(not received as of yet) * Please note additions as of 11/16/76 Minutes of Lake Elmo City Council Meeting, November 3.6, 1976 Meeting called to order at 5:11 p.m. by Mayor Eder. Present: Mayor Eder, Councilmen Abercrombie (5:20) Shervheim and (8:40) Pott and Councilwoman Lyons. Also present: Blda. Insp. Mueller, Counsel Raleigh (9:00) Engineer Bonestroo. Planner Licht, Councilman elect Morgan. McCollar: Motion by Councilman Pott 2nd by Councilwoman Lyons, setting hearing date for consideration of the vacation of lands lying between boundary_ of lots 675-676 and 680-681 and Lake Demontreville for Tuesdav, January 18, 1977. Carried 3-0. Councilman Abercrombie and Shervheim absent at time of vote. Pebble Park: National Guards: Motion by Councilwoman Lyons 2nd by Councilman Pott to authorize city to replace gas used by the National Guard while doing volunteer work at Pebble Park. Carried 3-0. DNR Permits: Fees of. $15.00 ea. required for two permits (Facrle Point and Berschens Pond). Motion by Councilwoman Lyons 2nd by Playor Eder to approve payment of the 515.00 permit fees for the Eagle Point Fork and Berschens Pond permits to the DNR. Carried 3-0. Planner: Preliminary discussion exchanged relative to Metropolitan Land Planning Act. Mr. Jim Christiansen and Mr. Tom Loucks of Midwest Planning also attended discussion. This session was informational not requiring final decisions. Letter from Jim Barton of Metro Council was distributed to be reviewed at council members convenience. Council meeting recessed at 6:35 p.m. Council meeting reconvened at 7:32 p.m. Minutes: motion by Councilwoman Lyons 2nd by Councilman Pott to approve minutes of November 3, 1976 as submitted. Carried 4-0. Councilman Shervheim not available at time of vote. Truck: Councilman Pott advised that used truck which city had been considering _fell thru, it is not available. Maintenance crew Mr. Richert and Mr. Wier to be invited to council meeting December 7, 1976 to review the truck situation. Cimarron: Bldg. INsp. & clerk inspected two differenct car -ports at Cimarron. Bldg. insp. commented on both of these additions. Two individuals Mr. Sammon and Mr. Forsblad will pursue this and probably appear before the council December 7, 1976. Minutes of Lake Elmo City Council Meeting, November 16, 1976--naae 2 Forester: Gerald Beach reported on current diseased tree programs. The only local assistance is to the individual for removal of trees infected with Dutch Elm, amount $25.00. Mr. Beach did not offer any words of encouraae- ment regarding_ possible use of Lianasan BLP. IIe reported that more and more reports are neaative but they are waiting on results of studies by iI. of M. Suggested that burning site be resolved and available early next spring. Merle Payne: Discussion relative to SUP on 40 acre tract of land on Keats Ave. Sec. 3 (NW 1/4 of the SE ]_/4) . Purpose of SUP to put a driveway into his property. Paynes have only a 66' easement for access to their property. They also questioned what they could do if they wanted to split off 5 acre lots at a later_ date. Since a number of legal questions exist relative to sale of properties involved council referred the matter to counsel for review and a recommendation. Davton-Hudson: Officer Furstenberg reported that Parranto had placed a fence across the Private road into the Dayton - Hudson property, however the diseased trees and debris scattered over the property had not been cleaned uP. Counsel instructed to write letter to Parranto advising them that this has to be cleaned up. Investment Framework hearing: Clerk instructed to contact Jim Olson of Juran & Moody and get his recommendation on how Lake Elmo should respond. Paying Agent:Councilman Shervheim submitted Resolution R76-35 establish- ing First National Bank of St. Paul as our paying agent. Second by Councilman Abercrombie. Carried 4-0. Mayor Eder abstained. Liquor Licensee Motion by Councilman Shervheim 2nd by Councilwoman Lyons to approve the Sunday On Sale and regular On Sale liquor license for Tartan Park. Carried 5-0. Motion by Councilman Shervheim 2nd by Councilwoman Lyons to approve the Sunday On Sale, Regular On Sale and Off Sale liquor license for Twi.nPoint Tavern -- Norm Schwartz owner. Carried 5-0. Motion by Councilman Abercrombie 2nd by Councilwoman Lyons to approve the special On Sale liquor license for VF[+? post 5725. Carried 5-0. Motion by Councilman Abercrombie 2nd by Councilwoman Lyons to approve the Sunday On Sale, regular On Sale and Off Sale Liquor licenses for Ben's Elmo Inn. Carried 5-0. Salt -Sand: Motion by Councilman Abercrombie 2nd by Councilwoman Lyons that Lake Elmo purchase its salt sand requirements from Washington County at $5.00 per cu. yard with T. A. Schifskv and Sons at $4.75/ton as a second source. Carried 5-0. Minutes of Lake Elmo City Council Meetinq, November 16, 1976--pane 3 14cCoy: Report of sewer failure by city employees. Bldg. Tnsn. instucted to write letter advising them they were in violation and were required to take corrective action. Plowing: Motion by Councilman Abercrombie second by Councilwoman Lyons that we tentatively approve C. Prancis Oehlke for supplemental snowplowing based on a quotation submitted by Mr. Oehlke and subject to his having adequate safety lights and insurance onhis equipment. Carried 5-0. Claims: Motion by Councilman Shervheim 2nd by Councilwoman Lyons to approve payment of claims 77010 thru 77016 and 77094 thru 77115. Carried 5-0. Insurance: Motion by Mayor Eder 2nd by Councilwoman Lyons that Sonnen-Zignego Insurance Agency be named the agent of record for Workmen's Comp, Casualty and liability insurance for the City of Lake Elmo. Carried 3-0. Councilmen Pott and Shervheim abstained. Adjournment: Motion by Councilman Abercrombie 2nd by Councilman Pott to adjourn at 10:06 p.m. Carried 5-0.
