Members- Councilmen Shervheim and Pott Special meeting June 7, 1977 at 3:OOnm in the Lake Elmo City Council Chambers. Councilman Shervheim explained that since the last meetina a copy of the petition which was presented to the Minnesota Environmental nuality Council and apnarently ignored by them and signed by some over 700 people, not all from Lake Elmo, urging that the Northern route be considered,has been made available to US. Additional petitions were added to the original file and Councilman Shervheim acknowledged receipt. He read from the petition ---the undersigned taxpayers and/or residents of 1ashington County joined in this petition to urge the governing bodies of Washington County and the municipalities in which they own or occupy real estate to join in judicially Challenaina the selection of the nresent Hiahwav 12 as the route for construction of I-9A and to substitute therefore the Northern route. There are a number of whereases, citing economy of the Northern Route, timesaving and safety --it is therefore urged by the undersigned, manv of whom have pledaed their own funds and support thereof that Washington County and the municipalities in such county through action of their re- snective aovernmentina bodies agree to actively sunnort and commit a portion of the county and municipal funds in their custody to support a judicial. review and challence, 100 additional signatures. Members reviewed addresses of signers of netition. Review of nledcRes revealed that $12,900.was reported. Councilman Shervhein- ---Other things that influence my judgement are the monies that the city has spent in planning, the 2n million dollars of admitted extra costs of going the Southern Route, the maintenance cost of service roads which would have to be installed along the Southern Route which would not he required on the Northern ??oute, at least not in the same dearee, because the Southern Route could he used to carry the traffic while the Northern Route was being con- structed andthen service roads would only have to he constructed as the need demanded it which may be 20 or 50 or 5 or 10 vears from now. A delay of 5 years would perpetuate that anci I apes the other thina that imnresseel me is the pretty significant display of interest by quite a few People. The uncertairtty of br.ir_aina or of success in a lawsuit is ever present. If the delay of bringing it were material that would affect my judgement thev are still just in the process of identifying the tracts on which condemnation has to be commenced. Looking at the court calenders, at least in Wash- ington County, I don't see a significant difference in the time when they could move forward with the Southern Route whether we now take a few months to ask the court to determine whether this selection was reasonable. If it is successful and the Northern Route does prevail we gain 5 years. If it is not successful then I don't think we have caused a significant delay because they are not ready to start. I would like to see us authorize some amount of city funds to be expended for this purpose but that it be subject to the county Minutes of Special Committee of the council on I94. bane 2 and other municipalities, other corporate and perhaps individual landowners supplying the rest of the funds and that if we don't get them by a certain future date, a near future date, that then we call this off and make the best of. the Southern Route. Councilman Pott --- I agree with that and also with vour last comment we have to go one way or the other in the near future. The one concern I have is that we are at $15,000. and would envision an expenditure from the city, on the order of 55,000. as opposed to a bigger number. Somewhat in line with what other_ municipalities and individuals have contributed. I can't see the city making up the difference. Councilman Shervheim---I think the bulk of the money would have to come from the county, the county is going to incur the greatest saving of course. They will be saved the expense of building a 10 mile stretch of local collector roads. Councilman Pott--We are 40% of the way if the city went in with what I consider a manimum of $5,000. Councilman Shervheim--I would like to submit the 2nd resolution or something like it and recommend its adoption to the city council and you would fill in the amount, not to exceed $5,On0. Is July 1 a reasonable date to set as a deadline for the others to express an interest? Councilman Pott--I don't think it should be any longer than that. We revitalized this about March. If we can't nut it together in 90 days maybe we shouldn't try any further. It is Bettina to be a rather old subject. July 1 is reasonable. Councilman Shervheim---•Should this then be our recommendation to the council with $5,000. number. Councilman Pott---I don't know how broad that power is in the bottom paragraph. Councilman Shervheim- -Subject to approval by the city attorney of course. Councilman Pott--If that in any way jeopordizes the whole thing we can use di_fferect words or scratch it. Councilman Shervheim---The only purpose of leaving that in was to leave on the shoulders of the same people who carried it thus far the obligation of going forward.. Model Zoning Regulation Code Minutes of Lake Elmo City Council Meeting June 7, 1977. Meeting called to order at 7:37 pm by Assistant Mayor Shervheim. Present. mayor Armstrong (7:40), Councilwoman Lyons 7:40 and. Councilmen Shervheim, Pott and Morgan Also present: Counsel Raleiah, Bldg. Insp. Mueller, Fnaineer Noyes, Planner Loucks and Adm. Assistant �,Thittaker. Oaces: Presented city with two checks amounting to $1,03.1.01 to cover pass thru expense which they had been billed. Sub- division Lot 6-Block 1, Oace 4th..Addition. Oaces have