.

Meeting called to order at 7:35 n.rl. by "layor. F(er.
Present: Mayor Eder, Councilmen Shervheim & Pott and Councilwoman
Lyons.
Absent: Councilman Abercrombie
Also present: Bldg. Insp. Mueller, Counsel Raleigh and Fngineer

Newspaper Boxes: Mike MacDonald advised that the paper was unable
to get door to door carriers and he ended up with a
contract to deliver papers. The only way residents
will get the paper is to accept the tube container for
roadside delivery. Council advised that sore of the
installations were improper and advised that at least
they would comply with post office regulations.
Motion by Councilman Shervheim 2nd hv_ Councilwoman
Lyons to table action until the next council meeting
September 21, 1976. Carried 4-0.

Stankey- Mr.. Mueller submitted a written report on the back-
ground of the Stankey Greenhouse permit. Council re-
viewed and heard comments from the citizens protesting
extension of the permit on the or.iainal structure and
insisting action he taken to guarantee its removal.
Motion by Councilman Shervheim ,'_nd by Councilman nott
to inform Mr. Stankey that his operation is a non-con-
formina use. There is to be no planting of new crop
for the 1977 season. The plant operation is to cease
by January 1, 1977 and the structure is to be removed
by May 1, 1977.
Carried 4-0.
Dogs: Mr. Stanwav advised that a cyclist had been bitten.
It occurred about 2 weeks ago on a Vlednesday n.m.
Owner of the dog is Mrs. Johnson, who lives across
from Stanway. Council agreed to have MApST patrol
this area and see if they find any animal violations.
Bldg. Insp. Requested permission to spend total of one days time
to sit down with Counsel and review ordinances re-
lative to building code.
Motion by Councilman Shervheim 2nd by Councilman Putt
to approve 1 day of conference of Bldc7. Insp, and
Counsel to review ordinances as they relate to the
building code and then mak-e their recommendation for
changes to the council. Carried 4-0.

Sewage: Counsel Raleigh recommended. that Rldq. Insn., Sewer
Inspector and. Engineer Noyes he a committee of three
to review all proposed new systems with FFnaineer to
make final approval.
Clean-up Days --Motion by Councilman Shervheim 2nd by Councilwoman
Lyons to set up clean up days as follows: Lake Fl.mo
Fire Department Parkina Lot on October 16, 1976 and on
October 23, 1976 at Pehble Park. Pours from 2:00 A^,T to
Noon. Carried 4-0.
Dutch Elm: Motion by Councilman Shervheim 2nd by Councilwoman Lyons
to close the burning site on Wednesdays since there has
been little activity. Burnina site will continue to be
open, thru September, on Saturday from 10 AM to 5:00 PEA.
Carried 4-0.
Street Signs --Question was raised relative to who incurs cost of
signs in new construction area. Counsel. advised that
this is part of development agreement. City office to
advise Mr Emerson of his responsibility. City will obtain
and install signs at a cost of $30.00 each (Rsigns).
Public Worhs Law--1976. Fngineer explained that under present regu-
lations the Lake Elmo area would .find it difficult to
qualify.
Rental of pipe for pumping: Engineer received a call from The T,7aste
Vlater Commission, askina if we would rent them the n"
pipe we acauiree to pump Lake Jane.
Motion by Councilman Shervheim 2nd by councilwoman Lyons,
that we approve offering rental of pipe at the same rental
rate we paid.. The pipes would have to be cleaned before
they were returned and gaskets or rubber seals must he in
useable shape. Tom TToyes, Elmer Richert or Bob t,,7ier would
have to be on hand when they picked up pipe and. make sure
they are signed for. Pipe to be returned in a reasonable
length of time. Carried 4-0.
Street Lights --Councilman Pott raised the question of new street lights.
Where buried cables are installed, who pays for moles and
installation costs.
Motion by Councilman Pott 2nd by Councilwoman Lvons that
City revise the street lighting policy to establish a set
of standards for new light installations. There new lights
are requested Citv will arrange for an improvement hearincr
and then an assessment hearing. The total cost of the
installation would he assessed. At the end of each year
property owners would be billed for the power. Carried 4-0.
Demontreville Fi_ghland s--Motion by Councilman Pott 2nd by Councilman
Shervheim that council approve the Develonment Agreement
bets-.een Allied Properties and the City of Lake Flmo and
authorize the nayor and clerk to sign the agreement for
the City. (Copy of agreement on file in clerks office).

County Park: Council discussed the controversy relative to ac-
quisition of park property. Mr. W. Schwab to he
asked to attend the Park Advisory Board "leetinc7,
September 15, 1976 to review the status of park
acquisition and explain his position on some of the
situations currently being created.
Use of Wone Sewer Facilities: *Notion by Mayor Fcger 2nd by Council-
man Shervheim that we establish a rate of 50(�/1000 gals -
estimate for the next 12 month year that the houses
use 75,000 gals of water and the balance used hased
on historical that's being charged will he used to
determine charge to Cross Road Fords and we ask them
no later than January 1, 1977,to install a meter.
$9.00 minimum per quarter for residential.
Carried 4-0.
Schwartz-Martinco--Engineer Bonestroo will check to determine
status of work to satisfactory requirement of city
before closing the files and refunding owners check.
Eden Park
Development Contract --To review and determine if an ex-
tension of bond is required for completion of agree-
ment.
Wage Scale: Plotion by Councilman Pott 2nd by Councilman Phervheim
to establish a minimum wage for non -skilled la.hor at
$2.30. Carried 4-0.
Budget:
Meeting of September 21, 1976 agenda to include
budget discussion from. 5 - 6-:30 p.m.
Minutes:
Motion by Councilman Shervheim 2nd by Councilwoman
Lyons to approve minutes of Auqust 17, 1976 as sub-
mitted. Carried 4-0.
Claims:
Motion by Councilman Shervheim 2nd by Councilwoman
Lyons to approve pavment of claims 76833 thru 76g38
and 76858 thru 76903. Carried_ 4-0.
