Meeting called to order at 5:05 p.m. by Mayor Armstrong. Present: Mayor Armstrong, Councilwoman Lyons, Councilmen Shervheim, Pott and Morgan. Also Present: Counsel Raleigh, Bldg. Insp. Mueller (7:30) Pngineer. Noyes (8:12pm) and Sewer Insp. Prier (5:05-6:20). Hjelmgren SUP: A neighbor requested that she be in attendance when the Hjelmgren matter was discussed. She was informed that the item would be discussed on the agenda at-8:15. She was not informed of the agenda revision. Motion by Councilman Pott 2nd by Mayor Armstrona to defer action on the SUP until 8:15 p.m. --Carried 5-0. Sewer Inspector: Mr. Wier made a presentation on a new septic system ordinance and proposed amendment. The proposed ordi- nance is based on input from the Citizens Advisory Committee to the Minnesota PCA, Mr. T-7ier had attended a workshop which discussed. the proposal in detail. Ile recommends general acceptance of the ordinance but asks for modifications so that maximums expressed in our current code are not reduced. Copy of proposed ordinance on file in city office. Coordinator: Mr. Lawrence Plhittaker has been in contact with Mahtomedi. regarding salary proposal. Tle advised that the original offer of $15,000. was not adequate and asked for ad- ditional $3,000. because of cost of living in Twin City Area. Mahtomedi had negotiated an agreeable salary of $17,000. plus benefits which imuld he 1�2,0n0 to $2,500 extra per year. Time spent representing each community would be logged so a o breakdown of cost could be determined. Council Items: Fire Truck-- Councilman Pott advised that specs were now available for the new truck. Copies of spec to be distributed to council. Council has until April 251 1977 to respond relative to changes. Motion by Mayor Armstrong 2nd by Councilman Pott to authorize clerk to proceed with request for bias based on specs submitted by fire dept. Carried 5-0. Parks--- Councilman Morgan expressed concern over responsibility for use of lights at ball field. Suggested installation of a timer; council agreed. John Mueller offered to donate a timer. An electrician will have to he hired to install. Suggested we hire same electrician that originally installed the switches sincehe. is familiar with this particular set-up. Discussion regarding well in Pebble Park. Fnaineer Frigaard agreed to go back to the contractor (Renner) and determine condition of well and tank and if it is defective that it will be repaired free of charge. MINUTES OF THE LAKE ELMO CITY COUNCIL MEFTINC,, APR.IL 19, 1977. Pa.? Council Items: Parks-cont'd.--- Reid Park ---Councilman Morgan advised that he had been in contact with attorney for A. Reid and he agreed that it would he a good idea to submit a written proposal to him. Counsel Raleigh will prepare the proposal. Advisory Committee to Council-- Councilman Morgan advised he still favored formation of such a committee. With council approval he will put together a proposal for the next meeting. Metro Park Reserve --Mr. Schaefer advised that the farm land in park has been renter? for 53,000. Mr. Schaefer advised that city should be getting 30% of all revenues from park land. To date no payment has been receiver?. by Lake Elmo. Councilman Morgan will pursue this with Mr. Schwab. Speed Lir!.it--Olson Lake Trail. Residents complaining. Mayor Armstrong discussed this with Officer Swanson and he agreed. speed was excessive for conditions. List of streets on which speed zones have been established to be reviewed to determine if there are others that should be reconsidered. Park Advisory Committee --Submitted annual report. Councilman Morgan made presentation of appreciation awards to R. P. Abercrombie, M. Eder, C. Brockman, J. Mottaz, Ruthmary Logue, L. Friedrich, Lake Elmo Jaycees and 682nd.. Engineering Battalion. Hjelmgren SUP (8:15) - Mr. & Mrs. Osborne were given an opportunity to express their feelings about approval of requested SUP. Mr. Hjelmgren was allowed to offer his rebuttal. Councilman Shervheim offered Resolution n77-3, a resolution approving SUP of. Mr. Hjelmgren at 10899- 32nd. St. North subject to certain conditions expressed by PZC and Council and asked council to consider adoption. 2nd by Councilwoman Lyons. Carried. 5-n. Metro Systems Statement --Engineer Noves--Discussion of Engineer response to Mr. Ron Nelson letter disapproving the engineers original report. Discussion covered 3M problem, the pollution question and sewer status in general. Council decided to defer action for another 2 weeks because of the length of the meeting. Sewer study for old Lake Elmo Village will be completed in two weeks and added to agenda of Play 3, 1977 meeting, Forester---r'erald Beach: Discussion regarding Dutch Plm disease and Oak Wilt disease. Lake Elmo disposal site closed by PrA. Closest disposal site to Lake Elmo is Pine Pend f_acil.ity. County will have a site in "lay Township --scheduled to open June 1, 1977. Counsel recommended that we appeal closing of Lake Elmo Site. Council advised that diseased trees in right-of-wav are responsibility of land owner and forester should act accordingly. I-94---------------- Motion by Councilman Shervheim 2nd by Councilman Morgan to establish a committee of Councilman Shervheim and Pott to examine the I94 matter in light of the opinion, the facts that have changed and then present that position statement to the council at the next meeting which they can then accept or reject. This would include information on any action planned by involved surrounding communities. Carried 5-0. Newsletter ----- Motion by Mayor Armstrong, 2nd Councilman Shervheim that each committee of the city appoint a member who would act as a liason member of the publications committee, to furnish any article that that committee may want published in the newsletter. Carried. 5-n. PZC------------- Appointment of a new member to replace Tom Torseth. PZC having problems with quorum. Two applicants, Hesse and Michels will be considered at next meeting. Others could be considered if so desired but an appointment should be made. Coordinator------- Motion by Councilman Pott 2nd by Councilman Shervheim to proceed with a formal arrangepent with Mahtomedi to share a coordinator or "administrator" for a 1 year period. Carried 5-0. Motion by Mayor Armstrong 2nd by Councilman Pott to authorize clerk to arrange for equipment for coordinator. Carried 5-0. Correspondence: DeCoster Co.-- If sewer is available it is available through Metro Council not through the City of. .Lake Elmo. Lake Elmo has no provision for supplying Prater_ in this area. Fire Dept. --Robert Dennis and Ray Sachs have submitted written notice that they would like to exercise their right of retirement upon completion of 20 years of service. Parranto--Reauest to remove lot access and ecgress .road to property located at 9352-10th. St. No. -Lake Rlmo, is in agreement but since this is a county .r_oad,matter should be referred to county. Larry F. Lanz --Letter advisina that he was not paying the Flood Project 1 assessment since there teas a class action lawsuit underway. CETA-Youth Program --Letter from Sue Sullivan advising that Lake Elmo would probably be entitled to one mare youth than we had last year. Councilman Pott advised that we can utilize 3 youths and that clerk should proceed on that basis. Letter from Minn. Dept. of Health advising us that Elmer Richert had qualified as a Class C-water Supply Systems Operator.