put together all of the details which have been requested by the city and its officials. Motion by Councilman Morgan 2nd b_y Councilwoman Lyons to give tentative approval to Preliminary plat subject to satisfying city counsel and city engineer that all of the special requirements had been met. Carried 5-0. (To be scheduled on agenda of 6/21/77) Water Tower-- Paint is again peeling off of the legs on the water tower. This is a repeat of last years problem. Caused, as some citizens have pointed out, by improper preparation before painting in 1975. Tom Bidon: 8528 Lake Jane Trail --Possible change of layout at the intersection of Lake Jane Trail, 45th. and Irish Court. Road design is presently a curved corner. Recommendation is to make this intersection a 900 corner with two stop signs. Motion by Mayor Armstrong 2nd by Councilman Pott to allow the developer (Mogren-Shrier) to hold off on road for a month to allow engineer to determine feasability and cost estimate. Carried. 5-0. I-94 -- Councilman Shervheim of_fereO Resolution R.77-6 outlining Lake Elmo's position relative to contributing toward and entering into a lawsuit challenging selection of Southern Route for I-94 and asked council acceptance. For —Councilwoman Lyons (see transcript for comments on conflict of interest) Councilmen Shervheim and Pott. Against ---Mayor Armstrong and Councilman Morgan. Carried 3-2 J. Mueller-- Uniform fire code. Modeled after Oakdale. Council delegated Bldg. INsp. Mueller & Duane Grace to advise counsel how the standards in the new fire code will effect these existing uses we're concerned about so that counsel can advise council what their responsibility is that is all that is necessary and then it can he considered by the council for adoption. House size -current minimum 1150 sq. ft. county minimum is 960 sq. ft, living space. This may be included in the zoning Minutes of the Lake Elmo Council Meeting, June 7, 1977, pq, 2 J. Mueller --Uniform fire code continued -- ordinance but new ordinance does not include a definite dimension at this time. When zoning ordinance is up for final approval 960 sq, ft, will be considered. Bruce Folzs Motion by Mayor Armstrong 2nd by Councilman Shervheim to approve the request of Bruce Folz to retain the city engineer to design streets and storm sewers on the Lake Jane Hills 3rd, Addition and the Eden Park 2nd, Addition, As part of the approval, city would be developing a set of standards on these type projects, only these two projects are included in the authorization any additional projects would have to be submitted for special approval., Carried 5,0, Subvdivision regulations This should be scheduled for discussion and action at the council meeting June 21, 1977, PZC Secretarys Motion by Councilman Pott 2nd by Councilman Shervheim to approve per meeting rate of $2.5.00 for the recording secretary of the pzc on a temporary basis. Final decision will be reached when job description for M.r. Whittaker has been finalized, Carried 5-0, St, Paul. Post Office Street Naming Committees Motion by Mayor Armstrong 2nd by Councilman Shervh.eim to appoint Mr, Duane Grace to the St. Paul Post Office street naming committee. Carried 5-0. Mr, Grace also represents Oakdale, PZC Appointment: Motion by Councilman Shervheim 2nd by Councilman:�?ott to approve the appointment of Mr, Michels to fill out the term thru Dec, 31, 1978 on the PZC, Carried 5-0, PZC Attendances Motion byCbuncilman Pott 2nd by Councilman Shervheim that the council request the pzc to review their attendance problem and make a recommendation for change to the city council. Carried 570, Sewer Study Committee— Motion by Councilman Shervheim 2nd by Councilman Morgan that the Ad Hoc Sewer. Committee,to study the current sewer problem in the old Village of Lake Elmo, be composed of the following members Louis Urtel, John Patton,.Bernard Froehner, Anton Friedrich, Conrad Adams,. Todd Williams, Kent Voge and Hugh :Madsen, Carried 5-0, Snowmobile Club---re.quested opportunity to meet with the city council. to discuss trail thru park. Council. recommended that the club make their presentation to the Park. Advisory Board. at their meeting on June 22, 1977 at 800 p,m, Leroy Voel.tz appeared relative to improvements on lst, St, N „ Emmanuel and ideal. Council explained that the streets were never brought up to standard and as a result has never been accepted as a city street, It was suggested that they submit a petition of the residents requesting action required, Minutes of the Lake Elmo Council meeting, June 7, 1977. pg. 3 Systems Statement --After considerable discussion it was decided to delegate Councilman Pott to come up with what is hoped will be the final draft to be presented at the June 21, 1977 meeting. Mr. Whittaker and. Mr. Grace will also be involved in the final draft. Trees --Dutch Elm --Councilman Shervheim offered Resolution R77-5 to establish a program acceptable to the state for individual rebates for cost of tree removal and asked its eoption. 2nd by Councilman Morgan. Carried 5-0. Minutes--- Motion by Councilman Morgan 2nd by Councilman Shervheim to approve the minutes of May 17, 1977 council meeting as submitted. Carried 5►-0. Claims---- Motion by Councilman Shervheim 2nd by Councilman Pott to approve payment of claims 77491 thru 77562, Carried 5-0. [eater ----Engineer to advise estimate costs of extending_ main from Hwy. 212 to the new Brookfield Bldg. Broom ----- Motion by Councilman Shervheim 2nd by Councilman. Pott to purchase the broom, which is an accessory for use on the Scout Tractor, for $375.00 from the fire dept. Carried Budget--- Clerk requested council members to start preparing budget requests so this matter can be resolved before the final due date of Oct. 10, 1977.
