Absent: Clerk Mehsikomer Also Present: Council Raleigh and Building Inspector Mueller (9:30) Recorder: Deputy Clerx Park Meeting called to order at 7:37 P.M. by the Mayor. Lake Elmo Lions: Motion by Councilman Shervheim, seconded by Council- man Morgan, to issue the necessary permits to the Lake Elmo Lions for holding of their annual Fishing Contest, February 5 & 6, in Lake Elmo with all fees being waved by the city. Carried 5 - 0. Deputy Treasurer: Motion by Mayor Armstrong, seconded by Councilman Shervheim, to appoint and confirm M. Banister as Deputy Treasurer of City of Lake Elmo. Carried 5 - 0. Park Committee: Councilman Morgan indicated that there are vacancies on the Park Committee with the resignation of R. Louge and others. He moved, seconded by Councilman Shervheim, that Tom Monette and Peter Warner be ap- pointed to the Committee. Carried 5 - 0. The Park Committee is proposing an outing where -by the citizens could acquaint themselves with the new City park on a week -end day the last of February. Councilman Morgan requested that the City appropriate $40.00 for expenses to cover Satelite costs for the event. Mayor Armstrong so moved, Councilman Sherv- heim seconded. Carried 5 - 0. Reed Park: Councilman Morgan questioned the status of Reed Park. After discussion among council members, it was sug- gested that Councilman Morgan meet with J. Eder and P. Scheltgen. Midwest Planning: David Licht and staff appeared to discuss 1976 Plan- ner invoices. His main concern was that of recent statements which appeared in a recent newspaper art- icle over which the City Council has no control. He reviewed the changes or billing relating to the Meeting Minutes Page two. Comprehensive Plan for the City and explained the added costs or over -runs. They related to four causes: a. Necessity for an inventory, b. City Council was not involved enough or gave proper directions, C. Necessity of reprinting report, and d. Attendance at extra hearings. He explained that the added cost of technical assistance was for study related to I-94, review of 3M's IEA study, Washington County Sewer Plan, Regional Park study, Metro System Statement and a "catch-all" comprehensive work. To maintain better control of expenditures, he suggested the following: 1) That all pre -application conference be part of the monthly retainer fee of $600. 2) That Midwest present a cost estimate before undertaking any study or special project. 3) Do special studies or projects under a cost increment or lim- ited cost contact with authority vested in one individual who can authorize next increment or added cost over -run. 4) Require a pre -deposit to cover any pass thru costs on part of individual. No council taken on outstanding invoice or recommended course of action resolving this matter. Lake Elmo J.C.'s.: M. Johnson and L. Lancaster approached the City Council on behalf of the J.C.'s of Lake Elmo with suggestions of better utilization of the Council Chambers by rearrangement of furniture, mounting a projection screen, and realignment of light switching. On a motion by Councilman Shervheim, seconded by Mayor Armstrong, to permit the Lake Elmo J.C.'s to undertake modification of the Coun- cil Chambers as described and drawen with no lia- bility on behalf of the city, financial or other wise, to proceed at their leisure; also, a key to the Chambers is to be given to the president of the organization who assumes responsibility there of. Carried 5 - 0. City Insurance: V.G. Douglass, agent, Fireside Insurance Center, appeared to make Council aware that certain in- surance policies are about to expire. He also pointed out that the buildings were under insured as per recent appraisals. His figures were, Fire - Hall $98,922 (taken at $26.00/sq.ft. vs. coverage of $43,600) and City office and garage $49,500 (taken at $24.95/sq.ft. vs. coverage of $23,000). Meeting Minutes Page three. It must be noted that it is required that property be insured for 80% of its estimated replacement cost in order to collect full face value of insurance in effect. Jack Zignego was called. Upon his arrival the in- surance matter was discussed in length. Zignego had been indicated as the Agent of Record for Lake Elmo for the purpose of obtaining bids for total coverage of the City's needs back in November, 1976. He responded that bids are in process of being gath- ered and that Fireside Insurance Center was not con- tacted and that all companies contacted were repre- sented by Zignego as an agent. There appears to be a misunderstanding as to the meaning and responsi- bilities of an "Agent of Record". The matter is to be resolved at the Council's meeting of 2-15-77, when bids are received. Meanwhile on a motion of Mayor Armstrong, seconded by Councilman Pott, that all present carriers of any Lake Elmo City insurance which is about to expire on or before 2-15-77 provide the necessary binders to keep insurance in effect till the meeting of 2-15-77. Carried 5 - 0. Energy Crisis: Mayor Armstrong reported on the Governor's letter on the present energy crisis. The council concures on the situation; however, because of the City's limited operation and resources, requires that reasonable con- servation measures be initiated by personnel of the City at this time i.e. setting thermostat at 65' and 60°, control electrical usage, etc.. Water System: Councilman Pott reported that there has been nine re- ported freeze -ups in the water service thru 1-29-77. At this time it appears the situation is under control. Keys: The deputy clerk is authorized to provide the City police office the necessary keys for public buildings on behalf of the City Council. Fire Code: Council Raleigh reported that he is working on this at the present time. Mayor Armstrong presented and read a St. Paul ordinance on smoke alarms. Council refer- red to attorney who is instructed to prepare a similar one but with an effective or implement date no later than October, 1977. Draft to be ready for review 2-15-77. Fire Prevention: It was reported that the Fire Department is prepared and willing to present a fire prevention program to the home owners of Cimarron upon request. It was pointed out that smoke detectors, periodic furnace Meeting Minutes Page four, filter inspections, and fire extinguishers are nec- essary in each Mobile Home. Mayor Armstrong will work with representative of the Home Owners Association at Cimarron on the program. Planning Seminar: Councilman Pott moved, Councilman Shervheim seconded, that the City will pay for the $25.00 registration of any Council or Planning Commission member attending the Planning and Zoning Institute meeting February 24 and 25th at Bloomington, thus encouraging members attendance. Carried 5 - 0. Eder Plat: Councilman Pott moved, Councilman Shervheim seconded, that the City return F. Eder's check, posted as bond for Eder Plat. Upon passage of motion, deputy clerk is so instructed. Carried 5 - 0. Claims: Motion by Councilman Shervheim, seconded by Mayor Armstrong, to approve claims 77236 thru 77263 for payment. Carried 5 - 0. Midwest Planning and Itasca Equipment were held in obeyance. Lake Elmo Airport: Metro Airport Commission's letter regarding air space easements in connection with Lake Elmo Airport is tabled till 2-15-77 meeting. Meeting adjourned 10:15 P.M. f W. R.
