HomeMy WebLinkAbout10-11-77 CCMJoint Meeting, Lake Elmo City Council and Lake Elmo PZC--October 11, 1977 Present -City Council: Mayor Armstrong, Councilman Shervheim, Pott and Morgan and Councilwoman Lyons. PZC: Chairman Grace and members Novak, Lundquist, Crombie, Sovereign, Johnson, Dreher & Michaels. Meeting called to order at 5:24 p.m. jointly by Mayor Armstrong and Chairman Grace. Mobile Homes --Bldg. Inspector Mueller advised that the state has passed a regulation imposing responsibility for mobile home in- spection on local government. This must be set up and a local code adopted by July 1, 1978. If we don't the state will perform the function and charge us $15.00 per hour whether or not we set up a charge program for inspections. This is separate from the State Bldg. Code --it is a separate mobile home code. L. Anderson: -Mueller -A fellow called me up and asked that I inspect 2 units that I have that are prefab down here in Afton to see if they meet the State Bldg. Code. I went down there and checked them over and as far as I could tell, with some minor changes, they did meet, in fact, the Bldg. Code. I did not measure them for size because I didn't know he ever intended to bring them into the village. Ile said he was going to put them together, add on the necessary to make the square footage etc. etc. I said fine and dandy and he was going to go into Eden Park as he was looking at a lot there. That was the last I heard of it until a few weeks ago I got a call from the man and he said do they still comply and he met me at the council meeting one night and yakked about it and I said well don't forget if you're going to move them into the village you'll have to get a moving permit and you're going to have licensed mover bring them in and we ask for $1,000. bond in case there is any damage to the roadway or the curbs etc. fine --the next thing I know he says Do they still meet the code? He says, I'm finalizing my deal with Tom Schwartz. I said, don't forget to get the permit now. He says they're being moved at 2:00 o'clock tomorrow morning. I said you better come in at 8:00 A.M. tomorrow morning and take out the permit. So that hadn't been done; that in the meantime everybody got shook up about it because they are tar paper covered. They are not very presentable and last Tuesday night, if the council remembers, I spent about 1-1/2 hours in the back room with this person and his plans are not acceptable, so right now the situation is just sitting there. I've tried to catch him living in it. Raleigh --John, did you call Ray Marshall? He is expecting youto call and fill out the complaint on bringing them in without a permit. John Mueller--Ok I'll call him tomorrow. So that is the situation with this gentleman and as usual were a $ short and a day late. These things happen so fast and you can't get around to all of them but we will prosecute him on that score and once he gets that squared away if the buildings page 2 Joint Meeting, Lake Elmo City Council and Lake Elmo PZC, Oct. 11, 1977 L. Anderson, cont'd.--are brought into line as far as a valid permit is applied for and the plans do show up validable, then he will get a permit. But I had a heck of a time pinning him down. First he wanted a garage as part of the house -then he wanted to detach it -then he wanted an accessory down here and I told him no way. Well he says I want to store my boat- and I said by the way is that going to be a commercial enterprise or is that just a private hobby. Well he said strictly private. Well then I'd suspect that you'd sign a letter stating so to allay any fears that some of the neighbors might have and I don't think that's unreasonable in the approach. So, so far the residents down there checked out his references, found out he's been kicked out of Afton according to the sheriffs deputy. That's heresa_y tho. Raleigh --I think the significant thing is he brought this junk in without a permit whether it meets the code or not. If you're not going to have a continual problem we should jump on him hard now. I think you should get into Ray right away -sign a complaint -take him into court and then we can consider it after that. That will be taken care of tomorrow. Bldg. Insp., John Mueller, suggested to the council that they consider that the position of bldg. insp. in this village should be, very shortly, a full time occupation. Planning Assistance Guide Application -Tom Loucks, explained the Community Grant Application (Copy on file in city office) Grant amounts requested -Community Comprehensive Planning Fund Entitlement $6,252..00 and Special Planning Problems Funds Requested $4,000.00 for a total of $10,252..00. Mayor Armstrong offered Resolution R77-10 requesting Planning Assistance Funds. 2nd by Councilman Pott. Carried 5-0. I94 Frontage Roads --Engineer Noyes and Adm. Assistant Whittaker explained. Council and PZC discussed all of the possible options. The highway department, per Mr. Whittaker, would be making a cost study at their expense, of the attached detached roads suggested. An informational meeting will be scheduled at some later date at which citizens from each affected section would be invited to attend to see how the roads would affect them personally. Any decision on what roads the city is interested in will be withheld until cost information is available, early in 1978. Recess at 6:30 p.m. Reconvened at 7:35 p.m. Planning Proposals --Since two planners had requested more time, Mr.Whittaker allowed time up to October 18. Planned to ask council to review these between 5:00 p.m. and 6:30 p.m. Midwest Planning, Barton Ashman, Gunnar Isberg, Wehrman Chapman, Charlie Tooker and Tom Loucks will probably be the firms considered. page 3 Joint Meeting, Lake Elmo City Council and Lake Elmo PZC, Oct. 11, 1977. Meeting recessed in favor of hearing on moratorium; Moratorium --Hearing called to order at 8:00 p.m. by PZC Chairman Grace. (for individual detail, tape recording of proceedings on file in city office.) PZC Chairman adjourned hearing at 9:55 p.m. Meeting reconvened at 9:55 p.m. Motion by Mayor Armstrong 2nd by Councilman Morgan to approve a 6 month moratorium on all planning except for those applications which have been submitted to the PZC prior to October 1977. Councilman Pott offered an amendment to change the deadline from 6 months to February 28. Amendment failed for lack of a second. Vote on motion was as follows: For -Mayor Armstrong and Councilmen Morgan and Pott. Against -Councilwoman Lyons. Absent -Councilman Shervheim. At time it was assumed motion carried 3-1, however, counsel explained that motion required a 2/3 vote of all members of the council so motion failed, 3-2. t4eeting adjourned at 10:52 p.m.
